Social Pathological Phenomena in Society - Public Attitudes to Juvenile Crime

Tato práce je zaměřena na problematiku chování, které může vést až ke kriminalitě dětí a mladistvých. Na specifické příčiny vzniku tohoto problému, které jsou ovlivňovány působením společnosti, výchovou v rodině a osobností každého jedince. Vnímání veřejností tohoto problému a jaké jsou shledány možnosti prevence, jak na problematiku nahlížejí učitelé a rodiče. Tyto aspekty jsou obsahem teoretické části bakalářské práce. Obsahem empirické části jsou rozhovory s uchazeči a zjišťování postoje společnosti ke kriminalitě. Přiblížení jednoho konkrétního případu brutální kriminality, spáchaný mládeží v ČR. Kde jsou společností viděny rizika a jaké jsou možnosti prevence.

Crime of fraud, insurance, credit and loan fraud pursuant to section 209, 210, 211 and 212 of the Criminal Code The purpose of my thesis is to consider all the aspects of law structure of frauds in the Czech Criminal Code. The thesis is composed of six chapters, the first chapter dealing with the general term of economic, financial and property delinquency, while the other chapters investigate particularity of different fraud types of the Czech criminal regulation. The methodology employed was a review of the judicial decisions offering contradictory interpretation of fraud statutes. Privatisation process in 1990's started the growing trend of fraudulent actions when some people identified the lack of regulations and opportunity for gaining profit out of it. Despite the fact that we never quantify the true extent of frauds as there remians a high proportion of latent acts, the trend of frauds was (and still is) increasing. Although all the fraudulent activities were punishable pursuant the provision of fraud, damage was not always possible to be proven. Fraud involves intentional misrepresentation or concealment of fundamental information intended to result in an unauthorized benefit of a person. Způsoby represe vůči mladistvím a nezletilým pachatelům trestné činnosti. Dílčím cílem práce je zmapování programů prevence kriminality mládeže prováděné v rámci Policie České republiky.

93 Resumé Issues of Criminal Responsibility and Prosecution of the Juveniles This dissertation focuses on the Act No. 218/2003 Coll., Act on Juveniles' Responsibility for Illegal Acts and on Juvenile Justice and on Amendment of Various Acts, as amended (Act on Juvenile Justice), thanks to which the Czech Republic returned to the idea of an independent juvenile judicial system existing between 1931 and 1950. By the adoption of the Act on Juvenile Justice criminal law took a considerable position within the scope of child and juvenile legal protection. The dissertation aims at showing differences between general criminal law regulations and special regulations related to the juveniles. It further draws attention to shortcomings of the aforesaid act caused either by its interpretation or legislative drawbacks. Likewise, it comprises an outline of solutions to some of the shortcomings or proposals for possible modifications of the act in the future. The dissertation is divided into six chapters. The first chapter contains historical development of juvenile criminal law legislation as of foundation of the Czechoslovakia till the adoption of the Act on Juvenile Justice. Inclusion of Mentally Ill People in Some Chosen Parts of Vysocina Region

The subject of this diploma paper is Inclusion of Mentally Ill People in Some Chosen Parts of Vysočina Region. It is focused not only on service providers, who deal with people suffering from some mental disorders, but also on service users, it means on people with illnesses from the domain of psychoses, above all schizophrenia and affective disorder (according to MKN-10, F20 {--} F29, F30 {--} F39). It is about people, whose social roles have been disrupted because of their illness and they are in danger of isolation and also social exclusion. The aim of this paper is to find out whether and in what way the inclusion is carried into effect in some chosen parts of Vysočina Region. In the theoretical part of this diploma paper the writer deals in a complex way with the problems of inclusion of disordered people from medical, social and juridical point of view. In the introduction the author qualifies the current situation of these problems. The first subchapter is focused on mental disorders, from the domain of psychoses, their description, their social importance, precaution and therapy. The second chapter covers inclusion and its importance. In the following part full rehabilitation and its partial parts are described. The fourth chapter deals with social work, which is focused on helping people with mental disorders and in the last chapter the author writes about problems of rights of mental ill people. The research part is based on qualitative analysis, which examines the above mentioned aim. To examine the results at the service providers it was used a method of semi-standard dialogue, which is done not only on the base of fixed questions but also on the possibility of expressing their own opinions. The case reports were worked out at the service providers. These case reports were based on the method of concerned supervision. According to the results it is obvious, that inclusion of users is carried into effect in given institutions, because 55% of respondents answered yes and 39% of respondents answered more likely yes. The result is above all the cooperation of partial parts of full rehabilitation, whose aim is to contribute mainly to inclusion. The conclusion of this paper is benefit of this knowledge, that during planning of service, intervention, analyses of needs, it is necessary to consider individuality of every client as much as possible and always emphasize individual approach. In this procedure it is also important trained staff. The author has experience of several years, which she can rely on, and she believes, that in the future community centers will be still founded and they will mostly replace big hospitals. This will be a next important step to re-socialization and to following inclusion of mental ill people.

