Residential lease - protection of a lessor

The aim of this thesis is to point out the specific status of the lessor in the residential lease within the meaning of the Civil Code, act no. 89/2012. This thesis is composed of five chapters and additional sub-chapters. The main part of this thesis is dedicated to describing the specific areas which might weaken the status of the lessor and at the same time to state selected institutes which through correct use in the residential lease might notably increase legal certainty and status of the lessor. The first chapter serves as the introduction of lease issues and brings the general reflection over the role of lessee and lessor in this legal relationship. At the same time also sets a target of this thesis, which is the statement of the problematic areas of a lease from the perspective of the lessor and suggesting possible solutions. The second chapter includes the fundamental features of the residential lease, with the emphasis on the characteristics and distinctions from other obligations. The third chapter consists of "prohibited agreements" and their impact on a lease and status of the lessor. Selected cases of unfair competition according to the general clause

The thesis deals with the most common cases of unfair competition punishable under general clause, such as "snowball", botheration of consumer, unfair advertising, exploitation of feelings, etc. There is also outlined the development of the law against unfair competition, the subjects of unfair competition and the crucial term "general clause". The following chapters are concerned with the European Unfair Practises Directive and legal means of protection against unfair competition. The last chapter deals with the upcoming new Civil Code and its regulation of the law against unfair competition. It also includes suggestions de lege ferenda.

The sphere of an enterprise and the firm agenda in České Budějovice area along 1850-1950 years

This diploma work has for its object an existence of enterprise in the České Budějovice area a Eormation of professional constitutionalism in half of 19th century during an introduction oE the new civil and criminal judicial system in 1895 - 1896 years and declaration of republic until the disapperance oE trades and nationalization in 1950 year. Diplomatic part oE this work occupies itselE with office agenda arising from the relations between offices and tradesmen or their firms. It has a respect with regard to very high quantity of written material, above aU to two institutions, namely Regional Commercial Lawcourt and also the Chember of Commerce and Industry; both with headquartes in České Budějovice. The last part refers to usmg of legalising means, also the seals and stamps in diplomatic contact oE trade associations with state or professional offices, mainly with the commercial lawcourt. This short sigillographic excursion does its best to map two halfcenturies.

Simulation of market store

The goal of this work is an implementation of a supermarket simulator. You can build your own supermarket by placement of cases with goods, cashier counters etc. until you create the whole shop. Then we try to simulate shopping patterns of real customers. We focus on placement of best offers, discounts, … and the success of their placement. Naturally we want to maximize spendings of each customer. To confront with the reality I designed a real supermarket. Many data like average shopping time and average total costs corresponeded to the real ones. Further in my thesis I survey marketing techniques and tricks to influence shopping patterns of customers and I verify their effect in the simulation. At the end I shortly describe commercial simulation software.

Genetic polymorphism of selected loci in relationship to technological traits of meat

Within the framework of this diploma, a genotypization of 162 beef cattle of the ČESTR commercial breed from was performed in order to analyze the potential influence of gene coding calpain I (CAPNI) on the resulting beef tenderness. CAPN1 present on the BTA29 chromosome, was selected in previous studies as a candidate gen for QTL. Polymorphism of CAPNI gene was studied using PCR/RFLP method and CAPN530 marker. Genotype identification resulted from this procedure. A 341 bp long fragment was present in homozygotes AA, two fragments of 195 and 146 bp were present in homozygotes GG, and three fragments of 341, 195 and 146 bp were detected in heterozygotes AG. The genotypization output was subsequently statistically evaluated. 11 homozygotes AA, 62 homozygotes GG and 89 heterozygotes AG were detected in the analyzed beef cattle population. More frequent G allele occurred in the set with the frequency of 0,657 and A allele with the frequency of 0,343. Warner-Bratzler shear test was employed to determine beef tenderness based on the shear force attribute. Samples of raw and grilled beef aging 1, 14 and 28 days after the slaughter were analyzed. Statistical methods were used to evaluate relationship between genotype and detected amount of shear force. In case of raw beef, only the samples aging 1 day after the slaughter showed significant difference in the shear force. The most positive results for the given parameter were achieved in case of AG genotype. Samples aging 14 and 28 days after the slaughter showed no difference in shear force and related beef tenderness, indicating no genotype influence. In case of grilled beef, no significant difference in sheer force indicating possible genotype influence was detected at any day of analysis. Genotype influence on grilled beef tenderness within the test animal population is minimal and statistically inconclusive.

Ethics in Marketing Communications

The thesis focuses on new marketing communication techniques. Their appearance is triggered mainly by technological progress and consumers' immunity to existing methods. Despite business ethics being part of commercial activities of majority of companies and business activities, not seldom do these upcoming and non-standard methods cross the boundaries of law and ethics. This business ethics has institutionalized itself into ethics codes. The thesis provides insight into the issue of the system of legal regulations of advertising in the Czech Republic. The regulation of ethics is executed by "Rada pro reklamu" as so-called self-regulation. The bodies of "RPR", its activity and also the "Code" and its practical application are detailed. The regulation of ethics concerning Public Relations is also involved. Trends are illustrated by many examples from real life.

1 Abstract Representation This thesis concerns the institute of the representation in effective legislation of civil law particularly in the Act no. 89/2012 Coll., Civil Code. This institute is very important for each person, no matter it's age or profession, because everybody in his live needs to use the representation. Not only have I focused in my thesis on the part of the Civil Code which is called representation, but also on the other parts that contain representation as well. My thesis is divided into nine chapters, in which I am dealing with representation based on the decision of the court as well as the contract or the law. At the beginning my thesis describes historical basis of representation and also short glimpse to the previous legislation. The next chapter deals with chosen types of the representation that are not regulated in the chapter III of the Civil Code, but I also consider them as really important and very useful in practice. The most of the thesis is focused on the part of the Civil Code that is named the representation. Firstly general provisions are described where I specially focus on the power of attorney, its form and necessary provisions. In the representation based on contract belongs also procuration, where I included its origin, its extent, form and termination. The thesis...
