Bedaňová, Jana ; Honusková, Věra (advisor) ; Flídrová, Eliška (referee)
International Legal Protection of Refugees Persecuted for Reasons of Sexual Orientation and Gender Identity: A Critique of the Human Rights Approach Abstract This thesis examines the human rights approach to the interpretation of the definition of refugee by using the example of persons persecuted on the grounds of sexual orientation and/or gender identity (SOGI). The thesis focuses primarily on the European area and how a human rights approach to the interpretation of 'persecution' may be relevant to the practice of European Union states specifically in relation to SOGI refugees. The first part outlines the context of persecution of persons fors reasons of their SOGI. It examines the criteria by which SOGI is, and potentially can be, subsumed under the relevant grounds of persecution for refugee status. The second part outlines the different approaches to interpreting the concept of persecution and elaborates more on the so-called 'circumstantial' approach embodied by UNHCR. The third part is devoted to elucidating the doctrine of the human rights approach pioneered by James Hathaway and his book The Law of Refugee Status. The fourth part examines the approach of human rights monioring mechanisms to failed asylum seekers fearing persecution on the grounds of SOGI. It analyses the decisions of the Committee...
Migration and its social construction in approaches of political parties in the Chamber of Deputies in the Czech Republic
Burešová, Zdeňka ; Novotný, Vilém (advisor) ; Jelínková, Marie (referee)
Migration is a phenomenon which has strong impact on the Czech Republic. The Czech Republic is currently under transformation from transit country to immigration country. At the present time the situation is even more complicated because of the migrant crises which impact all of us. I suppose that the Members of Parliament will create social constructions or narratives about migrants during the sitting of parliament. I aim to identify social constructions of migrants that are created by the Czech political parties represented in the Chamber of Deputies since the 2013 election. I will divide social construction into two main groups. Ones belong to migrants and the other ones to refugees. I would like to find out if there are more positive or negative social constructions and how are benefits and punishments distributed to these groups. I would like to discover key narratives of particular political negotiation as well. Theoretical background of this thesis is the social construction of target population theory of Anne Schneider and Helen Ingram. In the manner of Lina Newton's article "It is not a question of being anti-immigrant: Categories of deservedness in immigration policy making", I will use a combination of discursive and narrative analysis as the main method. I will analyse statements and...

The work of Government and non-Government organizations in refugee integration in the German labor market, Sep. 2015-Jan. 2016. Moreover, the findings analyze the main industries where refugees are typically employed. Finally, comparing the areas of focus by both types of organisations, it is identified the presence of a noticeable division, not...
The definition of a refugee, its interpretation in recent international law
Honusková, Věra
The dissertation examines the definition of a refugee and its interpretation and application in the current international law. The thesis is based on the definition which is incorporated in the Convention Relating to the Status of Refugees of 1951. According to the Convention a refugee is a person who "owing the well-founded fear for being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, is outside the country of his nationality and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country (...)". The dissertation deals with the inclusive part of the definition only. The following theses are discussed: 1) whether there has been a shift in the interpretation and application of the definition of a refugee. Also, the dissertation analyses whether a new customary definition was established and what is eventually its content; 2) whether a regional customary definition was established and what is eventually its content; 3) whether the restrictive practises of the states prior to and during an entry of a foreigner influence the interpretation and application of the definition of a refugee. The study is divided into four parts. The first part analyses the historical development of the definition of a...
Environmental Migration - Reflection of the Migration Policy Segment from the Point of View of Global Justice and Christian Social Ethics
Váňa Jirků, Tereza ; Štica, Petr (advisor) ; Fošum, Jan (referee)
The thesis aims to familiarize readers with the basic concepts of environmental migration at such a pace as to enable discussion and reflection on the subject. The first chapter is introductory and defines basic concepts such as migration, environmental migration, refugee. The second chapter deals with environmental migration. Environmental migration is nothing new. Natural and human-induced disasters have been the cause of migration in the past and are likely to be the cause of migration. The third chapter deals with legislation on environmental migration. It examines refugee law, human rights law, or international humanitarian law. It points out that the existing legislation is not sufficiently developed. So far, there is no legally recognized definition of an environmental migrant. The fourth chapter looks at migration as a moral question, primarily in the optics of the social doctrine of the Church, the universal determination of goods, solidarity, and the direction towards the integral good. The fifth chapter deals with the little discussed or neglected ethical issues associated with migration. The last chapter is devoted to possible suggestions and solutions to environmental migration. It describes the most common proposals such as broadening refugee definition, enhancing disaster protection...

Halaj, Vladislav ; Brunclík, Miloš (advisor) ; Stauber, Jakub (referee)
UNIVERZITA KARLOVA FAKULTA SOCIÁLNÍCH VĚD Institut politologických studií Vladislav Halaj Problematika imigrace v programech ČSSD a ODS Abstrakt práce v anglickém jazyce Praha 2018 Abstract The aim of this bachelor thesis is to examine problematics of immigration in context of two ideologically different political parties which have had permanent representation in the Parliament of Czech Republic since 1993 - ČSSD and ODS. The analysis starts with the year 2012 when neither media nor political agendas did assign any importance to this topic. The whole examination will end with year 2017. An issue will be considered through views of both mainstream parties: how they approach topic in bounded time interval and if they tried to exploit anti-immigration moods in society by embracing dislike of immigration in their schemes. Besides, in my thesis I will be dealing with how both parties are approaching problem of immigration, what solutions are offering and how big portion of their agenda this issue takes. I will examine ways questions about migration evolved during the whole period and how terrorist attacks affected these changes in connection with the migration crisis. In view of the fact that politician parties belong to one of the major players in political process, my thesis will investigate how big...
Regionální média a uprchlická krize ve vybraných krajích České republiky
Rodová, Zuzana
This bachelor thesis deals with the phenomenon of refugee crisis and migration and with the projection of this theme in regional media. The aim of the thesis is to point to how migrant people are portrayed in regional media and to evaluate whether the picture of migrant people is consistent in regional daily newspapers on the basis of comparison of two regional mutations of the chosen medium. Then our aim is to suggest advice and recommendations for balanced coverage of this theme in the news. The theoretical part of the thesis offers insight into current migration trends in Europe, definitions of basic terms such as refugee crisis, refugee, migrant, asylum-seeker, international protection etc. Also we deal with the influence of media on the formation of public opinion and opinion on refugees. The following chapter presents our analysis of a small sample of articles in foreign media. We show how journalists write about migration in regional newspapers behind the border of the Czech Republic. In the empirical part of the thesis we try to find out, through content analysis of websites of two regional mutations of Deník, how the theme of the refugee crisis and migration is reflected in regional media. We find out that the portrait of refugees in regional media is rather consistent and the differences are given mostly by the personality of a journalist. Media agenda in regional newspapers rather do not correspond to real development of refugee crisis at the given place. It rather corresponds to the reality at the level of the Czech Republic or the European Union. We suggest essential recommendations for better covering the theme at the level of language and we call for deeper context.
