The Cryptocurrencies in Practice of Law

This diploma thesis deals with the cryptocurrencies in practice of law. The aim of the thesis is to analyse the initial coin offering and the basic tax aspects of the cryptocurrencies, both with respect to the Czech law, and to provide a comparative overview of the cryptocurrency legal regulation in different states of the world. The actual text of the thesis is divided into four parts. These parts are preceded by a general introduction outlining the overall concept of the thesis, its purpose and the reasons why the topic was chosen. The fourth part is followed by a conclusion summarizing the main findings that were made. The first part of the thesis deals with an explanation of the term cryptocurrency and its comparison with the terms virtual and digital currency. It also discusses whether cryptocurrencies can be considered as money or as currencies and what each of these two categories means. The second part is focused on the initial coin offer in the Czech law. There is a brief description of its course followed by an examination of the applicable rules of both public and private law. Particular attention is paid to the rules concerning the initial public offering, payment transactions, collective investment, enterprise and anti-money laundering. Providing Public Access to Theses and Copyright Law

The paper presents a basic overview of the issue of providing access to theses from copyright’s perspective. The first part introduces the meaning and purpose of this copyright limitation as well as the development of legal regulation. Attention is paid to the identification of individual interests that might conflict due to its application. The second part deals with the current legislation and identifies its problems, especially the ones related to providing online access to theses. The last part proposes possible solutions to these problems.

SELECTED ASPECTS OF BITCOIN AND ITS IMPLICATIONS FROM THE STANDPOINT OF THE LAW AND ECONOMICS Abstract Bitcoin is one of the best-known examples of a decentralized convertible cryptocurrency based on blockchain technology. The diploma thesis deals with the main aspects of bitcoin and bitcoin payment networks in complex economic analysis based on the use of standard economic apparatus. The economic analysis is backed by a thorough and relevant legal research. The main goal of the diploma thesis is complex economic and legal analysis of bitcoin. In economic analysis, the emphasis is put on the use of supply-demand analysis, which outlines the basic factors affecting supply and demand for bitcoins. Based on a clear delineation of these factors, the thesis is able to analyse specific aspects of bitcoin. Diploma thesis analyzes the impacts of decentralized setting, as well as risks associated with anonymity of users, crime in connection with bitcoin, time delays in transaction verification, technical and energetic demands on mining, high transaction costs and internet connection needs. Legal regulation of the product placement a its utilization by the czech television

The main aspects of this thesis is the analysis of the legal regulation of the product placement and its utilization by the Czech television. Czech law comes from the Directive 2007/65/EC of the European Parliament and of the Council, therefore several chapters are dedicated to secondary law of the European Union. The last part of this thesis includes few ideas about the law de lege ferenda. The second part of this thesis consists of the application of the product placement by the Czech television and there is a comparative analysis with selected television shows from around the world. The comparison is made with the similar shows in regards to their format and style. The result is a recommendation how to apply product placement in the future and kind of mistakes could be prevented.
Manipulation in Advertisement

The bachelor thesis deals with the means of manipulation in advertisement. It is based on the findings of psychology, sociology and especially neuromarketing. It describes the model of advertisement acceptance. The process of advertisement acceptance includes learning and remembering, the success of which is directly influenced by emotion. The concept of advertisement popularity and its measuring is further described. The thesis focuses on how advertising manipulates with emotions in order to make customers purchase goods. The common ways of affecting senses which directly sway emotions are also described. The issues of subliminal advertising, product placement, package design and layout of stores are also dealt with. The final part focuses on the legal regulation of advertisement in the Czech Republic.
Legal Regulation of the Radio and Television Broadcast in the Czech Republic

The thesis Legal Regulation of the Radio and Television Broadcast in the Czech Republic deals with an analysis and description of relevant legal regulations applicable in the area of broadcasting and television in the Czech Republic and with a closer insight in the main legal institutes and entities. A theoretically-juridical opening is followed by an introduction of the Czech Republic and European Union legal systems. The core of the thesis is the main topic, which is the legal regulation of the radio and television broadcasting in the Czech Republic. This part is opened by a short historical abstract followed by chapters dedicated to particular legal regulations. The Broadcasting Act, the Act on Czech Television, the Czech Television Code, the Act on Czech Radio, the Czech Radio Code and the Act on Audio Visual Media Services upon Request are described in individual chapters. The closing part is dedicated to some of the legal regulations and their provisions that are more remotely related to the subject. Individual chapters describe relevant legal institutes of the Act on Advertising Regulation, the Advertising Council Code of Ethics, the Consumer Protection Act, the Commercial Code and the Civil Code.
Law and social regulation of drug addiction

The topic of my thesis is the legal and social regulation of drug addiction. The drugs phenomenon stays a global and constant societal problem. I started to be interested in drug issue shortly after revolution, after I attended my very first talk about drugs within the school education. The aim of my thesis was to map development and current situation of drug problems, especially drug scene state, national and European drug policy, analysis of legislation, and last but not least, prevention, treatment and subsequent rehabilitation of drug addicts in the Czech Republic and European Union countries. Czech Republic came closer to European countries with the introduction of new criminal legislation. However, despite all efforts of harmonization of the European Union differences between countries exist in the legal framework and specific procedures in the field of drug. Individual states have their own characteristics in the drugs field, and therefore we cannot generalize uniform procedures for all states. Nevertheless, sub-national practices could stand for inspiration for the Czech Republic in similar cases. The aim of this thesis is to analyse legal regulations of marketing and advertising in the Czech Republic as well as in the European context and define possibilities of applications of marketing methods and tools in the field of legal services. This is followed by a detailed elaboration for advocacy being the most marketable branch within this field. Based on the analysis of classic marketing mix tools, the aim is to create a set of marketing instruments suitable for the selected field of advocacy services. The thesis takes into consideration particularly strong characteristics of legal services as such. The theoretical part of the thesis is opened by a chapter dealing with the issue of marketing in general. Defining the respective branch and identifying its basic descriptive signs creates a terminology basis for further development of the subject. Legal regulation of online advertising in the Czech Republic

The thesis focuses on regulation of advertising on the Internet. The aim of the thesis is to evaluate the current state and position of public regulation of online advertising, both in general and on the example of Google advertising network. The approach to achieve defined goals is to first present a theoretical overview of the legal regulation of advertising with an emphasis on online advertising, followed by a case study showing the practical functioning of online advertising rules in Google AdWords accompanied by qualitative research involving relevant representatives of the online advertising market. The conclusion is an assessment of the rules of online advertising and evaluation of the legal rules' role in relation to it.
