Cooperating defendant

The aim of this thesis is the analysis of a cooperating defendant as a legal instrument of combating organized crime not only in the law regulations of the Czech Republic, but also in the laws of other European countries. This thesis also outlines the origin and development of this institution, both in the international context and in the context of the Czech legislation, including amendments and proposals de lege ferenda. In my work I am also comparing the Czech legislation with specific national legislations. I also mention some interesting legal cases that relate to these issues and present the views of the scientific capacities and respected experts. The thesis is divided into five chapters, which are complemented by introduction and conclusion. The first chapter deals with the historical development of the institute, both in the Czech Republic and in the territories of other states. The second chapter deals with the Czech legislation, the introduction of the institute, and amendments regarding also the laws outside of the Criminal Procedure Code. 57 7 Summary Action and judgment (mutual relation) I have chosen this topic for my Master's degree thesis, because I am interested in civil law, especially in a civil litigation. In my thesis I tried to explain institutes of both law action and judgment and of course the mutual relation between them. Civil procedure is a procedure carried out by state courts as judicial bodies of power. Civil process takes place before the courts, which decide disputes and other legal matters arising from civil, labor, family and business relationships. People are requesting the protection of their endangered or broken rights by bringing an action. Person who brings an action we call the suitor and person against whom the dispute is called defendant. Both these parties are given the same procedural rights and obligations, therefore, in the proceeding they are equal. Finally, the dispute is decided by a court from a position of an independent third party. Judgment is a form of judicial decision, which terminates the proceedings and resolve the dispute. Only the court is entitled to make judgments and decide authoritatively on the rights and obligations between the suitor and defendant. Czech and European law of groups Résumé: We are in a time of dynamic evolution. It comes to integration and globalisation. Groups of companies are usual economic phenomenon. Groups of companies are to be seen as a legitimate way of doing business. They bring the positive aspects, for example economize costs. But they bring the negative aspects too. They may present specific risk for shareholders and creditors in various ways. It is necessity to have a good regulation of groups for legal protection third subjects. My dissertation work is about groups of companies and their regulation in Czech and European rule of law. Our rule of law is influenced by European rule of law. I describe regulation of this problem in other rules of law at first. I selected French and German regulations of this problem because these regulations are more or less a model for the others. A foundation of German regulation is on wide protection of shareholders, creditors and incorporate companies after a formation of group. German regulation differentiates real groups from contractual groups and consequences which are connecting with them. French system of regulation groups is standing on Rozemblum conception. Providers of investment services are investment firms, investment firms providing investment services in a different member state than in the Czech republic, investment firms providing investment services in the Czech republic, investment intermediaries and tied agent. These subjects are entitled to provide investment services at the czech capital market. In order to ensure high level of protection of investors and transparency and safety of dealing at capital market, there are plenty of requirements set for such providers. they should secure that investment services are provided by persons with sufficient skills and financial and technical background. Furthermore a supervisory authority, Czech national bank in the Czech republic, supervises over their activities. For this reason Czech national bank grants a permition for investment firms, registers investment intermediaries and enlist tied agents into a list of tied agents. Providers of investment firms are obligated to perform wide information obligation towards Czech national bank. Society for the Protection of the Rights of Music Authors and Publishers - Honest Guardian of Property Rights or just a Lawful Monopoly on Collection of Money?

The work deals with the role of OSA (Society for the Protection of the Rights of Music Authors and Publishers). It examines the perception of intellectual property from the theoretical point of view with respect to its practical implication and the Copyright Law. The work use the thought of Law and Economics and thoughts of those who stand opposite its view of intellectual property. It attempts to evaluate the activity of OSA in terms of the efficiency, justice and transparency. By analyzing the Copyright Law it shows it's consequences for authors and users of music works. The identification of interest groups results from studying the mechanisms of OSA's incidence. The work tries to observe the principles of cash flow in OSA. On the basis of the analyses mentioned above the work criticizes the contemporary system of protecting copyrights as unsatisfactory. Some aspects of new possible alternatives are proposed and beginnings of new approaches to intellectual property in practical life are shown.

The diploma work "Life ofTownsmen oj Soběslav in years 1525 - 1550 from the point oj view oj thJir testaments" is based on survey of extant last wills of men and woman, available for the tracked period in the State District Archiv (Státní okresní archiv) in Tábor. Is brings the set of early modem testaments and estate indices of Townsmen of Soběslav to the laic public and professionals, it maps testamentary practice in survile town, allows to leam the way of life of folk people, vocational and social stratification of early modem comunities and financial management of single housholds. In this rare way it points sout the relation of men to the God, their way of thinking and sensing the world on the threshold of life, mutual relationships in a family and connections to its closest relatives.

Selected data mining methods and their applicability to the television audience monitoring data in the Czech Republic

Data mining is nowadays a fast-growing field, which incorporates machine learning, statistics, and logic within computer science. It has the potential to bring new insights into almost all branches of human activity, because the data are stored almost everywhere. This thesis tries to show the main aspects of the original Czech method Guha, to demonstrate its strength via its application to television audience data, and finally to compare it with the association rules method, which is similar to it. The ambition of this text is to interconnect the world of praxis with the theoretical field, where methods are invented. It also serves as an introduction to data mining itself. The results show that Guha is a full-value method with several interesting features and might be a good tool for extracting knowledge from analyzed data.

Buddhistické obrázky ze Souboru Husheng tvoří významnou skupinu Feng Zikaiových obrázků manhua. Obrázky První a Druhé sbírky současně představují reprezentativní soubor Feng Zikaiových vrcholných manhua. Obě sbírky lze vnímat jako celek, který nabízí překvapivě široké spektrum pojetí nábožensko-filosofického ideálu nezabíjení a ochrany všeho živého. Dílo pojímá buddhistický ideál nezabíjení z různých pohledů. Myšlenkovým základem je buddhistické přikázání nezabíjení zdůvodněné vnímáním jednoty individua a veškerých živých bytostí, které vychází z teze o neustálém koloběhu převtělování. Poselství obou sbírek bylo též výrazně ovlivněno praxí mahájánového buddhismu, který současně výslovně formuluje požadavek ochrany živých bytostí, jejich osvobozování, zdůrazňuje nutnost příklonu k vegetariánské stravě a zároveň vyzývá k aktivnímu šíření těchto postojů. Výrazně buddhistický postoj je patrnější v První sbírce. Tuto sbírku Feng Zikai připravoval krátce po své konverzi k buddhismu a při práci úzce spolupracoval se svým celoživotním učitelem, buddhistickým mnichem, Mistrem Hongyim. Tyto dvě skutečnosti určovaly směřování celé První sbírky. Ve srovnání s Druhou sbírkou je První sbírka svým vyzněním apelativnější, obsahuje řadu obrázků a textů, jejichž působivost je založena na šokujících přirovnáních, která svědčí...

Mobbig at a sick-nurse working place

Mobbing at a sick-nursery working place Key words: psychical terror, conflicts, aggression, nursing staff The work deals with psychical terror at a working place. The aim of theoretical part is to show possible strategies of mobbing and to indicate possibilities of protecting in the case of becoming its victim. At the theoretical level the most often types of stricken persons are defined. The work is aimed to the children's age in searching the sourses. In the empirical part of the work are the symptoms of mobbing and sourses of its origin in nursing staff are discovered. Another aim is comparing differences between standard and acute nursing care. Three concrete casuistries show real mobbing in use among nurses. According to my search "fat ground" for the rise of mobbing exists at the most places of work. The work judges also the approach of superiors, especially departmental sisters, to solve conflict situations at a working place.
