Private enforcement of competition law

The purpose of my thesis is to analyse the state of private enforcement of competition law in the European Union and the Czech Republic by taking into consideration the proposals set forth in the Green and White Paper on damages actions for breach of EC antitrust rules issued by the European Commission which were inspired by the U.S. system of private enforcement of antitrust law. Further on, the possible impact of the implementation of such proposals into Czech law will be assessed and experience of Member states will be considered. The dynamic development of this area of law and the never ending political and legal debate on the possibilities of private enforcement in Europe was the reason for why I have chosen to write my thesis on this topic. The thesis is composed of eight chapters, each of them dealing with different aspects of private enforcement of competition law. Chapter One is introductory and is divided into three parts. Part one tackles the difference between public and private enforcement. Part two deals with the evolution of the concept of damages claims and introduces the most relevant decisions of the Court of Justice of the European Union. Mutual duty between parents and children to support and maintain in theory and practice

Maintenance between parents and children Resumé My thesis deals with the mutual maintenance of parents and children in theory and in practice and the thesis consists of ten chapters. The topic of alimony is a very current topic. Our society is constantly changing and its relations in the families as well. The families which are functioning decrease so the needed family members have to seek for their rights. Each of us is a parent or a child, so this topic affects all of us. The first chapter defines the basic concepts of my thesis, such as the concept of maintenance obligations, the differences between different types of maintenance obligations, the definition of subjects of maintenance obligations and the differences between the Czech and the International legal system. The final part of the first chapter discusses the new regulations of maintenance obligations, which will come into effect with new Civil Code. The main chapters focus on alimony obligation of parents to children and on alimony obligation of children to parents. I discuss the basic concepts and I define them. CIRCADIAN GENES AND REGULATION OF DIAPAUSE IN INSECT

This thesis considers various roles of circadian clock genes in insect physiology. Application of molecular-biology methods in Pyrrhocoris apterus, non-model insect species, enable us to investigate involvement of circadian clock genes in photoperiod induced physiological responses. We discover involvement of neuroendocrine cells, and a role of Juvenile hormone (JH) signalization in transduction of photoperiodic signalization to peripheral tissues. We found new principles of JH signal diversification in tissue specific manner, and in addition described molecular mechanism of photoperiod induced changes in gut physiology. Comparison of gut and fat body tissue reveals that mechanism observed in the gut is tissue specific, and that circadian clock genes exhibit tissue specific functional pleiotropic effect.

Basic principles of public administration activities in theory and practice

Bachelor thesis represents set of basic principles activities of public authorities and their practical application. The theoretical part is focused on general information about public administration and its activities, further to the description of the basic principles activity of administrative authorities and also to administrative justice. The above information was drawn from literature, articles or case law and served as a basis for research. The practical part describes the application of the principle of legislative expectations administrations in practice and outlined on the selected decision of the Supreme Administrative Court. Further evaluation questionnaire survey concerning the application of the basic principles of the five selected regional authorities (employment office, district social security administration, land registry office and the tax office) from the perspective of clients and officials.

Digitální restaurace nástěnných maleb

In this thesis we present the application of digital image processing algorithms for the process of fresco restoration such as image registration, image fusion, and image segmentation. We have worked with images of various modalities (visual and ultraviolet spectra) and at different times. Moreover, during the image analysis we also have taken the local chemical analysis into account. The robustness of proposed algorithms is required to be high with respect to the bad state of the fresco. The achieved results provide a better insight into the evolution of the fresco aging to the art conservators and show the way how a proper conservation method can be chosen. All developed methods are illustrated by generated output images.

Design of defibrillator

This master’s thesis deals with design of defibrillator. It is a medical device for restoration of proper heart rhythm. The proposal respects the current production, but should draw their own concepts. The actual solution consisting in a combination of manual and fully automatic defibrillator. Applicability should include a wide range of expertise. The proposal is completely prepared in compliance with all aspects of construction of defibrillator.

Did it really happen? : testimonies before the international criminal tribunals and in refugee status determination

The dissertation "Did It Really Happen? Testimonies before The International Criminal Tribunals and in Refugee Status Determination" promotes the creation of guidelines for the fair and consistent assessment of evidence in refugee status determination. The correct interpretation and effective application of these principles can reinforce local as well as global trust in the international refugee protection regime. The framework in which witness testimonies are assessed before the two ad hoc international criminal Tribunals - the International Criminal Tribunal for the Former Yugoslavia, and the International Criminal Tribunal for Rwanda - appears to be the most relevant for refugee cases. The judgements issued by Trial Chambers often include a coherent and logical description of how they work with and interpret rules on evidence, and their approach is generally approved by the Appeals Chamber. The status of an injured person in a criminal proceeding

163 SUMMARY This work is focussed on the status of an injured person by a criminal activity in Czech criminal proceeding. It tries to give a coherent view to this topic in the conditions of the Czech criminal law when it takes its bearings on contemporary valid legislation, to mention its weak points and suggest the solution. After the introduction which is also engaged in main objectives of this work and also the reason why the author of this work has chosen this topic, the author firstly defines the conception of the injured person and also the victim of a crime which are not, according to her opinion, the same. The separate chapter is dedicated to the problem of secondary victimization of the injured and the victims of crimes. The secondary victimization prevention also reflects in international documents of international organizations which are mentioned in this chapter too. As it has been said above, the main substance of this work is an analysis of the status of an injured by a criminal activity in Czech criminal proceeding. The main part of this work is shaped by a description of particular rights of the injured during the criminal proceedings which are legally berthed in Czech Criminal Code. Implementation of European legislation into the legal order of the Czech Republic

AAAAbstractbstractbstractbstract The main purpose of my thesis is to analyse how Czech legal order deals with the obligation to implement European legislation, and also, how it is affected by the process of implementation. The thesis consists of two major parts. Part One describes the European law system from the point of view of its effects on a national law; the direct effect as well as the obligation to implement the EU law into national legal acts are considered. Part Two is divided into six chapters; each chapter deals with a different aspect of Czech obligation to implement and apply the EU law. Czech government is the main legislative initiator and has developed detailed rules for preparing government bills. However, the praxis is far from ideal. Both chambers of Czech Parliament are affected by serious lack of interest in the process of implementation. The Constitutional court provides a constantly growing judicature of open-minded interpretation of the national law with respect to the EU law. On the other hand, it shows a surprising reluctance to refer for a preliminary ruling at the Court of Justice of the European Union. 141 10. SUMMARY The theme of this Rigorous is Selected Problems of the Criminal Statistics in the Czech Republic. This work follows up my Thesis "Criminal Statistics in the Czech Republic and possibilities of its improvement" of May 2008. In the introduction I present the theme of the criminal statistics and the targets of my Rigorous. In the second chapter described are basic problems of criminality, the difference between the latent and registered criminality and also the subject, value and application of the criminal statistics. The subsequent chapter deals with the system of the criminal statistics and with the current state of this system kept by the police and the judiciary. This chapter is mainly concerned with the description of the legislative basis of the criminal statistics, manner of organization and processing of criminal statistical data. The fourth chapter concerns the pieces of knowledge from the development of electronization of police's system up to now and with the significant changes which happened in 2008 and 2009.
