Securing of public order in the Czech Republic and the State of Israel

Topic of this thesis is securing public order in the State of Israel and comparing it with securing public order in the Czech Republic. In view of the current security situation in Europe and its development, the Czech Republic is also currently facing new challenges in the area of securing public order. The State of Israel is a country that has been facing threats of destruction from its enemies from the day of Israel's creation. Ensuring security and the sole existence of the State has become a major priority for Israel, and thus studying Israel's ways to secure public order is, in my view, useful and in certain aspects also inspiring. This thesis presents a detailed view of Israel's methods of securing public order. It also reflects the social and historical context which is an integral part of the Israeli public order legislation and which is essential for correct understanding of the Israeli approach to provide security to its inhabitants. I compare the most important aspects of securing public order in the State of Israel with the ways of securing public order in the Czech Republic. This thesis is divided into six chapters. Administrative infractions against public order

This dissertation deals with the topic of minor offences against public order. While working on this dissertation there has been a major change in the law, where the act number 200/1990 Sb. about minor offences was replaced by two new acts. Firstly it was replaced with the law number 250/2016 Sb. about responsibility for minor offences and the legal proceedings (furthermore minor offense law) and secondly with the law number 251/2016 Sb., about selected minor offences. This thesis aims at the area of minor offenses against public order regulated in the act about selected minor offences, it describes individual offenses and analyses whether there has been any change compared to previous regulations. This dissertation consists of seven chapters. In the first chapter I deal with the definition of a minor offence. I describe the individual definition of minor offences and describe its particular features. The second chapter follows the first; I deal with the responsibilities for offences caused by legal entities and business individuals. This modification was not previously included in the offense law, and I would like to describe the individual bases of responsibility for these subjects. Anti-riot unit of the Regional Police Directorate of the Pilsen Region, the issue of interventions under the unitary command of Police of the Czech Republic

This bachelor thesis deals with the issue of the Anti-riot unit of the Regional Police Directorate of the Pilsen Region which protects the security of people, property and public order. In the theoretical part there are firstly defined the basic terms concerning the Police of the Czech Republic and the anti-riot units. Further described, we can find the tactics of intervention, training, weaponry and equipment. The aim of the bachelor thesis is to compare a purposefulness and exploitability of the Anti-riot unit of the Regional Police Directorate of the Pilsen Region in terms of a deployment frequency and means for the observed period. The hypothesis of the bachelor thesis consists in the fact that the number of deployment of the Anti-riot unit of the Regional Police Directorate of the Pilsen Region and the number of interventions under the unitary command has an upward tendency from its inception to the present. The quantitative data showing a workload of the Anti-riot unit of the Regional Police Directorate of the Pilsen Region are compared in the empirical part. These interventions are divided according to the kind and the data are always for the period 2005-2015. These data were gathered by the analysis of the deployment and training assessment which is annually drawn up by the chief of the Anti-riot unit of the Regional Police Directorate of the Pilsen (Westbohemian) Region. In the discourse of this bachelor thesis there are all the previous data evaluated. Some kind of an anti-riot unit deployment are presented with the specific case of security measures. They are the ones I have taken part in, and I can draw on my own experience. Based on the analysis, it is possible to state that the number of anti-riot unit deployment has an upward tendency. The anti-riot establishment has been useful and its activity in the field of security of life, health, property and public order helps with an incident-free functioning of our society.

(ENG) Refusal to recognize and enforce arbitral award under Article V, paragraph 2 (b) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 Public policy exception is a deeply rooted instrument used in international documents governing the recognition and enforcement of foreign dispute resolution decisions. It was included in the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards of 1958 since its very first draft, which actually aimed to reform the system of recognition and enforcement of foreign arbitral awards at the time governed by Geneva Protocol and Geneva Convention. Article V section 2 b) of the New York Convention which embodies the public policy exception is quite commonly described as the weakest and the most problematic part of the Convention. In the thesis at hand, the author analyses this provision and conducts a research to find out whether and why the provision is problematic in the practice of the courts. In the first part of the thesis, the author describes the legislative process of the scrutinized provision. Prague City Hall's attitude to prostitution

