Economic rights and the licensing agreement

Property rights and the licensing agreement Nowadays copyright is more important than it ever used to be. Cause of this importance is the development of society and mainly new technologies of communication which emerged not long ago, particularly Internet. Copyright in the Czech republic is based on dualistic conception, thereby we distinguish moral rights of author from property rights of author (that is in accordance with Berne convention article 6 bis). In the Czech law only property rights may be subject of licensing agreement. In first chapters I deal with copyright in general. Its position in Czech law system and review of sources of law including international treaties and European directives. Furthermore, I define subject of copyright, thus author's work. Chapter concerning author's property rights serves as an introduction to chapter analyzing licensing agreement. This chapter provides list of author's exlusive property rights mentioned in copyright act with their basic characteristics. Emphasis is put on the right to use the work. The enumeration of rights to use the work is demonstrative, so there may exist also different rights. Eventually in this chapter, there is mentioned duration of economic rights. 58 4. Summary The Czech material law of succession The law of succession is one of the most important branches of civil law. It governs the succession of the deceased's property onto his heirs. The Czech law distinguishes two means of succession - the former is testamentary succession while the later is legal succession. The difference between the two lies in the fact that legal succession takes place only when the deceased leaves no last will. In my thesis I thoroughly processed the all the institutes of the Czech material law of succession. The first chapter introduces the meaning of the law of succession and its main principles, e.g. the principle of familiarity or the principle of free disposition. The second chapter concentrates main focus of my thesis and is furthermore sub-divided into sub- chapters. In the first sub-chapter I explain and give examples of the most important sources of law of succession. The second sub-chapter enumerates the premises of succession, i.e. death of the predecessor, existence of the inheritance, legal reason for succession and capacity to be heir. The third and fourth sub-chapters elaborate on the possibility of refusing the inheritance and the succession of debts. Self-defence And Its Ethical Aspects

This work deals with self-defence as objectively possible, morally obligatory and legally permissible. It is based on sindefendology, the scientific discipline of self-defence, and Christian ethics. It explains the need of sindefendology base, and the necessity of rejecting all the if-concepts of ``self-defence`` (jujitsu, aikijitsu, karate, kenjitsu, or systems resulting from them). Ethical justification is assessed on the basis of the Summa Theological by St. Thomas Aquinas, the Catechism of the Catholic Church, the defence options of the assaulted and possible danger as a result. It is essential as well as useful to distinguish between situations of self- -defence and self-protection, as only this division allows the defender to identify the nature of the combat situation, and the acceptable ethical reaction before having been placed into the serious time pressure.

Role diskurzních markerů v bezprostřední neformální konverzaci rodilých a nerodilých mluvčích

The thesis is focused on the study of discourse markers in English informal language. The main corpus includes seven face-to-face conversations of native and non-native speakers and serves as the basis for the research. At first, necessary linguistic terms are defined. Then, the corpus and speakers{\crq} characteristics are presented. The practical part concerns frequency, different functions and positions of particular discourse markers. The factors which might influence the possible choice of discourse markers and its motivation are focused on. Attention is also paid to the frequency of discourse markers used by the class of non-native speakers who were divided to the sub-classes of pre-intermediate, intermediate and advanced. The work further observes co-occurrence of the markers and ambiguous expressions that are not easily distinguishable. Finally, the results of the research are interpreted and analyzed.

Sequence analysis of SIX homeobox family in Craspedacusta sowerbyi

Homeobox genes are generally known as key factors directing processes during the morphogenesis of organ systems. Recently, research of homeobox genes evolution has focused on evolutionary old groups of species, such as Cnidarians. ln Cnidarians, there are more homeobox genes compared with more complex organism, such as fruit flies. Several homeobox genes have also been described in plants and fungi. General opinion is that homeobox genes are a very old group of genes, originating even before the main kingdoms of multicellular organisms. Six homeobox genes that have been identified as homologues of Drosophila sine oculis, an important factor for compound-eye formation, take part in numerous developmental processes directed by the PAX-SIX-EYA signal pathway. ln Vertebratae, as representatives of Deuterostomes, there are six genes in three sub groups, whereas in Drosophila melanogaster, as a representative of Protostomes, three homologues have been described, always one for each subgroup. The ancestral six genes diverged even before the divergence of groups Bilateralia and Cnidaria. ln freshwater jellyfish Craspedacusta sowerbyi we distinguished both HD and SD regions for five SIX proteins. Public awareness concerning problematic of dementia Dementia is a problem that is socially becoming a very serious topic. Consequently, with the increasing aging of the population, the number of people who are suffering from it is growing. The symptoms of dementia include a decreasing of the intellectual and memory abilities in comparison with the level on which they were acquired before the illness started. Nonetheless dementia does not include the defects in intellect and memory only; it also includes other psychical functions. For example, dementia strongly affects the person in virtually all social situations and has a big impact on the quality of the patient´s life, as well as the life of his/her family and other people that are close to them. In most cases this illness starts very slowly. Thus, diagnosing dementia in advance gives the possibility of an early start of symptomatic treatment as well as maximum use of the therapeutical procedures available nowadays. At the same time it gives patients and their family time to prepare for future health, financial and law problems. The public cannot distinguish the pathological aspects of aging from the normal aspects of aging. Consequently, the usual idea of aging is still a perception that includes forgetting, change of personality and aggression. These symptoms are not the indivisible part of aging, but they can be the symptoms of pathological process. I believe that if the public accepts this fact, it can change its attitude to the elderly. The problem is that the public is still not informed enough. Considering the facts mentioned above which I regard as important, it seems we should make an effort to find out how much the public informed about the problems of dementia. The theoretical part of this work gives the basic information about the problems of dementia. It defines dementia, its epidemiology, etiopatogenezy, and it classifies the different kinds of dementia. It also deals with differential diagnostics, risk factors, diagnostics, treatment and prevention; and it also contains chapters dealing with dementia from the social, financial and law point of view. At the same time it gives information about the present possibilities of help in the institution of social care, and it also gives the list of the organizations in the Czech Republic which offer help in the care of people suffering with dementia. In the practical part of my theses I wanted to find out how much the adult population of Písek is informed about the problems of dementia. I used a method of a standardized questionnaire that consisted of 18 questions; and the research was done on a statistically significant group of adult inhabitants of the town Písek. The total number of distributed questionnaires was 250, 220 were filled in, out of which 25 were filled in a wrong way. The final number was 195 correctly filled in questionnaires that were possible to use. The hypothesis as stated :{\crqq} The adult population in the town of Písek is not informed enough about the problems of dementia{\crqq} has been confirmed, because the respondents were informed about it enough in only 42% of the sub-questions. I believe that it is important to inform the public. It would help to prevent or lower the risk of neglecting and disregard of the warning symptoms of the pathological process of aging. I wish this theses was available to the people working in health and social services and mainly to the public. Such an availability of the material would give them well-arranged basic information about the problems of dementia.

