3 In recent years, the legislation on environmental impact assessment in the Czech Republic has undergone a great number of significant changes. The existing procedures in the EIA as well as in the subsequent authorization process have been substantially modified. The thesis aims to provide an overview of the EIA system in the Czech Republic, with particular regard to the recent changes made thereto. The thesis focuses on the main features of the EIA and analyses the institutes applied therein, considering the requirements of international and EU law and the conclusions of the judicial authorities or other independent bodies established to review the compliance with these requirements. Attention is paid not only to standard forms of assessment but also to special regimes in which certain project are assessed. The thesis also deals with the specifics that characterize the EIA procedure, such as public participation or impartiality and expertise of the assessment. The thesis identifies the pros and cons of the current legislation, including de lege ferenda proposals to address shortcomings where appropriate. The influence of the Federal Republic of Germany in development of the European Union environmental policy is dealing with promoting of German environmental policy within the European Union in a broad context with the focus on EU institutions and national political system. The German approach to environmental policy is shaped by strategy of European countries that are influencing EU environmental policy. That chosen strategies were developed by Liefferink and Andersen. The stress is put on the analysis of embedding of environmental policy within political system, institutions and within various actors. Part of the research is climatic policy denominated as a main topic of environmental policy of the last days. The principle of prevention in environmental law The principle of prevention as one of a common legal principles plays also a key role in environmental protection. Once the environmental damage occurs, the remedy is more costly in all aspects, including economical ones. Moreover, some damage can be irreversible. Thus, modern environmental law and policy is based on prevention. The implementation of the principle is not only reduced to pollution prevention, but in broad meaning, to damage prevention. In secondary legislation, the principle of prevention is realized primarily through general prevention obligation (Act on the environment, Waste act, Water act, Nature protection act etc.). Environmental impact assessment is the essential instrument for implementation of prevention principle in environmental law. The environmental assessment covers plans and programs (strategic environmental assessment, SEA) and individual projects (environmental impact assessment, EIA) likely to have significant adverse effects on the environment.
