United States Supreme Court case law on campaign finance

United States Supreme Court case law on campaign finance The diploma thesis deals with the development of US Supreme Court case law on the issue of electoral campaign finance while paying special attention to the question of the constitutionality of expenditure and contribution limits. Its main goal is to provide a comprehensive analysis of these cases to demonstrate how regulation of campaign finance works there, which is considerably different from systems found not only in the Czech Republic but also in Europe. At the same time, the author focuses primarily on providing insight into the more recent part of American case law, which has significantly loosened the whole regulatory system, especially regarding the financial participation of legal entities in electoral campaigns. The author divides the work into four parts. In the first part, the reader is introduced to the basic institutes and concepts that relate to the American campaign finance law and then compares them with their Czech counterparts in order to facilitate the understanding of the following three parts, which already cover the concrete cases. Influence of Violent Non-State Actors on Corporations in the Sahel

West Africa's Sahel is one of the most unstable regions in the world. Despite its turbulent security situation and high amounts of political risk, foreign corporations dominate the region's extractive industry. Violent non-state actors and their activities present tangible physical risk to operations and employees of these corporations. Since extractive corporations present an important source of foreign direct investment in the region, if the risk far outweighs the costs for corporations they could be expected to pull out leaving the region in a worse economic state. Despite the salience of the topic, it is academically severely underdeveloped, with the majority of scholarship focusing on the region's broader geopolitical situation or specifically at the act of kidnapping with the intent to ransom. Aim of the research is to study the dynamics between violent non-state actors and corporations in order to identify security risks they face and how they react to them. This is accomplished through qualitative analysis of specific incidents, with special attention paid to countries of origin in order to determine whether non-western or western corporations are more risk averse. The theoretical part of the Thesis describes marketing strategy and its methods such as SWOT analysis, Portfolio analysis, Marketing audit and Benchmarking as well as marketing mix and the procedure of setting up a KPIs. The practical part of the Thesis consists of active usage of the methods in strategical marketing such as SWOT analysis, Portfolio analysis, Marketing audit and Benchmarking. In the second chapter the diploma thesis deals with the theoretical explanation of Marketing planning and plans, situational analysis such as SWOT, Portfolio analysis and Marketing audit. It also consists of explanation of Benchmarking, Marketing mix, Online marketing and KPI. The next chapter describes the target of the diploma thesis and its methodology. The following chapter focuses on the practical implementation of analysis. The next part describes the results of the analysis. Share pledge in a corporation Abstract The thesis deals with the share pledge in a corporation. In the beginning I analyse the meaning and purpose of the lien. The following section deals with pledgeability of a share in a corporation. Firstly, I discuss the pledgeability of a share as an intangible movable asset that represents a set of rights and obligations arising from participation in a corporation and, further, the share pledge in each type of corporation, including the association and unit owners' association. The different rules for shares depend on whether they are in a form of a security or not. Subsequently, I deal with the formation of a lien, while focusing on the various titles from which the lien can arise and the question of the moment of creation of the lien. I analyse in detail the creation of a consensual lien, i.e. on the basis of a pledge contract. This is followed by the creation of an ex actu lien on the basis of a court's approval of an agreement of the heirs to divide the estate, and on the basis of a tax administrator's decision pursuant to the Tax Code, where I also provide practical information communicated by the General Financial Directorate. Theory of Decision Making in Public Law and Private Law Corporations

2 Jan Broulík - Theory of Decision Making in Public Law and Private Law Corporations Abstract The thesis analyses Czech legal regulations concerning decision making in bodies of corporations. For the purposes of this analysis it employs mainly the apparatus of the economic analysis of law. Its basic concepts are also outlined. The author focuses on two kinds of legal entities which are public universities and joint stock companies. The ethical-legal connections and the significance of corporate governance in the decision making domain are presented. The analysis of the legal norms shows how reasons of the economic analysis of law correspond with provisions regulating body elections, body competence allocation and the body decision making procedure. The criterion for evaluating the quality of legal norms is effectiveness, meaning an increase of social wealth. The main detected imperfections are a missing provision allowing a long distance voting for joint stock companies' general meetings, a missing tool for the cases where a shareholder breaches his loyalty duty which leads to not passing of a general meeting decision and the mandatory nature of the duty of care. Activity of the Associations in the Kralovice Region as a Part of Modernizing of the Region (from the Second Half of the 19th Century to the First Half of the 20th Century)

