Subsidiarity in EU law English Summary / Abstract The upcoming 30th anniversary of the Maastricht treaty is an opportunity to celebrate but also to critically evaluate the overall success of this significant political step towards deeper European integration. The Maastricht treaty incorporated the Principle of Subsidiarity as a general principle of law into the EU legal system. The Principle of Subsidiarity was intended as a safeguard against a creeping centralization and federalization of the alliance and a means of regulating the exercise of the Union's non-exclusive powers. Thirty years of experience is a good time to evaluate the success and fulfillment of that mission. This is all the more pertinent in 2021 as the EU finds itself on the threshold of a new public debate about the future of Europe. The Principle of Subsidiarity underwent several textual changes on the way to being anchored in the Treaties. Despite these changes the case law of the ECJ has remained for unclear reasons underdeveloped in comparison with other issues and areas of judicial review. The original emphasis placed on a judicial review of the fulfillment of substantial conditions and ex-post control of the principle has lately shifted to the ex-ante procedural one. Unfortunately, even this change did not bring the expected results....
I Appoint, Recall and Accept: The Powers of the President of the Czech Republic During the Appointment, Fall and Reconstruction of the Government

The Diploma thesis focuses on the approach of the presidents of the Czech Republic to the power of appointment, dismissal and reconstruction of the government from 1993 to the present. In selected cases it compares individual specifics of approaches and interpretation. From the obtained data it is possible to compare the development of the approach over time and the development of the position of presidents within the Czech political system. The main source of the thesis is content analysis of the period media and other connected documents. Theoretically, the thesis is based on specialized literature focused on position and application of powers of presidents.
Judicial Review of Executive Orders

The topic of the diploma thesis is the judicial review of executive orders. The thesis begins with the first chapter dedicated to executive lawmaking with a focus on the separation of powers context. The second chapter then describes executive orders as legal acts, paying attention to the specifics of their binding force, usage and issuance procedure. The third chapter delves into the judicial review of these acts, first delineating the authority for review and specifics of jurisdiction, followed by analyzing the context of review of executive orders, ultimately formulating a guideline to follow when determining the validity of executive orders. The final chapter applies this guideline and all the foregoing information to chosen cases which are analyzed. Czech Environmental Inspectorate

This thesis addresses the problem of Czech Environmental Inspectorate and the general protection of the environment. I focus on the history of the protection of the environment, both at international, European and national. Further, I develop inspections in our area and grounds of Inspection, its scope (both substantive and territorial) and its competence in all major components. For comparison, I also deal with environmental protection in other European countries (I chose two Western European countries, which have a relatively long history of environmental protection). Most, however, devoted to the performance of supervision, both in general and specifically as one of the powers of inspection to all five areas. At the end of the deal by providing information and differences in process the individual laws. The aim is to introduce the reader to general environmental protection, and especially with the functioning of Inspections and its importance.
Delegation of competences in Kindergartens

My bachelor thesis deals with the process of delegating management competences of pedagogical process in kindergartens with one or more detached places of work which form one legal subject. This work is to present the process of delegating, shows its positives as well as negatives and possible risk. It also brings survey of competences which can be delegated to teachers by a headteacher. There are two parts of the thesis, theoretical and a research. The research is based on the analysis of the questionnaire which main aim is to find out who are the competences delegated to. Delegation and its implementation in practice

This thesis deals with process of delegation and its implementation in practice. The thesis consists of a theoretical part and an own work. Theoretical part applies on general concepts of management in the introductory part. Main theoretical part is focused on issues of delegation, its object, elements and goals. Next there are introduced advantages and disadvantages, barriers, which block managers process of delegation. The analysis of work is written in details, that means what is possible or cant be delegate, planning of delegation, which includes goals of planning, terms, decisions, extent of authority or inspection. There are not forgotten chapters focused on a choice of appropriate workmate and a process how to delegate correctly. The practical part is primarily based on a survey in which statements are followed from literature research. Answers of interviewed managers are presented and then illustrated with graphs, where are also added information from unstructured interviews. It is also used a method of structured interview with managers for more details. In conclusion, this own study evaluated the results of the survey and based on these measures is proposed, which should ensure more efficient use of managerial skills in the surveyed company.
Territorial Administration in the Czech Republic - the direct election of mayors

The starting point of the diploma thesis is a discussion of the direct election of mayors in the Czech Republic. The aim of the thesis in this context is to assess whether the direct election of mayors is appropriate in the normative framework of territorial administration of Czech municipalities and if so, under what circumstances. A partial aim of the work, intended to lead to the fulfilment of the main aim, is the description of the formal role of mayors in the administration of municipalities, the description of the manner of appointment of mayors into their positions, as well as the description of the anchoring of the position and election of mayors of municipalities in selected European countries. Another partial aim is the description of starting points for the direct election of mayors, stemming from the attitudes of mayors of selected municipalities. The subject of study will be the normative setting of the mayors position in the regional administration in the Czech Republic and simultaneously the manner of their election. Another subject of study will be the attitudes of various mayors in relation to the issue of their formal position and election. The data on the mayors attitudes will be obtained by the focus group technique. The criterion for the selection of respondents will be the municipality size. The purpose of the work is to generalize the data obtained and to assess it on the basis of the prevailing opinion.
