Judical reform in Czechoslovakia 1948 - 1953

This work is introducing the processes which undergone in the Czechoslovak Justice during period of years 1948 and 1953. These processes resulted in complex change of the entire legal system in Czechoslovakia (CS). Newly established communist regime managed to build tight grip on power during the analyzed period of time. Changes of the justice, legal education and advocacy was analyzed by many excellent Czechoslovak scholars from area of law and contemporary history but their free publication was enabled after the fall of the communist regime in 1989. Important part of this work is analysis of the vital laws which was introduced during above mentioned period. First chapter is about important politician Alexej Cepicka, who was an architect of the whole judicial reform. Understanding of his role in the transformation of the society is necessary to understand the historical events. The second chapter focuses on the whole process of purification the society through mass organizations loyal to the communists and attempts to annihilate of the Catholic Church. RESUMÉ THE PERFORMANCE OF A LEGAL PROFESSION (THE BAR) IN THE CZECH REPUBLIC AND IN BELARUS The aim of this thesis is to characterize the practice of law in the Czech Republic and Belarus. This theme was chosen because of the comparison of advocacy in both countries and also because of the limited number of literature sources about law practices and advocacy organization in Belarus, to at least briefly cover the operation of this Institute from the very beginning. Czech Republic and Belarus are democratic countries. Czech Republic is a parliamentary form of government. According to the Constitution of the Republic of Belarus (1994) it is a presidential republic, with strong centralization of legislative, executive and judicial power in the hands of the president, as evidenced by presidential decrees, which significantly affects the advocacy activities and organization in Belarus. A common feature of both countries is the nature of the mission of advocacy - providing skilled and professional legal assistance in accordance with the law; serving the principles of legality and justice. Money laundering is a dangerous activity. Funds that pass through this process become a source for a various criminal activities, such as terrrorism, corruption, etc. The thesis is composed of three main parts. First part deal with methods and stages of money laundering. Money laundering is a sophisticated activity, with a high degree of complexity, which requires a certain level of planning. entertain various features and steps which are necessary to clear the funds. Professional ethics in legal practice Key words: ETHICS, ADVOCACY, PROFESSIONAL ETHICS The primary subject of my diploma thesis is professional ethics related to carrying out advocacy in the Czech Republic and institutions related to the ethics of solicitors. The reason for my choice of the aforementioned subject is mainly my experience in a legal office, where I have encountered many positive and negative approaches to carrying out this profession, and also the public's interest in the ethics of advocacy, which is growing concurrently with the rising needs of citizens to use services by legal consultants and representatives. In the first chapter of my work I describe the key terms (ethics, morals, law), definition of which is fundamental for understanding the issue of professional ethics and I also outline the mutual relations between these terms. In the second chapter I briefly present the short but varied history of advocacy in the Czech Republic, which began in the 12th Century. The third chapter focuses on definition of the institute of professional ethics. This diploma work deals with marketing utilization in service sektor, concrete in legal profession. The objective was to make analysis of marketing assertion in legal office. On the basis of suitable methods was followed and evaluated actual posture of marketing literacy in legal office. Result of practical analyses was definition of barriers, handicaps, reserves and opportunities at marketing utilization in legal office. Theoretical part features information about marketing in service sektor, shows in legal profession domain and gets acquainted with used methods. Practical part analyses contemporary state in legal office. By means of suitable methods is drafted the measure, how to eliminate barriers, handicaps and reserves and to take advantage of opportunities.

Arts Advocacy

Arts advocacy, called a defence of culture and arts, is an unknown area for many people in Czech Republic. Almost no one thinks about it on a theoretical level, so it still remains mainly a foreign domain. Master thesis summarizes and in detail describes this essential area of every culture organization in the theory. It discuss some of the selected methods of arts advocacy and sources of their argumentation: an awareness of own usefulness as an advocacy basis, economical benefits of a culture as an advocacy argumentation source, contact with elected representatives, coalition building and community involvement as a cultural advocate. In addition, thesis also provides several examples of good practice from abroad. Based on the acquired knowledge, the thesis reflects the state of the arts and culture advocacy in our country.

Cooperation between law firm and the bank

The aim of bachelor thesis is to describe the partnership of law firm with bank, the differences due to the specific line of business, and finally follow the development of cooperation in time. The first part is an entry to introduction of law firm and clarification which bank is currently main bank provider. In the second section are characterized products used for regular payments, described the development of their terms from beginning of the cooperation to present and created the review of costs and incomes from this cooperation. The third chapter focuses on the familiarization with special products which is used in connection to the legal profession, and specifies who pay associated charges. The fourth chapter compares the conditions actually used products with offers of two competing banks, monitors the negotiation about these conditions and the subsequent decision to change bank provider. The fifth chapter is dedicated to the change of the bank, and what advantages and disadvantages this change brought.

Poslední část práce řeší konstrukci marketingového mixu vhodného pro oblast advokacie na základě získaných informací.

Způsob výkonu advokacie v ČR

Práce obsahuje popis a analýzu nejdůležitějších prvků výkonu advokacie v ČR, stejně jako analýzu různých forem výkonu advokacie, které zákon o advokacii umožňuje. V jejím rámci jsou analyzovány vybrané prvky obchodních společností a sdružení, je brán také ohled na nové formy, zavedené novelou, účinnou od 1.dubna 2006. Práce je koncipována dle časového sledu, umožňuje tedy porovnání úpravy výkonu advokacie před novelou a po ní.