68 English résumé: Crime scene examination The diploma paper considers analysis of criminology method called crime scene examination. The introduction of the thesis shortly deals with progress of proofs during criminal proceedings. Author presents the crime scene examination as a creative and a systematic activity of the bodies in charge of criminal proceedings, which targets the detection of criminality and criminals. The second chapter treats conceptual signs of crime scene examination. There is accomplished the analysis of examination as a criminology method, whereat the bodies in charge of criminal proceedings discover, by the help of direct observation, all the matters, which are useful for clearing the perpetrated criminal activity. Sequentially the focus is paid to criminal scene. At this moment the author of the diploma paper compares the ideas of character of criminal scene. He mentions two opinions. The crime scene can be the area, where the crime is perpetrated or according to the second opinion the crime scene can subsume also other areas, which are connected with the crime scene somehow. Analysis of the defects identified in the fire inspections performed within the State Fire Inspection of the Fire Rescue Department of South Bohemia for the years 2003 - 2012

The thesis on the topic Analysis of Faults Found in Fire Inspections Performed within Execution of State Fire Inspection by the Fire Brigade Rescue Corps of Southern Bohemia in 2003 2012 focuses on comparison of faults selected by gradual elimination from all the 700 fire inspections to final 150 complex fire inspections and classified per years in a ten-year comparison period. Follow-up inspections and thematic fire inspection were not used for the complex evaluation as they did not contain the necessary information. Six parameters were chosen from all the performed complex inspections containing 30 monitored facts of correctness and existence of documents of the inspected object and seven monitored facts from physical examination of the objects. These six parameters were subsequently compared. The aim of my thesis was to find out whether the numbers of the faults detected within execution of the state fire inspection were increasing in the individual categories. The theoretical part summarizes the basic legal norms applicable to the Fire Brigade Rescue Corps of the CR and to execution of the state fire inspection and some extensive legal norms related to the inspection activities or inspected subjects. Elaboration of the thesis topic required explanation of some terms like legal entity, private entrepreneur, fire inspection, state fire inspection and its integration in the Fire Brigade Rescue Corps of the CR. The chapter contains description of activities including graphs illustrating procedures related to execution of state fire inspection. A separate part is dedicated to fire protection history, formation of awareness of the history and to chronological arrangement of some key legal norms binding for the Fire Brigade Rescue Corps of the CR and execution of state fire inspection. It was for example necessary to present the rules governing execution of state fire inspection like professional competence of Fire Brigade Rescue Corps members and their identification at the place of inspection, to clarify the terms fire inspection plan and fire inspection programme. The final part of the theoretical base of the thesis contains the rules of behaviour of Fire Brigade Rescue Corps members performing state fire inspection at the inspected site and principles of interaction with people representing the inspected subject. The research methodology was chosen adequately to the topic dealt with. First archive materials from complex fire inspection records were studied and then the individual faults were qualitatively processed and categorized to faults in documentary part and physical defects. After that a selection of closer spectre of examined faults was performed and preparation of data for comparison. The faults of the individual years were compared in the monitored data and the danger index of the individual years was calculated. The concluding part of the thesis focused on presentation of the dependences of the detected faults of the individual years by means of tables and graphs. The results were mutually compared, classified, commented in detail in the discussion and elaborated into the overall image of the society. Dependence of the number of performed complex fire inspections on the number of detected faults was proven from the danger index and from graphic representation of its values.

Anti-Money Laundering in the Tax Consultancy Office

Thesis deals with application of anti-money-laundering legislature in tax attorney environment. A general theory of money laundering is discussed and legal requirements on tax attorney are presented resulting from act 253/2008 Coll. on selected measures against legitimization of proceeds of crime and financing of terrorism "Anti-money-laundering Act". Selected tax Attorney Company is then analyzed in terms of anti-money-laundering clauses and their practical application. Finally a specific AML internal control system is created with suggestions on implementation in this company.

Terrorism as a crime under international law The purpose of this thesis is to assess the possibility of prosecuting terrorist attacks as crimes under international law and analyse the feasibility of their prosecution before the International Criminal Court. The reason for this research is is twofold. First, compared to the international academic scene, Czech research related to this topic is relatively sparse. Second, the international terrorism has grown into a massive issue of international significance and its global aspects leave the traditional national judicial mechanisms somewhat lacking with regards to the efficiency in its prosecution. The author has therefore attempted to examine the possibility of using the only permanent global judicial body available in today's world, the International Criminal Court. The thesis is composed of six chapters, each of them dealing with different aspects of prosecuting the terrorism as an international crime. Chapter One is introductory and defines basic thoughts upon which this thesis builds. It also presents the structure of the thesis with regards to possible issues which may arise during its course.