The diploma thesis The City Hall of Prague attitude towards prostitution is based on the constructivist paradigm and uses feminist theories. It examines, by means of a critical reading, the attitudes of the City Hall of Prague towards prostitution and its development in course of time. The period of investigation was determined by the beginning of municipal intention to introduce a regulatory bill. For this purpose all the relevant press releases from the period 2003 and 2015 were gathered. These documents are concerned with prostitution and they are accessible on press service section of www.praha.eu portal used by the City Hall as a medium for press releases. A theory part introduces basic concepts and trends in feminist debates concerning prostitution. The core of the thesis consists of four categories derived from the source data.These are: definition of prostitution, prostitution as a problem, needs and goals, and support and repression. The categories are treated critically from the viewpoint of feminist theories. The author follows not only the topics concerning prostitution, but also the way they are presented. Case Study of Socially excluded locality in Litvínov - Janov and possible solutions

This diploma thesis is focused on issues of socially excluded Romany locality in Litvínov - Janov. The problematic situation is described in the thesis. There is a higher number of socially handicapped people with a wide range of social problems like unemployment, insolvency, occurrence of socio-pathological phenomena including criminal behaviour in this locality. The occurrence of socio-pathological phenomena within the socially handicapped people causes conflicts with other residents living in the locality. The diploma thesis also focuses on the precautions and policies made by the city of Litvínov to solve such problematic situation. Each precaution is subsequently described. Furthermore, there is an evaluation of these precautions by means of monitoring social indicators. In result, it is possible to say that there are no signs of distinctive improvement of the situation in the locality. In the conclusion, further precautions are recommended for finding a solution to this problematic situation in the housing estate. The recommended precautions arise from the analysis executed in the locality Janov and from precautions realised by the city of Litvínov.
The concealed performance of public power and values protected by the constitutional order

The aim of this diploma paper is to analyse and define the nature of secret exercise of public authority and to asses this phenomena in respect of the fundamental principles of the democratic rule of law. Any secrecy in exercising public authority is in fact a clear contradiction to a natural concept of the human rights and fundamental freedoms. Therefore the republic, as a public institution, should not have too many secrets to hide away from the people if its own principles are not to be completely disgraced. Secrecy in exercising public authority is a specific feature often related to the areas such as securing the sovereignity and territorial integrity of the Czech Republic, protecting its democratic foundations, protection of the lives and health of the population as well as the right to own the property. This is in full accordance with the constitutional duty of the state. Limited access to the information has a unique and 84 inevitable role in these areas and it is clearly mentioned in the Charter of Fundamental Rights and Freedoms, the European Convention of Human Rights and Freedoms and the International Covenant on Civil and Political Rights. Good morals and public order as the limits of the autonomy of will in civil law

1 Abstract This thesis deals with the principles of good morals and public order focusing on their role function as limits restricting the autonomy of the will. Although both principles are vague legal concepts, this thesis doesn't seek to define exactly not even cover all the practical possibilities of their application. The aim of the thesis was to bring the possible content of these principles and to highlight their importance in assessing the validity of legal actions or to specify further consequences of legal conduct, which would be contrary to these principles. The view on this topic is primarily from the Czech law perspective. On exemplary and a limited number of legal institutes, this thesis tries to capture the possibilities of using good manners and public order as correctives of autonomy of will. The thesis is divided into eight chapters. The theme of the first chapter is the principle of autonomy of the will and its position in the Czech legal order. This thesis is focused on the offences discussed in the field of public policy in the period from 2011 to 2015 at the Municipal Office of Nový Bydžov. The work identifies the most common offences types, discussion results, discussion complicating facts and proposing measures for their elimination. The theoretical part describes the concepts relevant to infringement proceedings. The practical part contains the introspective investigation results with innovations proposal. Práce se zabývá problematikou právní úpravy přestupků ve vybraných zemích Evropy, přičemž zvláštní důraz je věnován přestupkům v oblasti veřejného pořádku, občanského soužití a majetku. Práce se zaměřuje především na sankce udělované za tato protiprávní jednání a na postupy uplatňované, jestliže pachatel dobrovolně neplní uložené sankce. Mimo jiné se text zabývá také vymezením subjektů příslušných k projednávání takto spáchaných přestupků a postupů, které mohou být uplatněny, jestliže pachatel jedná při spáchání přestupku recidivně. Součástí této práce je také zodpovězení otázky, zda právní řády vybraných zemí umožňují postihovat dávky sociální povahy v případě nesplnění sankcí uložených za spáchaný přestupek.
