The principle of precaution in European environmental law

Princip předběžné opatrnosti v evropském právu životního prostředí ix The Precautionary Principle in European Environmental Law SUMMARY The purpose of my thesis is to analyse the role of precautionary principle in EC environmental law. The reason for my research is the fact of increasing introduction of this principle into the EC legislation. Its repercussions in other areas of EC law especially in EC public health law should not be neglected neither. However the thesis describes reasons and conditions for applying the precautionary principle, it also justifies limits of its application to prevent the misuse or even abusive use of the principle. The thesis is composed of two basic parts, the first seems to be more theoretic and descriptive compared to the second one which presents the analysis of the application of the precautionary principle in practice with all its consequences. Part One is composed of two chapters, first of them describing the rise of the precautionary principle in international public law, his introduction and effects in EC environmental law. Povaha SZBP vede k závěru, že poruší-li členské státy své povinnosti v této oblasti, nelze v zásadě v rámci práva EU jejich splnění vynutit a v úvahu přicházejí jen mezinárodněprávní sankce. Tento fakt je dán tím, že nástroje buď nejsou závazné nebo, když jsou, není stanoven postup jejich vynucení. Jedinou výjimkou tvoří hospodářské sankce, jako nástroj s komunitárním prvkem, avšak i zde lze v konečném důsledku možnost vynucení zpochybnit.

The purpose of insolvency proceedings in case of bankruptcy is to find out registered proof of dept and its subsequent relative satisfaction from the proceeds of the realization of estate. The main activities of the insolvency practitioner in the performance of his function is to review the filed claims of creditors, the findings of the estate and its subsequent inventory, management and sale. Position of the insolvency practitioner in the insolvency proceedings is a complicated issue, which is in our legal environment little discussed by legal theorists and it is necessary in many cases work solely on the insolvency practice. The aim of the thesis is to evaluate the current legislation regarding the insolvency practitioner and his role in insolvency proceedings with respect to the professional literature, the applicable legislation and case law. The thesis also shows the complexity of the position of the insolvency practitioner. Práce se skládá ze tří hlavních částí. První část se zabývá obecnou charakteristikou kupní smlouvy a stanovení kupní ceny. Druhá část práce se týká dodacích doložek. Jsou zde popsány jednotlivé dodací doložky. U každé dodací doložky jsou popsány práva a povinnosti prodávájícího a kupujícího z nich vyplývající a nejčastější problémy. V poslední části práce je uveden příklad z praxe. Vybranou firmou je SPAR Česká obchodní společnost s.r.o. Jsou zde popsány rámcové obchodní podmínky používané firmou SPAR a vznik kupní smlouvy.

Liability for damage in case of occupational injuries and occupational diseases

The intention of my thesis is to analyse legal provisions concerning occupational injuries and occupational diseases, comment amendments in this area of labour law and indicate meaning and content of above mentioned legal provisions in connection with court decisions and practical facts. The entire text is structured into chapters relating to particular topics connected with occupational injuries and diseases. At first the thesis introduces concept of liability with specifics that influence area of occupational injuries and diseases. Subsequent chapter contemplates recent events and system of legal insurance of employer's liability. Fourth chapter describes provisions implementing prevention of occupational injury and disease. Fifth chapter defines conception of occupational injury and occupational disease in detail, elaborates characteristic features, prerequisites, process of solving and possibility of employer's exemption. Sixth chapter reflects findings relevant to compensations provided to affected employee. Result of processing the topic is composed of comprehensive characterization of main terms and issues, with effort to indicate explanation of respective judgements and consider selected legal provisions.

Research points on the fact that information level of your patiens is on a very good level. There is the space for improvement, mainly in the area of communication, which is the basic presumption of good relationship between patients and medics. Report is divided into two parts. The theoretical part is focused on information flow in health service. Experiential part describes the classification of patient's informedness levels within the hospitalization. Research sample are 68 patients. Result shows, that consequent communication is needed. There was biggest dissatisfaction in this sphere. The target is to reach high quality in provided care with active client's attendance and his satisfaction. Main point is good information flow between patient and medic about health state.

Housing cooperatives from the perspective of law, accounting and tax

This diploma thesis aims to assess the issue of housing cooperatives in terms of law, accounting and tax. The part relating to law is based on Business Corporations Act and the new Civil Code. Using the coherent application example, the work tries to show the specifics related to housing associations in the field of tax and accounting, which include settlement of advances, billing advances for the normal operation of cooperati-ves, billing additional membership contributions and repair fund. In parts relating to taxes is pointed to obligations arising from tax laws. For this thesis was determined following hypothesis: Rent from members of the cooperative to cover the cost of normal operation is accounted through profit or loss.

De-merger of companies

The main aim of this thesis is to describe the complex transaction that is de-merger. It outlines the legal process of divisions, accounting and tax procedures. From the legal point of view, the main emphasis is put on the decisive date and draft terms of division. The accounting part concentrates on valuation and deferred tax. There is also a brief characterization of corporate income tax regarding divisions. The last part of this thesis describes some examples from accounting practice and their analysis and comparison.

This document has introduced several new elements into the constitutional order (eg. the definition of state and national holidays, the symbolical role of the president, specification of currency in the constitution).
