Directive on environmental liability with regard to the prevention and remedying of environmental damage and transposition in the Czech legal system

The subject of my master thesis is the EU directive 2004/35 on environmental responsibility, prevention and damage redress, its implementation into the legal order of the Czech Republic and the potential impact of undue transposition of the directive. The first part of my thesis deals with the harmonization need in this area and with the directive itself. Following a brief introduction of the directive, I'm presenting an overview of its basic institutes and their legal form. I'm also making an effort at identifying possible shortcomings of the directive. The basic institutes of the directive include: key principles, the environmental damage itself, operational activity, responsibility mechanisms, financial safeguards and the administrative procedure to impose a preventive or a remedial provisions. The second part of my thesis deals with the theoretical aspects of appropriate implementation, such as the interpretation of the directive, a timely adoption of the transposition provisions, proper projection of the content of the directive, due form of the transposition provisions, the application of EU norms, the equivalence and effectiveness imperative and the internal Czech rules for the implementation of EU norms that have been laid down by the governmental provision Nr. 1304 (methodological directions). Thesis title Liability for environmental damages Abstract This thesis deals with the position of the institute of liability for environmental damages in the Czech legal order. This is a relatively complex issue in the field of environmental law, which has been constantly evolving. The environment extends beyond national borders, therefore legislation of the environmental protection, including liability for environmental damages, is strongly influenced by international law and, in particular, European law. Liability for environmental damages is one type of the liability for environmental losses and together with liability for public torts (crimes and contraventions) it forms the concept of legal environmental liability. The aim of this work is to analyse the institute of liability for environmental damages in detail and to analyse its individual aspects in a comprehensive way. Because of the fragmentation of legislation and different views of individual acts on the concept of environmental damages, this thesis focuses on the analysis of these views and explanation of the acts' purposes. Liability for ecological harm

This thesis discusses the issue of liability for environmental damages, which includes (i) public-law liability (in Czech legal framework described as "environmental injury") and (ii) private-law liability. The Act on Environmental Damage transposed the Directive on Environmental Liability (the "Directive"), the aim of which is prevention and remedy of environmental damage. The Act on Environmental Damage is legally binding from August 17, 2008, as lex specialis to the Act on Environment and other Acts on respective environmental components. Although the Act on Environmental Damage is based on the public-law approach, the private-law liability remains unaffected. According to the Act on Environmental Damage, the strict liability is imposed on operators of certain high-risk occupational activities and these operators are obliged to implement preventive and remedial measures and bear associated costs. Furthermore, the operators must provide relevant information on the request of competent public authorities.

The remedial measures in the protection of the environment

The remedial measures in the protection of the environment. This thesis focus on the remedial measures which belong to legal instruments and create an integral part of the public law. The public bodies, which are responsible for the enforcement of public interests, are in charge of enforcement of remedial measures to be done. As in the international law, the state is primarily responsible for remedying of damages arising from activities under its jurisdiction. Despite the remedial measures are incorporated into almost all legal enactments, the quality of the legislature is rather low and this legal tool has been beyond the academical interest. The remedial measures represent one of the most important instruments of the environment protection and are closely connected with the principles of the environment protection, i.e. the principle of the sustainable development, the polluter- pays principle, the preventive principle and the principle of the State responsibility. Výzkum struktury zájmů a potřeb návštěvníků velkoplošných chráněných území a možnosti diferencovaného kulturně výchovného působení (na příkladu Krkonoš) 7: Ekonomické a ekologické aspekty rekreace v Krkonoších

Studie vychází z dlouhodobé zkušenosti s turistikou a rekreací v Krkonoších i z historického zkoumání jejího vývoje. Studie uvádí různé možnosti použití sociálně ekologického přístupu k celé oblasti , ve které se střetávají zájmy cestovního ruchu a potřeby ochrana přírody. Studie zahrnuje: historii, současný stav a předpokládaný vývoj turistiky v Krkonoších, ekologické, sociální a ekonomické souvislosti, které vznikají v důsledku cestovního ruchu a výhled do budoucna, rozlišení rozvoje a ekologických důsledků letního a zimního cestovního ruchu, analýzu rozvoje cestovního ruchu ve Špindlerově Mlýně, ekonomickou analýzu rentability vybraných zařízení cestovního ruchu ve Špindlerově Mlýně. Jsou uvedeny závěry a návrhy na koncepci řešení z hlediska zájmů ochrany přírody, návštěvníku a místních obyvatel.
