Innominate Contracts in Business Relations
Horčicová, Iva ; Kotoučová, Jiřina (advisor) ; Švarc, Zbyněk (referee)
Diploma thesis Innominate Contracts in Business Relations deals with a legal basis of innominate contracts in the Czech private law. It focuses mainly on so the called Modern innominate contracts. The purpose of the thesis was to answer whether leasing, factoring and franchising contracts should be codified. Consequently, it aimed to prove or disprove that the Czech legal regulation does not reflect the recent developments in business environment. The thesis is divided into two parts. In the first chapter an analysis is carried out on the legal regulation of innominate contracts in the Czech business law, civil law, labour law and international private law. The legality of innominate contracts and the applicability of an analogy is discussed in this part. Based on the Czech legal regulations and court decisions it was concluded that innominate contracts were valid and that courts may use analogy when deciding on civil or commercial contracts. The second chapter deals with the contents of leasing, factoring and franchising contracts. It concludes that there are reasons against the codification of the above mentioned contracts. The content of an operating leasing agreement very much resembles a rental contract which might be used for this kind of leasing contract.A leasing purchase contract does not present any new answers to issues which had already been dealt with by court decisions. The substance of a factoring contract -- assignment of a receivable is already regulated by the Civil Code. A franchising agreement involves parts of many types of codified contracts and interlocks with multiple legal areas. Moreover, all the above mentioned contracts are challenged by a fast pace of development therefore a codification could hamper the progress or it could become obsolete. Based on the above mentioned facts the thesis concludes that leasing, factoring and franchising contracts should not be codified in the Czech private law as separate contract types and therefore disproves the primary proposition of this thesis and subsequently infers that the Czech legal regulations do not reflect a recent business development.

Theoretical background of empirical part is formed by theories of present time analysts which highlight the variability and instability of social conditions. The result of this instability is that there are shifts of the timing of life events in the life cycles and challenging the traditional definition of adulthood as defined for example, independent living and marriage. Trends in the life of young students, such as prolonged studies or leaving home parents in late time point to a new stage, which haven't been in the life paths of previous generations. Levrincová, Petra ; Kučera, Rudolf (advisor) ; Ondřej, Jan (referee) ; Fremr, Robert (referee)
The dissertation "Did It Really Happen? Testimonies before The International Criminal Tribunals and in Refugee Status Determination" promotes the creation of guidelines for the fair and consistent assessment of evidence in refugee status determination. The correct interpretation and effective application of these principles can reinforce local as well as global trust in the international refugee protection regime. The framework in which witness testimonies are assessed before the two ad hoc international criminal Tribunals - the International Criminal Tribunal for the Former Yugoslavia, and the International Criminal Tribunal for Rwanda - appears to be the most relevant for refugee cases. The judgements issued by Trial Chambers often include a coherent and logical description of how they work with and interpret rules on evidence, and their approach is generally approved by the Appeals Chamber. In addition to providing a background to the aforementioned Tribunals, and briefly outlining the main aspects of evidentiary practice before them, this work describes the refugee status determination procedure - highlighting selected challenges decision makers face with respect to evidentiary practice - and presents the features that international criminal trials and refugee status determination procedure have in...

Vejbor, Jan ; Rovná, Lenka (advisor) ; Chatard, Benoit (referee)
The diploma thesis "Creative Destruction Within The Automotive and Energy Industry - Sustainable Electric Mobility As a Political And Economic Challenge for the EU" deals with the issue of the impacts on the political and economic area caused by technological innovations. The subject of the study is the personal motorised transport with its key elements: automotive industry, oil industry, energy industry and state administration. The goal is to introduce the reader the development of the personal motorised transport as a concept of "major innovation" of the Joseph Schumpeter's economic theory. The binding of the two innovations of (a) automobiles propelled by internal combustion engines with (b) the refined crude oil products gave way to a new economic cycle. The integral part of every economic cycle represents the "creative destruction", i.e. the fall of old structures and the rise of new ones. In the domain of personal transport, automobiles devoured not only the animal propelled transportation, but the successfully expanding market of electric vehicles, too. Mainly due to the ecological and supply problems of the fossil fuels, electric vehicles cars are currently witnessing a period of a strong publicity and technological success. Nevertheless, their accession on the market and hence a new economic cycle...

Departure from Faith and Return to the Church
PAULÍKOVÁ, Zuzana
The work investigates the education in family, the departure from faith and return to the Church and faith. It is a research work. The first part deals with the preparation for a qualitative dialogue and for the choice of appropriate respondents. It describes the process of respondents collection, the process of dialogue and their recording. The case analysis occupies with the respondents´ characteristics. The second part of the work is interested in the analysis of the dialogue, the comparative analysis and therefore the dialogue evaluation. We get to know how the respondents were guided and lead to faith in their families, when and why they departed from faith, what events and moments in their lives had a bearing on their faith experience, when they returned to the Church, what people influenced their religion development and how they live in Church now. We find out that particular spheres are dependent one on another. It is very important how strong is the faith basis, how deep you sowed the faith and how you kept the seed. We can also see a diference in feeling the faith at each respondent since people are different. The human personality is very important as well as your opening to the Grace of God. The role of people we meet is very important, too. We are influenced by them. It is a kind of a call not only for people in pastoral work but also for believers themselves so that they can try to help and be here for others.

Ceramic altarpiece
KVAPILOVÁ, Petra
The dissertation contains both practical and theoretical part. I deal with history and conception of the church in which the altarpiece will be adjusted in theoretical part. Furthermore, I allude to all proprieties that are associated with person of Saint Prokop - his life, studies, education and miracles which got him to awareness of the public. I describe the Dalej cave near Prague where he lived in, I make reference to extanted re-lics and I am also engaged in a fate of St. Prokop{\crq}s remains. I am showing up the moti-vation resources, iconography of the Saint and I am describing the technologic procedu-re of work. I attach the most original proposals of altarpiece to the practical part and also the photographs produced during altarpiece creation. First of all I am separately solving zoomorphic character of devil in which I am searching the right expression and repre-sentation of evil. Next I am studying anatomically the statue of the Saint and I am trying to find a move in which I want to capture him to get the dynamic and thrilling scene. Finally I propose the disposition which has a diagonal character. I am making the potte-ry relief that is realized as a set of glazed tiles adjusted on wooden plate in the same size as the original altarpiece was. The last part of dissertaion contains the photomontage of positioning in the sacral space of the church.
