The Social and legal protection of children is one of the most important activity. The state cares about children without parents. The aim of adoption is acceptance of another person as their own. The Process of Adopting a Stepchild throught the Eyes of the Stepparents in the Czech Republic

This thesis deals with the process of adopting a child through the eyes of step parents in the Czech Republic. In the theoretical part, with the help of external sources, it explains the current substitute family care with its conditions in the Czech Republic. More emphasis is put on the conditions of an adoption, legal release of a child, mediation of an adoption, and lastly the steps that lead to a child adoption in the Czech Republic. The practical part is written with the help of data acquired from a qualitative research with adoptive parents. Based on the adoptive parent interviews, it introduces their experience with the process of child adoption and explains the shortcomings which they encountered in the process. The results of the research imply that the average waiting period for a child is 25 months in the Czech Republic. One of the largest downsides for adoptive parents is that each Czech region acts on its own and a centralized adoption system is non-existent in our country. Establishment and revocation of adoption in our country and in other legal systems Abstract The diploma thesis is devoted to the establishment and revocation of the adoption of a minor child in the Czech Republic, the Netherlands and the Australian state of New South Wales. The thesis consists of an introduction, seven parts and a conclusion. In the first part the author deals with the historical development of the institute of adoption in the Czech territory, explaining the idea and conception of adoption according to Czech Civil Code and its division according to theoretical typology. The second part discusses the conditions of adoption. The author pays special attention to the position of the child and his / her best interest, as discussed by Czech law and international human rights conventions. Further explanation is focused on adopter and the position of child's parents. The third part of this thesis is focused on adoption service and adoption's procedurals in the court. In this section, the author describes how the child is adopted. It also deals with the legal position of persons involved in the proceedings, representation and proceedings obstacles. Adoption Proceedings Abstract This thesis deals with the current legal regulation of adoption proceedings. Adoption proceedings are one of the non-contentious proceedings which are initiated on basis of motion and in which court decides on the personal status of the adoptee and adopter. The thesis is divided into 5 parts in which the procedural and substantive regulation of adoption is discussed with the aim to provide an explanation of adoption proceedings as the legal regulation of this institute does not fully respect the division of the law into substantive and procedural. After a brief introduction, the first part is devoted to the historical excursion in which I describe the basics of the adoption as set by the ancient Roman law. In the longest chapter of first part I focus on the interpretation of the development of adoption after the establishment of the Czechoslovak Republic and the change of the position of court in the process of adoption. The concept of adoption is defined in the second part of this thesis and after that I focus on international treaties and laws that govern adoption in the Czech legal order. Adoption according to New Civil Code

The theme of the bachelor thesis is an institute of an adoption under the new Civil Code, Act No. 89/2012 Coll., which brought big changes to the entire private law with the effect from January 1st 2014. The theoretical part tries to bring a comprehensive view of the adoption, as one of the foster care forms and describes the most fundamental changes that have occurred with the effect of the new Civil Code. Firstly, it explains the basic concepts of the Family Law, such as family, kinship and foster care that are necessary for the overall orientation in the issue. Over the following seven subchapters the thesis deals, at first with the adoption as one of the main alternative family care forms; with the adoptive parents and the adopted child; with the consent of the adoption and the associated conditions; with the care before the adoption, which has undergone a substantial change compared to the previous regulation; also consequences of an adoption; the eventual annulment of an adoption, and the last subchapter discusses the adoption of an adult, which appears with the new Civil Code as a completely new institution. The theoretical part is processed by the analysis method of the issue with a partial comparison with the legislation effective till December 31st 2013. In the empirical part of the bachelor thesis is applied the qualitative research method using the structured interview techniques. The aim of this part of the thesis was to ascertain the views of the workers of the Department of Social Child Protection, Foster Care Department in Ceske Budejovice about the new legislation in practice, evaluation of its contribution, or conversely the negatives. The final section incorporates the research results with the answer to the research question, clearly presented acquired data as well as the idea of further research topic is attached.

This master thesis deals with Legal and Psychological Aspects of Adoptions. As far as the first chapter is concerned, it goals to introduce the institute of adoption, describe it in its historical context and outline its legal regulation. The adoption is one of the oldest institutes of the family law and its roots date back to ancient civilizations. As the society has been evolving and changing during the centuries, the conception and content of this institute has been transformed as well. The primary impulse of this institute was to regulate property issues, mostly in favour of an adoptive parent. This is what distinguishes present regulation that principally aims at rendering protection to an adoptive child. During the evolution of this ancient institute, the humanistic notion has prevailed. This notion is reflected by both international treaties and national legal regulation, they both render protection to the child and its interests. The aim of my diploma thesis in the second chapter is to cover the regulation of the institute of adoption in the view of the Act No. 89/2012 Coll., the Civil Code and compare the most important changes to previous regulation including possible evaluation of its positive or negative impact on the reality.The most important change brought by new regulation is in the...