This diploma thesis deals with the development of activity of the associations on the territory of former judicial district of Kralovice between the second half of the 19th century to first half of the 20th century. The introductory part is devoted to the origins and general development associations in the Czech countries with regard to the typology and the process of association legislation in a specific timeframe. The next section of this work has been focused specifically on the Kralovice region. Described here is a historical development with emphasis on the period 1848-1949, which is followed by a characteristic shape, a typology of associations and activities in the district court Kralovice. The final section will then detail the associations of Kralovice, their formation, members, activities and influence of corporations on the development and character of the city. For the purposes of this analysis it employs mainly the apparatus of the economic analysis of law. Its basic concepts are also outlined. The author focuses on two kinds of legal entities which are public universities and joint stock companies. The main difference between these two kinds of legal entities, which also impacts the decision-making processes, is the great extent of governmental interventions in public universities. The analysis of legal norms shows how reasons of the economic analysis of law correspond with provisions regulating (i) body elections, (ii) body competence allocation and (iii) the body decision making procedure. The criterion for evaluating the quality of legal norms is effectiveness, meaning an increase of social wealth. Roček, T. Changes in income distribution in the USA and decomposition of Gini coefficient. Diploma thesis. Brno: Mendel University, 2016. Since the 80s of the last century, the United States has seen a considerable income inequality growth. This diploma thesis analyses the influence of individual income sources on determination of inequality, esteems their significance and formulates instruments that the government can use to affect these sources. This diploma thesis contains decomposition of Gini coefficient. This decomposition revealed, that the source, which is the most important determinant of the total income ine-quality are salaries and wages. Sales of assets contributed the most to the rise of inequality in the analysed period from 2000 to 2014. This income source also has the highest potential for further growth of income inequality. Discussion part, which follows, contains the debate about the main causes of this progression and the relevance of researching the income inequality issue. Based on the approach used in this diploma thesis, it is possible to decompose the Gini coefficient in any state or region, and to explore the inequality determinants in this way. This thesis also offers a comprehensive view on the whole issue.
Insurance Protection of a Selected Business Entity

The aim of the master‘s thesis is to design the optimal insurance protection of a business entity. The work is divided into several parts. In the first part I deal with the methodology of work, theories and legal regulation of insurance of business entities in the Slovak Republic. In the second part, I analyze the current form of insurance protection of a business entity, I solve the risk analysis of the company and I look for the main risks of the entity with respect to its economic activity. I also analyze the current form of insurance protection and look for shortcomings or unnecessarily insured risks that the company does not need. In addition, I verify the accuracy and timeliness of all data on insurance contracts. In the design part, I will recommend the company's management to modify existing contracts and propose a new optimized insurance coverage. Taking into account the price and quality of current contracts, the possibility of modifications, extensions and newly offered products, I will recommend the continuation of existing contracts with possible modifications or entering into new contracts.
What type of First Lady Was Michelle Obama: Case Study on Michelle Obama as First Lady

This Master's Thesis analyzes various roles that First Ladies of the United States take upon when their spouses are elected President of the United States. Even though the role of First Ladies is undefined, the public still expects a certain level of manners and dedication to their selected causes. The influence of First Ladies is, on the one hand limited by the fact that they do not have any real policies to follow. On the other hand, the platform of First Ladyship offers a great deal to influence and ability to raise awareness to causes they care about. The main argument is that Mrs. Obama had a particular skill to promote her initiatives and to turn negative attention by the media to the rights directions. Additionally, she was able to get the attention of corporations and state officials to help her make a real impact on her initiatives. Her authenticity and fun engaging style helped her with engaging young people into her campaigns and her status of popular First Lady. Therefore, the goal of this thesis is to find out how the role of First Lady changed during Michelle Obama's term as First Lady and what kind of influence her initiatives brought.
