The Law of Contracts in the United States of America (The Approach to Conflict of Laws in American Contracts)

- 105 - The Law of Contracts in the United States of America (The Approach to Conflict of Laws in American Contracts) Summary: This thesis aims to compare the fundamental principles and basic ideas behind the law of contracts in the Czech Republic and the Unites States, hoping to introduce the reader not only to the pivotal maxims inherent to each of these two widely differing legal systems, but also to their respective idiosyncracies and mutual inconsistencies. It further wishes to explane the rather unique position of Conflict of Laws in the United States - its history, origin and some of its major differences when compared to International Private Law as it is known in Europe. The first part of the thesis offers a quick refresher course on selected legal concepts of Czech contract law handpicked with the express intent of comparing them to their American counterparts. A discussion of the history, sources and types of contracts in the United States then follows. A general analysis of Conflict of Laws in the United States and its history is also included. Using XML technologies to apply design patterns

Although contemporary programming style involves massive use of design patterns, programming languages does not offer suitable means tu support their application. Aim of this work is to show in practice that modern XML technologies, namely XSL Transformations, allow developers to avoid some routine tasks required by the objective language itself. This reduces the probability of errors, allows developers to focus on the key parts of the design, and makes maintaining the code markedly easier. These benefits come to light especially in large projects with hundreds to thousands of classes with complicated relations. In this Thesis we demonstrate these ideas on an example of a C++ compiler project.

Economic and social context of the establishment of the Czechoslovak Republic in 1914 - 1918

This bachelor thesis deals with the establishment of the Czechoslovak Republic in the years 1914 till 1918. It attempts to clarify the situation of a nation living in the Habsburg monarchy before the establishment of the Czechoslovak Republic. It analyzes also the economic situation of Czech lands and the whole Austria-Hungary before the First World War. In the first place, it concentrates on the Czechs and Slovaks and their efforts that led to secession from the Austrian hegemony. Next, the thesis points out whether the nation's independence from monarchy was considered before the outbreak of war or the war itself caused the destruction of programme ideas of the Czech political parties about the formation of an independent state, or whether the new emerging state was economically prepared for the secession from the Austria-Hungary. The major initiators are mentioned such as T. G. Masaryk, K. Kramář, E. Beneš and others, who stood behind the establishment of a new state. Primarily, the emphasis is placed on the events home and abroad in 1914 - 1918, on the formation of the National Council, on the Kramář project of Slavic Empire and the Masaryk's fight for independent state. In the thesis I prop myself upon published sources and recent professional literature.

Mediation - Method of Alternative Dispute Resolution

This bachelor thesis is focused on mediation as an alternative method of dispute resolution. The aim is to explain the term mediation, its characteristics and legal regulations. The target group of readers is general public. The first part of the bachelor thesis describes a conflict and ways of its resolution -- a court-action and on the other hand, all types of out-of-court dispute resolutions. The second part deals with the idea of mediation itself. It offers an explanation of the term mediation, describes mediation procedure and its rules, the outcome of mediation and mediation agreement, the mediator, types of mediators and requirements on their qualification. It is also concerned with the advantages of mediation and the area of disputes which could be solved by mediation. The last part of my thesis is focused on legal regulation of mediation in European Union and its three member states -- the Czech Republic, Slovak Republic and Germany. It also describes the history and background of mediation in these countries. Moreover, two sample cases of mediation in the Slovak Republic are added.

Pragmatic motivation of cliché from the point of view of an interpreter

This thesis offers a comparison of the research of clichés in three languages: English, Czech and Russian. Clichés are just one possible manifestation of how speech can be automatized and syntactic structures that can be reproduced and identified are created. This complex phenomenon must be studied through the prism of lexicology, stylistics and pragmatics. Understanding and interpretation of this phenomenon differs depending on linguistic schools and single authors, some linguists hold a negative opinion of clichés, some believe that in certain types of discourse clichés are necessary. There is no unified definition of a cliché either. This thesis is focused on clichés in political discourse where the pragmatic dimension of clichés and their functions in relation to users, both politicians and their listeners, is studied. Clichés are a prominent stylistic element which may have a significant impact on the work of an interpreter. This is why the empirical part is aimed at clichés from the interpreter's perspective. An experiment involving 14 professional intepreters is set up in order to study their attitude towards clichés.

Buryat shamanism

After the political changes in East Europe and Central Asia at the end of 80s of the 20th century some latitude of religious liberty, which had been limited till then, occured. It made possible to restore original traditions and gradually return the religion from illegality back to the public life. Ecclesiastic and confessional institutions started to restore in accordance with those ones operating in the period of Imperial Russia. A very specific situation arose from Buryat shamanism, which had never been under the state and authority control like other confessions had. Buryat shamans began to restore and renew extinct traditions mostly by the way of studying professional ethnographical and religious literature and inspired by the new philosophical currents of the tardy wave of New Age, they complemented numerous gaps and deficiency with their own ideas. During the last 15 years several organisations associtiating Buryat shamans have come into existence. They obviously differ from each other in their specialisation, traditions they gather from, and even in their range. Some of them are local, others try to unite all shamans in the territory settled by the Buryats, but there are also small formal and informal groups gathering disciples of a master. Education of Physics and Creativeness

This thesis has been an attempt to 1) delimit the concept of creativity in education, 2) analyze it with respect to its potential use in physics teaching, and 3) provide a practical solution that could be applicable in class. The results show that the idea of employing creative thinking in classes is potentially useful at best. Examples of a practical solution are offered at the end. They include: creative thinking in learning of Ohm{\crq}s law, creative thinking in learning of Archimedes{\crq} principle, and creative thinking in application of knowledge of geometric optics.

Husserl's phenomenology of attention

(in English): The diploma work Husserl's phenomenology of attention systematically presents Husserl's conception of attention. The first part deals with the presentation of Husserl's static phenomenology of attention, taking into account in particular of Logical Investigations and Ideas I. The second part is devoted to genetic phenomenology of attention, which is reconstructed mainly upon Experience and Judgment and Analyses Concerning Passive and Active Synthesis. In it's conclusion the work offers other possible perspectives of investigation of the phenomenon of attention from the phenomenological positions.

Guerilla filmmaking style and its impact on the work of sound recordist.

This diploma work is focused on changes in the workflow of the sound crew in dynamically changing environment, equipment and production in the filmmaking process. It describes personal experiences of sound professionals in rare environments, includes/offers technical tips, tricks and solutions of difficulties in all parts of the creative process: from preparation to post- production.
