Beinlichová M. Czech labour market in relation to EU membership. Bachelor thesis. Brno: Mendel University, 2017. This bachelor thesis deals with the issue of international labour migration with the effect on the Czech labour market after the accession of the Czech Republic to the European Union. After the general introduction of basic concepts, this thesis provides an overview of the development of legislation concerning aliens on the territory of the Czech Republic and the Czech labour market. On the basic of statistical data, changes which have occurred in the development of the number of aliens on the Czech territory and in the labour market are identified here. Subsequently, the effects of these changes are evaluated. The findings are summarized at the end of this thesis.
Political Debate about the Issue of Free Movement of People in the United Kingdom between the Years 2010 and 2016

This Bachelor thesis is concerning with the evolution of stances of four main British political parties, namely the Conservative Party, Labour Party, Liberal Democrats, and the United Kingdom Independence Party, towards the issue of free movement of people between the years 2010 and 2016. The thesis aims to analyse on the basis of chosen documents, mainly manifestos or speeches of the parties' leaders, how and why did the stance of each political party towards the freedom of movement changed over the chosen period and how the stances differed among the parties. Mostly two documents are analysed for every chosen milestone of the time period between the years 2010 and 2016. These milestones are general elections in the years 2010 and 2015, the end of the transitional period for Bulgaria and Romania at the turn of the year 2014 and the European Parliament elections in the year 2014. For showing a possible shift in the stances of individual parties towards the issue of free movement of people are their statements characterised on a six-level scale negative to positive, whereas the sixth level means the issue was not mentioned in the statement. Benefit tourism as a problematic aspect in the EU Benefit tourism is a topic which has gotten quite a lot of media attention lately, has influenced the lives of mobile EU citizens as well as the EU itself in connection with the brexit. The aim of this thesis is to provide the reader with a comprehensive portrait of the topic, and to explore how is this phenomenon reflected in the case-law of the Court of Justice of the EU. In addition to dealing with the political context and the notion of benefit tourism, this thesis explores the free movement of persons based on both, the economic and the non-economic basis. The focus of the thesis lays on the case-law of CJEU relative to the access of economically inactive EU citizens to the social assistance systems of the host Member States, particularly the judicial chain Brey - Dano - Alimanovic - García-Nieto. These judgments are revolutionary in a way, because for the first time, the Court took into account also the "public finances" argument which has been raised by the Member States for years and the CJEU has always been adamant on rejecting it in favour of wider interpretation of social rights. Separatist tendencies in individual EU Member States and the potential impact on the free movement of persons in the EU This thesis deals with the separatist tendencies within the Member States of the European Union. It is therefore a case when a certain region within a Member State decides to secede from it. This needs to be distinguished from a situation when a whole Member State decides to withdraw from the Union. The aim of this thesis is to analyze the various possible scenarios in the case where there is a separation of that region from the Member State. It deals with it in the context of the regions potential continuity within the Union and furthermore it examines the differences between the two most important cases of possible internal secession in the EU of today: Catalonia and Scotland. The thesis evaluates the most probable scenarios in both cases and the consequent impact of such subjective secession of the regions on citizens and their rights in the EU context, in particular the free movement of persons. The main objective of this work is to analyse the system of recognition of professional qualifications within the EU as a tool to access and pursue a certain profession. It is an important condition for the realization of one of the fundamental EU freedoms, which is free movement of labour. Regardless of the adoption of the Professional Qualifications Directive in 2005, the area of recognition of professional qualifications has quite a long history in the EU. From a legal point of view this legislation is important because it provides the functionality of the free movement of labour. Mobility of qualified professionals in the European Union is still at a relatively low level. To some extent, these skills shortages could be filled by people with professional qualifications obtained outside the EU, who however currently face major problems in having their qualifications recognized. To take full advantage of the freedom of movement, their qualifications must be easily recognized in other Member States. It is therefore essential that the Professional Qualifications Directive sets out clear and simple rules for the recognition of professional qualifications. Right of entry and residence on the territory of member states of the European Union

This thesis deals with analysis of EU rules on entry and residence on the territory of Member States. These rules are described from the perspective of different groups of people, EU citizens, citizens of EFTA Member States, family members or citizens of Turkey, and also from the perspective of Member States participating in the Schengen Border Area and Member States outside this Area. The core of this thesis consist is the analysis of four key EU rules in this field, namely the Border Code (Regulation 562/2002), the Visa Code (Regulation 810/2009), the 539/2001 Regulation and the 2004/38 Directive, as well as relevant case law of the Court of Justice, that influences the interpretation of the rules in hand significantly. The rules are also assessed from the point of view of principles of legal certainty and legitimacy.

English summary The status of migrants in the social sphere The aim of the work is to identify and describe the position of two groups of European citizens, a worker and a student, migrating over Europe and exercising their rights. On one hand, there is still some discrimination against the EU citizens, and on the other hand, there is some criticism of the ECJ for its excessive benevolence in decision making. The social area stated in the name of the work is intended not only as the area of social security and labour law, but also as the area of access to education and meeting of the cultural needs of people. The thesis is divided into two parts, general and special. Two introductory chapters comprising the general part of the work are devoted to defining of the terms free movement of persons and the European social rights, and their historical development across the primary legislation. The author notices also the historical circumstances and reasons why the developments lead this way. The relevant present legal regulations in the secondary law are analysed in detail and a possible vision for the future of the EU is introduced. The right of free movement and residence of third country national family members of the European Union citizens - Free movement of persons - Abstract This dissertation is focused on the acquisition of the immigration status by the third country nationals on the basis of their family relationship with the EU citizens under the Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States. The particular attention is paid mainly on the acquisition of this immigration status by these family members, who are registered partners or cohabiters of the EU citizens in these Member States that do not recognize the registered partnership in their domestic laws. The difference in attitude of the Member States to the registered partnership is illustrated on the example of the implementation of this Directive into the domestic law of the Czech Republic and Slovakia.

English summary Free movement of persons from the perspective of health insurance coordination of migrants in the countries of EU The aim of this thesis is to render an integrated commentary of basic rights, which are granted by European Union to its citizens in the field of health care, mainly through coordination regulations. It concentrates on specific situations when people travel to different member states, temporarily or permanently, and their opportunities of access to the health care system in a different state than the competent state. Furthermore, it follows with systems which are used by member states between themselves to provide effective realization of these rights and the interpretation of relevant provisions of coordination regulations by the Court of Justice of the European Union. The thesis is thematically divided into three parts, whereas the first introductory part contains three chapters concerning basic terminology and explaining terms related with health insurance in the EU such as social policy, social law and social rights, free movement of persons, social security and finally health insurance and health care.
