Legal regulation of treating animals in human care

This diploma thesis deals with legal regulation of the treatment of animals under human care. It provides a comprehensive overview of international legislation, European legislation and also Czech laws. On the international level it describes fundamental conventions of the Council of Europe. On the level of European Union this thesis does not omit primary law of the European Union, secondary legislation as well as conceptual tools. On the national level it tries to outline the key regulations governing the treatment of animals. Next it deals with definition of an animal, creature and wildlife, and categorizations of animals. It also also includes a civil nature of the animal. The major Czech law governing the main ways of dealing with animals in captivity this thesis describes the act no. 246/1992 Coll., On Protection of Animals against Cruelty. After defining possible ways of the treatment it does not forget to acquaint with the possible torts for breach of the requirements for the protection of animals, including act no. 40/2009 Coll., The Criminal Code. In conclusion, it briefly describes the status of bodies whose activities relate to the protection of animals.
Civil initiative in the field of animal reproduction

This Diploma Thesis focuses on the issue of reproduction of animals and the non- profit organisations and subjects working in this field. The cat and dog reproduction is a primary cause of their overpopulation in the Czech Republic which becomes an ever- increasing issue as the abandoned animal shelter network fails to provide enough capacity for local demand. The thesis is focused on the activities of such organisations and tools they use for mobilising the necessary resources as well as the issue of animal reproduction itself. The theory basis is in the general theory of resource mobilisation supported with the explanation of the civil initiatives dedicated to this phenomenon as well as the overview of the phenomenon of the animal reproduction as well. The thesis is composed of five qualitative interviews with organisations or movements that are dedicated to effective reduction of animal reproduction. The empiric part of the thesis presents selected organisations and then analyses the collected data. The financial and human resources are mostly utilised by organisations which physically treat animals and the majority of the funds is consumed by providing care for them. Legal regulation of treatment of wild animals

The diploma thesis deals with the legal regulation of the treatment with wild animals. It compares different terms used in legal regulation of protection of animals. It specified differences between concept of an animal in private law and public law. The diploma thesis is focused on possibilities of gaining ownership to the wild animals, proving origin of animals bred in human care. It concerns with legal regulation of treatment with handicap animals. The diploma thesis analyzes preparation and realization of Action and Management Plans and is also concerned about protection of wild animals against cruelty.

Criminal law protection of animals against cruelty and other inappropriate treatment Abstract This diploma thesis deals with animal protection in the Czech Republic from perspective of criminal law as a legal instrument ultima ratio. Primary goal of this thesis is to analyse legal regulation in Act no. 40/2009 Coll., Penal Code, de lege lata and evaluate possibilities de lege ferenda. Within current legal regulation this thesis works with articles 302, 302a and 303 of Penal Code and the current legal regulation is compared with the previous one. Particural attention is dedicated to Act no. 114/2020 Coll., which established entirely new crime into the Czech legal system called Breeding Animals in Iappropriate Conditions and widened the listing of penalties stated in article 52 of Penal Code by penalty of prohibition of keeping and breeding animals. Particular novelties are analysed in detail and the thesis also responds to the most frequent arguments in favour and against passing the new legal regulation. This bachelor thesis is about the issue of welfare and protection of animals against cruelty. The first part defines concepts such as welfare and animal abuse, and sums up milestones in the history of animal protection from antiquity to modern times. In addition, three areas, namely the USA, the EU and China, are compared from the point of view of access to animals and welfare conditions. The second part is dedicated to the protection of animals against cruelty in the Czech Republic and the work of the State Veterinary Administration of the Czech Republic is evaluated from the beginning of its activity until 2016. And the last chapter describes the minimum standards for animal housing and transport and also authorized methods of fixation and slaughter.

Law legislation of breeding wild animals in captivity Abstract The aim of this diploma is to summarize and analyze the fragmented legislation concerning the breeding of wild animals in captivity, both in terms of national and EU legislation. However, given the limiting length of work, the EU legislation is not interpreted in detail, but outlines the most important sources concerning wild animals and their transposition into national law. The opening part contains an explanation of basic concepts, which this work couldn't do without, including introduction with key laws and the definition of cruelty and killing of animals in the light of the law on the protection of animals against cruelty. The second chapter is devoted to wild animals from the point of view of different legislation in relation to other animal species, especially in the area of capture and killing bans and regulation of some activities with them. It also includes a subchapter on the species protection of wild animals, both general and special, including the species protection of birds, rescue programs and animals raised in human care. Diploma thesis - Legal regulation of protection of farm animals against cruelty This diploma thesis on Legal regulation of protection of farm animals against cruelty divides into five chapters (excluding the introduction and conclusion). The first chapter explains the relevant terminology. The second chapter concentrates on history of animal rights and philosophical aspects of these rights as well as on animals as subjects of law. The following chapters focus on applicable relevant legislation. The third chapter deals with international animal welfare agreements and relevant EU legislation. The fourth, most important, chapter summarizes the legislation on the protection of farm animals against maltreatment in the legal order of the Czech Republic. This chapter gradually focuses on both public and private law. Finally, the fifth chapter brings a comparison of the domestic legislation on the protection of farm animals against cruelty with the legislation of the Hellenic Republic.

1 Abstract Diploma thesis: Legal regulation of the treatment of animals under human care This diploma thesis deals with legal regulation of the treatment of animals under human care at the national, international and European Union levels. It is systematically divided into four main chapters. The first chapter deals with the definition of relevant animal protection concepts, in particular defines the difference between the concepts of animal, creature and wildlife, it also gives an overview of further categorization of animals such as experimental animals, farm animals, animals breed for hobby, handicapped animals, animals that need special care from human, wandering and deserted animals. In my second chapter, I attempted to outline the relationship between national and international law. Firstly is the diploma thesis devoted to presents five most important agreements adopted within Council of Europeat international level, then mentions the Universal Declaration for protection of animals adopted within the United Nations organizations. In other part of the second chapter I devote to legislation at European Union level describing primary and secondary legislation, as well as conceptual tools.
