Identifying obscured employment or: How to avert the associated risks Summary The thesis explores the issue of obscured employment and obscured agency employment. Its roots are in practical experience and real needs of actual subjects. In practice, the issue of obscured employment and obscured agency employment is particularly important in relation to outsourcing of one's business activities to another person. However, the current legal regulation is not perfectly clear when it comes to definition of these two legal problems and their identification in practice. This is true especially in relation to the issue of obscured employment. Thus, the goal of this thesis is to identify the elements defining obscured employment and obscured agency employment. Added value of this thesis is then introduction of possible ways of how to organize an outsourcing relationship so that the relevant authorities do not assess such relationship to be obscured employment or obscured agency employment. In other words, how to avert the risks associated with obscured employment and obscured agency employment. This follows straight from the defining elements of these two legal issues identified in the thesis. The topic of this rigorous thesis is agency employment. Agency employment constitutes now a common part of the market with employment services and enables employment agencies to temporarily assign their employees to perform work at users. The thesis defines the concept of agency employment and describes its roles and functions which are typical for agency employment. One of the biggest user benefits of agency employment is the possibility of quick and effective workforce procurement for a wide range of different professions. The thesis contains a definition of agency employment at both the international and EU level. The thesis also presents international legal sources of agency employment adopted at the UN, EU legal sources of agency employment and legal sources of agency employment under the Czech legal order. The thesis also contains a description of Czech public law, which sets out some conditions for the activity of employment agencies, as well as other obligations imposed on employment agencies. 1 Agency employment with a cross-border element Abstract The topic of this diploma thesis is agency employment with a cross-border element. Employment agencies cover the shortage of workers on the Czech labor market by assigning foreigners to users. The thesis analyzes this process of agency employment of foreigners, by connecting the institutes of agency employment and employment of foreigners. In its introductory chapter, this thesis briefly describes and analyzes the institute of agency employment, focusing primarily on the requirements necessary to obtain a permission for agency employment and on comparable working and wage conditions. Furthermore, this work deals with the cross-border element of agency employment, where the second chapter analyzes in detail the process of agency employment of foreigners, both citizens of other Member States of the European Union and especially foreigners from third countries. Based on this analysis, the content of the second chapter is also a comparison of the legal status of Czech nationals, citizens from other Member States of the European Union and foreigners from third countries in the framework of agency employment. This bachelor's thesis addresses the issue of labor relations in terms of optimizing labor costs. The theoretical part explains the fundamentals of labor relations in legal, economic, accounting and tax concepts. The analytical part focuses on a specific problem of an employer with understaffing issues. Based on the acquired knowledge in the theoretical and analytical parts, employers are presented with recommendations so they may solve the defined problem.
Corporate Culture of the Job Agency and Proposals for Its Improvement

The diploma thesis deals with the corporate culture of a selected job agency and its values. The theoretical part is based on the studied literature to explain the issue of agency employment, human resources and corporate culture as a factor that affects the efficiency and performance of the organization. The practical part analyzes the responses of the company's core employees from conducted semi-structured interviews. This feedback about the corporate culture and its perception by the employees themselves compared to management's expectations provides suggestions for improving the in-house climate and thus increasing labor productivity.
Working conditions of agency workers in the Czech Republic

This bachelor thesis deals with the examination of working conditions of agency workers among foreigners in the Czech Republic. The thesis aims to describe the legal setting of agency employment, especially in terms of participants in contractual relations, their rights and obligations. It also identifies ways of circumventing the current legislation by work agencies and describes the consequences of this circumvention on employees. It also deals with how the agency workers themselves perceive their working conditions, concerning the work agency and the company to which they are temporarily assigned. Qualitative research is focused on foreigners in the labor market. Foreigners are a disadvantaged group in the labor market because they often do not know their rights and obligations, which employers can use to their advantage. The issue is viewed from the perspective of flexibility and precarization in the labor market. Flexibility, as one of the new trends in the labor market, brings many opportunities, but it has different effects on different types of employees. While it offers a greater degree of personal freedom for better-off workers, for employees in low-income occupations, flexibility is often associated with a high degree of job insecurity and limited social protection for employees.

Thesis Title: Occupational Health and Safety with Focus on Atypical Forms of Employment The thesis aims to analyse and present the rules of occupational health and safety (OHS). The second goal of the thesis is the research of OHS solutions in atypical forms of employments with regard to current development of working relationships. The thesis also deals with the question of atypical forms of employment and the ensuring of OHS in Germany (GER). The collected information is used for comparison and evaluation of both countries and their attitudes toward OHS in atypical forms of employment. Part of the thesis is also devoted to possible course of OHS in the atypical forms of employment de lege ferenda including potential inspiration from GER in connection with ensuring of OHS. The thesis is mainly based on study of laws, relevant literature, comments and current articles. In the thesis, the descriptive and analytical method are used and at the end supplemented by the comparative one. Agency Employment Abstract My diploma thesis is focused on the agency employment. The institute of agency employment was integrated to our system of the legal regulations in 2004 and nowadays it is a very popular alternative of traditional employment. Employers perceived it as an institute that enables them to react quickly and effectively to the changes which take place on the labour market and therefore gain the needed employees in the right time. I decided to write about this topic mainly because agency employment is very interesting issue with great business opportunities, but unfortunately the Czech regulation isn't as complex and clear as it could be. Therefore, I find this topic quite intriguing. The thesis is divided into introduction, conclusion and six more chapters. First chapter introduces the term and origin of the institute of agency employment within the Czech system of legal regulations. Next chapter focuses on the legal regulation of agency employment. Employment agencies and agency employment Abstract The topic of this thesis are employment agencies and agency employment. Employment agencies play an important role in the labor market. Their activities involve finding a job for individuals, finding employees for employers, providing advisory services and information services and, of course, the institute referred to as agency employment. Agency employment was incorporated into the Czech law in 2004. The text of this thesis is divided into five chapters. The first chapter is focused on the definition of basic terms related to agency employment and also on the definition of individual entities involved in the agency employment process. The second chapter is devoted to the topic of the development of legal regulation of agency employment. The attention is focused on the development of international law. The third chapter is focused on the employment agencies themselves. The penultimate chapter describes the mutual legal relations that arise between the various entities involved in the agency employment process.
