Reduction residential property prices as a result of defects or faults assessed construction

This thesis has the task to bring us to the issue of the valuation of the house loaded defect perimeter walls. The first chapter focuses on the theoretical information in the issue of property valuation. The second chapter deals with possible defects and faults of real estate. The third chapter is to approach the issue of property damage. The fourth chapter provides a survey of real estate and the last, fifth, chapter focuses on a case study of the valuation of the house with impaired peripheral walls and the suggestion of possible ways how to reduce the value of the property as a result of the defect.

Shareholder's meeting and board of directors of joint-stock company

The objective of my thesis is description of mutual relations between shareholder's meeting and board of directors of joint-stock company including their activities, rights and obligations. Then I focused on comparison of legislation of commercial code and bill of commercial corporations. In my first chapter, I dealt with characteristics of joint-stock company, its foundation by public offering or without and its formation. Second chapter concerns with legal regulations of General meeting, especially with the emphasis to its convening, composing, running, decision process and scope including rights and obligations of shareholders. Third part is focused on issues related to board of directors, its election, activity, responsibility and liability for damage and also rights and obligations of individual members. Finally in last part, I compared current legislation of commercial code and bill of commercial corporations in matters of shareholder's meeting and board of directors.

Liquidation insured accident

This Bachelor's thesis deal with the process of liquidation insured accident with externalization to motor-powered vehicle. The thesis is focused on procedure, practice and phase by which the insured accident passes by the liquidation. There are charted the process and the work load of the insurance surveyor. At first there are theoretically delimited individual sorts of automobile insurance, in fact accident insurance and the damage liability, their construction and the creation of reserves. Other part is focused on the process of liquidation of insured accident which is composed of the damage reports, after that the registration of insured accident, liquidation, payment of insurance benefit and the archiving. There is also mentioned the problem of insurance default.

Liability of Supervisory Board

This thesis deals with civil liability of the Supervisory Board and its members for breaching his duties. Emphasis is placed on responsibility and legal relationship, whose content is obligation to pay damages, between Supervisory Board and its member and business companies (in the new terminology "business corporation"). This thesis is dealing at first with the legal anchoring of the Supervisory Board as such, the creation and termination of the Supervisory Board and the definition of its living space not only in the relation to corporation, but also to individual shareholders, General Assembly and of course to the Board - including their mutual rights and responsibilities. Thesis is crossed by author's intention to evaluate the active legislation, whose legislative life is coming to an end, and on the basis of that to comment upcoming legislation that at least brings a fresh wind to the corporate life. Shortly is discussed upon by the factual impossibility to prosecute members of the Supervisory Board for crimes associated with their performance.

Delictual liability of natural persons in environmental law

The number and hazardousness of human activities that breach environmental law now features serious and growing problem. The environmental liability, that represents effective legal instrument, includes delictual liability and liability for environmental damage. The purpose of dissertation is to analyze and describe the present legal regulations of the delictual liability of natural persons in the field of environmental protection. The final aim is to propose recommendations de lege ferenda. The introductory part of dissertation defines the basic concepts like legal and environmental liability and basic priciples of environmental protection concerning delictual liability. Than it provides describtion of regulation of liability in international documents and in European Union law. The dissertation is analyzing in detail the administrative and criminal liability in Czech legal order. Natural persons are liable in Czech legislation in case of lighter breach of law for offences and other administrative delicts or in more important cases for environmental crimes. The Impact of the Mechanical Dependence of the Components of Total Elbow Replacement on Implant Survivorship

Drawing on long-term clinical experience, the dissertation provides an overview of the options for the reconstructive surgery of irreversibly damaged elbow joints and the individual structural directions in the development of total elbow replacements. The clinical study focuses on the comparison of the unconstrained Souter-Strathclyde elbow implant, which has been used at our workplace since 1987, and the semiconstrained Coonrad-Morrey implant, which we started to use in the nineties. The disadvantages of the Souter-Strathclyde implant consist of a relatively complex surgery technique and narrower indication which does not permit larger primary instability of the operated elbow and large bone defects. Due to these reasons in recent years the Coonrad-Morrey total elbow replacement has been the preferred option at our workplace. The main problem as regards the long-term survival of this implant is especially the wear of the polyethylene bushings of the fl oppy hinge. This can be solved through an early replacement of this hinge before substantial abrasive wear develops ultimately leading to the loosening of the whole implant. Reduction in House Prices due to Humidity

Diploma work "Problems of house price reduction due to defects manifested with damp" deals with the issue of property valuation and subsequent sale of the defect. The first chapter describes valuation and other important factors relating to the Act valuation. The second chapter deals with the necessary documentation for property valuation and basic terminology. The third section deals with defects that could occur in the residential building as well as their possible correction. Another part of this work is focused on the actual valuation of the object to a defect with property damage and the last chapter deals with the actual real estate market and the subsequent sale of such property with the defect. The attachments of the case study is then focused on the valuation of the house and without defects and possible solutions and proposed procedures for sale.

The issue of pre-contractual liability in relation to the practice of negotiating and concluding commercial contracts under national law and case-law of selected EU countries

The thesis deals with questions of pre-contractual liability which is seen as a very specific institute whose conception is diverse in different EU countries and also outside. The main research question is a difference between pre-contractual liability perception in the different countries and its full description in relation to the negotiations of business contracts with an emphasis on Czech law. In the first part, the author analyses historical background of pre-contractual liability in relation to Roman law and German-Austrian legal systems in which the professor Jhering developed that construction of culpa in contrahendo. In the following chapters, the author deals with the description and nature of pre-contractual liability, particularly in questions of whether they are contractual or delictual liability and enter into details the basic facts, example and extent of damages with respect to the European concept of pre-contractual liability. He concludes that the pre-contractual liability is in the European concept as delictual liability, with regard to the decision of European Court of Justice. Possibilities of private enforcement in the Czech Republic and in Germany Summary The purpose of my thesis is to analyse the possibilities of private enforcement of competition law in the Czech Republic and in Germany. The reason for my research is to detect differences of the relevant legislation and to find potential inspiration for an amendment of Czech competition law. The thesis compares legal basis for private enforcement in the Czech Republic and in Germany in connection with the current developments in the European Union. The thesis is composed of eight chapters. Chapter One is introductory and chapter Two highlights main literature on the topic. Chapter Three defines basic terminology used in the thesis: competition law, private enforcement and development of private enforcement in the EU. Chapter four examines relevant legislation which forms legal basis for private enforcement and for damages actions for breach of the competition (antitrust) rules in both, the Czech Republic and in Germany. Biomechanical research study of skull plates and implants

Cranial implants along with fixators are used to restore the function of the damaged area of the human skull, where due to disease or injury the defect was created. When assessing the suitability of the implant and fixators the mechanical properties are significant. With this the material and shape of implant and fixators are related. The implant must be suitable with human bone tissue and also be able to withstand long-term loading. This paper summarizes the present knowledge regarding the design, manufacture and application of cranial implants. Next the stress-strain analysis of the loaded scull with irregular shaped defect, placed implant and fixation system is provided.
