The relation between the individual and the society in Rawls' work

The aim of the present thesis is to answer the following question: How does the relationship between the individual and society change in Rawls' work? Does the link between the individual and society strengthen, weaken or change in another way? The author discusses other questions, too, namely the specifics of Rawls' theory and his liberalism as well as the criticism of Rawls. The author focuses on two crucial texts - The Theory of Justice, Rawls' debut book, and Political Liberalism. In order to answer these questions, the author first analyses The Theory of Justice and the relationship between the invidual and society in this work, and then places this relationship within the context of a philosophical debate, which stems from the criticism of the work. It is liberals and communitarians who engage in this debate. The author also mentions Robert Nozick, a representative of libertarians, and his critique. Liberals (Rawls) hold the view that one's identity is more significant than society, and thus advocate the individualistic image of the universal man who has appropriate rigths. Communitarians, on the other hand (MacIntyre, Sandel, Taylor, Walzer), advocate the image of a person whose identity is apriori derived from the society that the person belongs to. Three Liberal Theories of Justice

The mail goal of this thesis is to introduce the modern theory of liberal justice with a focus on distributive justice. In addition, the author addresses the issue of value neutrality in the liberal state and the concept of equality in liberal theory. The author presents the concept of "justice as fairness" described by liberal political philosopher John Rawls. Afterwards his concept is subjected to criticism of other contemporary liberal philosophers Robert Nozick and Ronald Dworkin. The author briefly looks into coherence between mentioned philosophers and earlier representatives of liberal theory, as well as their non-liberal critics. The first chapter contains a list of thinkers and their contributions to the issue of justice and the social contract theory. The following three chapters concerns the interpretation of the concepts of three mentioned authors using critical analysis of their publications. In the fifth chapter are described concepts of thinkers who critically respond to Rawl's theory of justice generally reffered to as communitarians, including the conception of Jürgen Habermas. Attitudes toward the death penalty in the Czech Republic

My diploma work follows up Czech Republic inhabitants' attitudes toward the death penalty. It also describes changes in death penalty perception in terms of historical aspect, its presentation to public society, changes in approach to death penalty and violence in general over time. It deals with execution types development, executioner's social position and craft. It brings elementary thoughts of advocates and opponents of the death penalty and describes related contemporary situation in the world. All these chapters are included for broader context description to allow me better use and identify results from the survey. The other part of my diploma work is survey with focus on attitudes toward the death penalty in Czech Republic. It was conducted in 2012-13, based on online respondent panel, with use of quantitative methods. This market research survey was executed on Millward Brown Czech Republic online panel with sample of 821 respondents. Results basically deliver knowledge of relation between attitudes toward the death penalty and sociodemographics, main arguments for and against the death penalty, clarifies the relation between attitudes toward the death penalty and some factors such as experience with crime or death penalty basic facts knowledge. Activities of the Probation and Madiation Service of alternative sentences

1 Abstract Thesis deals with the implementation of elements of restorative justice in the Czech criminal law, especially in the prison system. The work identifies and analyzes the basic problems of the Czech prison system and their impacts on public policies in the Czech Republic, especially overcrowding of jails, and the way, how the state, and especially through the Probation and Mediation Service, solves this problem. This work analyzes, how successful is the implementation of alternative punishments, what tools the state has to reducing the number of people in prisons and how to reduce overcrowding in jails. In the work I also identify the role of the Probation and Mediation Service in the issue of alternative sanctions. In the work I also suggest, how to solve these problems.

Andrey Vishinsky - a legal scholar of the Stalin era Abstract The aim of the thesis is to examine the basic categories of the Marxism-Leninism theory of law from the point of view of Andrey Januaryevich Vishinsky. The thesis is composed of four chapters. Chapter One (named "Marxism, Russian revolution and Law") is based on the idea that it is not possible to understand the Soviet law without analysis of the relationship between Marxism and legal theory. Subchapter 1.1 gives a brief overview of Marx's school of thought. At the same time it points out the absence of the self-contained concept of law in writings of Marx and Engels. Chapter Two is devoted to the life of Andrey Vishinsky, his academic and scientific career. The following subchapters are subsequently mapping the individual stages of his life. It contradicts some of the untruths and myths surrounding Vishinsky. Chapter Three (named "Vishinsky's contribution to the basic categories of the Marxism-Leninism legal theory") is concentrating on the four fundamental concepts of legal thinking: Law, State, Legality and Justice. Aristotle's conception of ethics

Diploma thesis deals the Aristotle's conception of ethics. The aim of this thesis is to introduce and to do understandable a overview of ethics. First of all, the thesis concentrates general characteristic time, Aristotele's life and status of ethics in the Aristotle's philosophy. Secondly, the thesis mentions general Aristotle's ethics. It deals with the subjekt, goals, good and hapiness, virtue and moral conduct. Third, the thesis deals intelectuall virtue including knowledge, art, wisdom and understanding. Fourth, the thesis concentrates moral virtuos and courage, moderation, generosity, other generosity, healthy ambition, calmness and truthfulness. Selected aspects of the development of liberalism

The thesis of this work is a treatise on liberalism in general firstly, what contains the etymology of the word liberalism. There are explained the beginnings of this orientation, dating back to ancient times and Middle Ages. The description of the beginnings of liberalism in England follows. The historical events of the time, which played an important role in the birth of liberalism, are accented. Liberalism is based on certain principles as well as any other social or political theory and in this work this principles are enriched especially by ideas of John Locke. Liberalism reached its height in England in the nineteenth century when it defended its leading position. Liberalism is not only social and political orientation but it plays an important role in economy also. It supports free trade without state's interventions and it promotes private enterprise. Although liberalism was often criticized by church representatives and particularly by Conservatives, liberal ideas are still current. Liberal Democrats are the third-largest party in the House of Commons in Great Britain. They have made a coalition government together with the Conservatives since 2010. The economic role of the state in globalized economy

in English This diploma thesis encompasses the idea of the economic role of a state in relation to trends of globalization applying political science, political economy and economic geography. The idea goes on by progressively defined conceptions of societal institutions - the concept of a state and political nation on basis of the social contract, the conception of the fair society on basis of the work called Justice as Fairness by John Rawls, conception of globalization in terms of its trends in the area of changing division of work and rising income inequality, and conception of the character of changing roles of a state in relation to globalization and economy. Reference state is a small, internationaly opened, democratic and developed society, which holds western values and norms. It is assumed that in such society individuals pursue their own happiness as a notion of good life. In this aspect Justice as Fairness theory was chosen as a framework for society of equal citizens where economic transactions are considered fair and everybody is given the chance to pursue their own vision of their lives and such state of society shall remain preserved in time. Principles of the tax justice

This thesis is an interdisciplinary perspective on the issue of fair distribution of the tax burden. Taxes are assessed in terms of its purpose, which is to establish resources for the payment of government spending . Attention is focused on the moral and ethical aspects of the impact of the tax burden in human behavior and decision making. The work is divided into four chapters . The first chapter is devoted to human beings , its behavior and decision-making capabilities and comprehensive view of human individuality. One is set in the perspective of living and farming. The second chapter contains a brief look at the concepts of justice , focusing on the relationship between justice and ethical values selected . In the third chapter, the evaluation of the structure of the tax system and individual taxation, with a focus on tax fairness in economic sense . The fourth chapter is devoted to some aspects of international taxation. In conclusion, the thesis are evaluated conflicts tax fairness with other values .