Sources of nitrate in lower reach of Jizera alluvium: unsaturated zone and other sources

The water supply system Káraný (WSSK), which is using the water from Quaternary fluvial aquifer and induced recharge from Jizera River, is affected by increase of nitrate content in recent years. No tension lysimeters were emplaced into the soil at locality north of Sojovice and sampled roughly with monthly frequency. Samples were analyzed on isotopic content ( 2 H and 18 O of H2O) and chemistry. Volume of water collected in lysimeters was recalculated to mm/year. Infiltration tests demonstrated that infiltration rate at surface of agricultural land is low and therefore Horton surface flow is generated after heavy rains and during watering periods. Horton surface flow is disappearing into open desiccation cracks. This concentrated recharge may via preferential pathways transport nitrates via unsaturated zone. Using selected environmental tracers (Ca2+ a SO4 2- ) the portion of water from Jizera River in individual wells of WSSK was calculated. For Sojovice part of WSSK the water from Jizera River accounts for 71 - 80% of pumped groundwater and for Skorkov part of WSSK this is only 38 - 41%. The remaining part of water is either water from infiltration to Quaternary fluvial aquifer and/or water from Cretaceous Jizera Formation Aquifer. Analysis of the Projects on Development Transport

This bachelor thesis deals with the analysis of selected projects for transportation development under ROP NUTS II Jihozápad. The aim of the thesis is to analyse the projects, evaluate and generalise the incurred deviations and changes during their realisation, and based on that, to propose suitable measures leading to the avoidance of deviations and changes during future projects. The thesis is focused on two successfully realised projects in the field of transportation, which are the reconstruction of a bridge in Písek and the reconstruction of a bridge in Roudné near České Budějovice. The South Bohemian Region applied for funding for the projects in both cases. The thesis consists of two parts: theoretical/methodological and practical. The first, theoretical part, describes the essence of structural policy, the meaning, the aims, the principles, and the sources of funding for regions, from which applicants may get funds for a projects realisation. It is also focuses on operational programmes as a tool for drawing funds from European sources, and on the division of the European Union territory into NUTS units. In the theoretical part, a project is defined, types of projects are distinguished, and a project cycle is explained. The methodological part discusses the methods used during the thesis work. The second, practical part of the thesis applies theoretical knowledge to analyse the selected projects.

Some problems in translating modal verbs structures from German to Czech

The subject matter of this diploma thesis is linguistic modality in German with focus on certain problems in translating modal verbs structures from German to Czech. In the theoretical part, the concept of modality as well as the differentiation of modal field is elucidated. Besides the usually used classification of subjective and objective modality, a more precise structure is applied, which is that of epistemic and non-epistemic modality. In addition, in the field of non-epistemic modality, two other sub-types are distinguished according to whether a speaker s evaluation is present or not. The practical part methodologically relies on concrete data such as modal verbs used with perfect infinitive or modal verbs in past perfect tense (Plusquamperfekt) and their translations from German to Czech. Based on selected examples, the aim of this thesis is to emphasize the main differences between Czech and German modality and to underline their essential significance to the translation accuracy.

Chiral recognition by mass spectrometry

Jana Roithová, Ph.D. This work is focused on the use of mass spectrometry as the analytical method for chiral recognition in the gas phase. We have examined formation of complexes (S and R) isomers [dimethyl-2,2'-dihydroxy-1,1'binaphthalene-3,3'-dicarboxylate] with sodium. Chiral effect for the fomation of sodium dimers is 1,34±0,06 and that for formation of trimers 2,38±0,22 in favor of the formation of homochiral complexes. Part of the work is devoted to the preparation of isotopically labeled ester [(R)-(−)- di(D3-methyl)-2,2'-dihydroxy-1,1'binaphthalene-3,3'-dicarboxylate]. Mixing of equimolar amounts of D3-(R) and unlabeled (S) isomers leads to the artificial racemate, while we can still distinguish the enantiomers using mass spectrometry. Another part represents the study of the complex formation between (S and R) isomers of [dimethyl-2,2'-dihydroxy-1,1'binaphthalene-3,3'-dicarboxylate] with the metal complex [(S,S)-1,5-diaza-cis-decalin]Cu(OH)I depending on the molar ratios in the solution.
