This bachelor thesis deals with shared custody as a post-divorce form of parenting. It discloses the most important legislation governing shared custody as well as the child's interest and the relationships between parents and children. The theoretical part provides the legal definition of divorce and shared custody. It examines the factors that influence the court's decision on shared custody and provides information on the development of the findings made by the Constitutional Court regarding shared custody. The influence of shared custody on the child's school success in primary school

The topic of this diploma thesis is the influence of joint custody on school successfulness of a child. In the theoretical part I describe a contemporary family and major functions of the family. I chart the situation of legislation in the Czech Republic, I deal with circumstances how the Czech courts make a decision about commiting children into parental care after a divorce of their parents and whether the number of children being involved in joint custody increases. I am really interested in the fact whether the courts make a decision based on the child needs. Following this part I focus on the definition of school successfulness of children and the behaviour of younger learners. I indicate the factors that could have an influence on school successfulness. In the practical part I present the results of my qualitative research. I explore the influence of joint custody into child school successfulness from the point of view of class teachers. I survey the behaviour of children who live in joint custody after the divorce of parents and I also take an interest into the fact whether the class teacher have noticed any features that could connect these children.
View of the Social Workers of the Department of Social and Legal Protection of Children of Central Bohemian Region on the Issue of Placing a Child in Institutional Care

The bachelor work is concerned with the placement of a child in institutional care. The theoretical part decribs the concept of dilemma, division dilemmas, manging dilemmas, dilemma intervence-not intervence and the related decisions, measures child protection and the possibility of solving social workers, within the family and in the case, where a child is at risk. The practical part of the qualitative research in the form of semi- structures interview answers the main research question which is: What procedures apply social workers awithin the dilemma intervence-not intervence? The relationship of parents to minors with regard to the specifics of domestic violence

The dissertation thesis "Relationship of parents to minors with regard to the specifics of domestic violence" focuses in particular on judicial proceedings in cases of custody of minors where family relationships are affected by domestic violence. It attempts to explain why it is necessary for the courts to take into account this fact and to adopt such measures within their decisions to provide sufficient protection to persons at risk and at the same time to stop violent behaviour. Domestic violence as a dangerous social phenomenon is described in detail; information on its individual appearances and forms is brought; briefly mentioned are also other scientific disciplines whose knowledge is important not only for the recourse of offenders and the protection of victims but also for creation of a strategy of effective prevention. Negative impacts on mental state of minors are stressed, who must be viewed in all cases of domestic violence as its victims, i.e. also when the violent behaviour is not immediately directed against them. The thesis brings interpretation of the current legislation with reference to the most important changes in the legislation in the last decade. Mediation in Family law disputes.

The purpose of my thesis called Mediation in Family law disputes is to analyse benefits between mediation process and judicial proceedings and also point out to references of mediation usage in foreign countries. Another motivation to select this thesis subject is new Act n. 202/2012 Collection of Laws., about mediation. This thesis is divided into eight chapters. Opening chapter is focused on family basic function, especially society influence on family as a basic social unit. The further analysis describes bound of marriage from historical point of view, basic principles of Family law and specific position of Family law subjects. Second chapter defines term conflict, treats of conflict description based on main characteristics. Further analyze is about ways how to resolve conflicts and their justification to have minimum impact on relationships. At the conclusion of this chapter are described conflict mutual influence, communication and mediation. Third chapter deals with basic mediation aspects, description of basic mediation term, historical evolution from ancient time to the present days and shows different characters between mediation and judicial settlement. Adoption as a substitute form of family

1 Abstract The presented thesis with the title of the "Adoption as a substitute form of family" deals with most ideal form of surrogate parental care, the adoption. The introductory chapter captures history of the institute, its gradual development and changes in the understanding of its meaning and significance. The following chapters are devoted to actual legal regulations of this institute. The last chapter deals with future situation, which is currently the most actual. In this last part of my thesis trying a critical evaluation of actual legal regulations and its comparison with future legal regulations. With planned recodification also related penultimate chapter of the work, where actual legal provisions regarding an adpoption in Czech republic are compared with the corresponding provisions in the Federal republic of Germany. One of the reason why I have included this chapter in this work is fact, that legislation of Federal republic of Germany was one of the patterns for our upcomig private code. The real goal and purpose of this thesis is mainly an effort, by the case law and real stories, to reveal and bring to a wider public awareness of illegal practices, to which the children are learning and which the most suffers just adopted children. Families at risk of social failure in the region of Karlovy Vary

This thesis is focusing on families at risk of social failure in the Region of Karlovy Vary. The aims of this work are outlining social situation in the Region of Karlovy Vary, mapping network of social service for families at risk of social failure and finding out the most frequent problems these families are struggle with. Outputs are the recommendations for SOS Children's Villages in Doubí in Karlovy Vary based on above presented findings that tells which services for families at risk would be advisable to set up. In theoretical part of final thesis is defined the concept of family at risk and then based on foreign experiences are cited the principles of how to work with these families. Practical part is build on study of feasibility realizes by SOS Children's Villages Association, which was finding out neediness of social services for families at risk and children in the Region of Karlovy Vary, where this organization is considering realization of programs for family support.
Ethics as a normative standard in European Asylum Policy: case study of unaccompanied minors

This bachelor thesis focuses on European asylum policy with the attention to unaccompanied minors. The aim is to find out on which principales the Common europen asylum system is based, how and whereas the specific situation of the unaccompanied minors is taken into consideration and where are the weaknesses while implementing the system into reality. The first theoretical chapter summarizes theoretical basis of ethics and regarding the relation ethics and migration. The second chapter is devoted to prncipales of asylum policy and its implemention into European common asylum system. The third chapter analyzes the realization of policiy through cases studies, especially in Hungary and Sweden.
Substitute Family Care in the Czech Republic

The bachelor thesis deals with the issue of substitute family care in the Czech Republic. This thesis is divided into theoretical and practical part. The first chapter of the theoretical part is concerned with a historical overview; it focuses especially on the Roman private law. The second chapter provides a brief explanation of basic terms. Foremost the relationship between parents and children is defined. In the third chapter, substitute family care is mentioned and mainly adoption, which is the most ideal form of substitute family care, is discussed. To make a comparison, I also mention foster care and institutional education. The practical part consists of three topisc. Firstly, an analysis of the survey, secondly an analysis of an interview with a social worker and finally there is a comparison of the two institutions - Klokánek v Janovicích nad Úhlavou and Dětský domov Staňkov.
