Comparison of disciplinary measures used in the Czech Republic and France

ABCTRACT The main purpose of this thesis is to compare the disciplinary measures used in the Czech Republic and France, especially at the first level of primary school. Two interviews were used for the comparison, one with a teacher from the Czech Republic and the other with a teacher from France. In the practical part, documents dealing with punishment and disciplinary measures were also analysed. It was found that disciplinary measures based on school regulations differ in the two countries. In the Czech Republic disciplinary measures are given per term, in France measures that are given immediately are preferred. However, disciplinary measures in France do not differ much with some punishments that are also used in the Czech Republic but are not mentioned in the school regulations. As this was qualitative research, we cannot generalise such results. Both teachers are satisfied with the disciplinary measures available to them. They agree that immediate punishments work better for younger pupils, with both of them often using a mandatory rewrite of the rule the pupil has broken. Disciplinary measures are closely related to corporal punishment; if a child is punished in the family, this has an impact on his or her behaviour at school. The current questions of the juvenile justice system with a special focus on the educational measures

This thesis is aimed at the current issues of juvenile justice system, especially the educational measures. The center of attention is the youths responsibility for their illegal acts, alternative process and measures, which are set up against the delinquents. Statistics show how the criminality of young people appears at present and what sanctions are taken against them. The main focus is aimed at the educational measures, which are specific to the type of sanctions imposed on young delinquents. The practical part shows the description of sample cases, where educational measures were imposed on young people. In conclusion is a recommendation and some incentives how to improve the current situation in juvenile justice system.
Educational Measures in Practice

The bachelor thesis is focused on educational measures that are imposed to juvenile offenders for their offenses according to the Law on Juvenile Justice. First, I want to characterize this law and development of this branch. Further description is focused on the principle of restorative justice and individual educational measures which are imposed to adolescents and children under 15 years old. The conclusion of the theoretical part is devoted to the role of the Probation and Mediation Service and of the social-legal protection of children and to brief comparison with measures that are imposed to juvenile in Slovakia. The practical part is realized by using qualitative research and technique structured interviews. The research was conducted with nine respondents which were employees of the Probation and Mediation Service and curators for children and youth. They answered on thirteen questions. I want to find out which education measures in practice are actually imposed which are imposed the most frequently and for what offenses. The next question I want to resolved were information about performance and control of the education measures. I also wanted to know how respondents assess the effectiveness of these measures and how the adolescents and their parents cooperate with them. The aim of the bachelor thesis is to show the problems associated with special educational measures that are imposed to delinquent juveniles and find out which of these educational measures are used in practice and how its performance looks like. In conclusion, based on the investigation I found out that the most imposed educational measure is supervision of a probation officer. I also figure out that common offense which is committed by juveniles is theft. Respondents evaluate the effectiveness of educational measures positively as well as cooperation with minors.
Social tutelage at work with educationally troubled children from primary schools

The thesis is focused on pedagogical problem children from primary schools, which are in the care of tutelage. The theoretical part explains who are educationally troubled children and what measures can be taken elementary school. Here are inappropriate family environment, special attention is paid to the developmental specificities of these children. The theoretical part of the work is concluded with a chapter on social tutelage, which explains in detail the activities of the social worker for children and youth in the social and legal protection of children. The empirical part of the thesis is composed of a qualitative research focused on these children. Using case studies shows the specific process of tutelage in solving the problem educate primary school children.
