Public interest in environmental Law

OF THE DISSERTATION ON "PUBLIC INTEREST IN ENVIRONMENTAL LAW" Zdeněk Horáček, 2011 The dissertation examines public interest in environmental law. Due to the lack of professional resources dealing with the very concept of public interest, the dissertation offers its basic definition and relevant connections, but always in relation to the institutes of the environmental law. Interpretive and historical aspects of public interest are analyzed and basic definition features, classification and process of the formulation of public interest, including correction of the improper process, are established. The dissertation specifies public interest in environmental law as a legally defined value of environmental protection shared by whole society. Such a public interest is promoted in all the phases of evaluation and authorization of a project that may be harmful to the environment, in the extent always depending on the specific situation. The dissertation concludes that environmental protection is a worldwide shared value and public interest. In addition, public interest in environmental protection is a criterion for a decision making process carried out by public authorities, and the resulting public interest (adopted solution) depends on the specific circumstances of the situation.
Viniculture and wine-production from the legal point of view

This thesis aims to provide an insight into the legal rules governing viticulture and winemaking, and their historical development. Furthermore, the current legal and factual situation as well as the current issues associated with the legislation in these fields are more closely examined in the thesis. An anonymous questionnaire had been created and sent to a selected group of small and medium-size viniculturists and wine producers in the Slovacko wine subregion in order to supplement the research and its aim of presenting the current legislation from de lege ferenda point of view.
Case-law of Czech courts in the area of environmental protection through criminal law

The aim of the thesis is to analyse judicature dealing with environmental crime of Czech courts. The reason for my research is fact, that environmental crime is one of the most dangerous for all human kind and there is such a small attention paid to it here in Czech Republic. The thesis is composed of five chapters. Chapter one is introductory and lines out goals of the thesis, terminology and techniques used in the thesis. Chapter two provides an outline of relevant Czech case law. This chapter is subdivided into six parts. Each part looks at special kind of environmental crime such as cruelty to animals, poaching, illegal wildlife trade, forest damage etc. Chapter three concentrates on impact of criminal liability of legal entities on environmental crime. Chapter four examines the infrequency of environmental crime coming before the court. Conclusions are drawn in Chapter Five. Frequent changes of complicated legislation have crucial influence on fighting the blight that is environmental crime. Prosecuting authorities are not motivated to prosecute the environmental crime because of light sentences. Czech courts also sometimes tend to legal positivism which brings out controversial judgements, especially in combination with poor-quality legislation.

The title of the thesis is "Viticulture and winemaking from the legal point of view". The purpose of my thesis is to analyze the Czech legislation of viticulture and winemaking. It is important to include the law of the European Union because it directly regulates the national legislation. The aim of this thesis is to give a complex insight into the valid viticulture and winemaking law. The thesis is composed of seven chapters, each of them dealing with different aspects of the topic. The first chapter is introduction and provides only starting point of the thesis such as terminology. Chapter two is subdivided into six parts and surveys historical background of viticulture and winemaking in the Czech Republic. Each part is devoted to one important era starting in antiquity and explores the evolution till current situation. Chapter Three shows viticulture and winemaking law in the context of the Czech legal system and highlights links between mentioned law and environmental policy. Chapter Four characterizes current EU legislation and focuses on regulations concerning common agricultural policy in the sphere of viticulture and winemaking. Tools for environmental protection in Czech law

The thesis is concerned on the topic "Instruments of environmental protection in the Czech Republic". The environmental law knows some categories of instruments. Mostly they are divided according to the influence to the subjects, respectively if they have direct influence to subjects or not. First category of direct instruments is called conceptual instruments and includes group of plans, programs and other documents concerned on scheming in area of environmental protection. Second group of direct instruments is called administrative instruments. These instruments contain commands, prohibitions, permits and approvals. They also contain standards categorization and ecologically-legal liability. Third group of direct instruments is called voluntary instruments. These instruments contain voluntary agreements, environmental managements systems and eco-labeling. Last group of instrument described in this thesis are institutional instruments. They are concerned on system of institutions which have some competences in environmental protection. Dopady regulácií v energetike na účinnosť a efektívnosť opatrení v ochrane životného prostredia

The theme of my diploma work is the regulations in energy sector. I will try to describe their impacts on the environment. I will deal with the economic effects of the regulations and their utility for the environment. I will use many criteria for the consideration of these regulations. The main solution of my goals should be the application of the regulations in energy sector to aggregates of national economy. In the first part of my diploma work I will try to define the concept of regulation and I will also mention some kinds of regulation, their methods and goals. In the second part, I will focus on regulations in Czech Republic and I will determine their background and institutions which deal with them. Third part of the work will contain the impacts of the regulations on market mechanism. I will focus on specific economic theories which deal with regulations. Fourth part will determine impacts of the regulations on the environment. I will mention some laws and alternatives for environment which are related to these regulations. Final part of my work will deal with individual regulations and their impact on aggregates of national economy.
Ecology and law

The thesis deals with the relationship between ecology and law in nuclear energy and the possible impact on the environment. The first part briefly summarizes the most important historical approaches to ecology and describes environmental law in the Czech Republic and the EU. The next section is focused on law in the area of construction and operation of nuclear power plants in the Czech Republic and the EU. The fourth chapter deals with operation of nuclear power plant Temelín and assessment the legislation. The fifth chapter is dedicated to various forms of longstanding conflict between the Czech Republic and Austria.

The purpose of my thesis is to analyse the relation between ecology and law. The thesis is composed of five chapters. Chapter One is introductory and defines the term ecology. Chapter Two focuses on law and its role in ecology. Chapter Three explains the importance of principles as the unifying elements of legal regulation. Chapter Four investigates the chosen principles of law intrinsic to environmental protection. Chapter Five describes the practical apllication of the Integrated Prevention and Pollution Control approach and endeavours for evaluation of its contribution to environmental protection.
