Euthanasia and its legislation

The aim of this thesis is the analysis of domestic legislation affecting euthanasia and analysis of such adjustments abroad. The author questions the appropriateness of such adjustments in the Czech Republic. The current legal regulation does not regulate euthanasia in any way, and so the adoption of such regulation is appropriate. Domestic experts criticize this fact for a long time. In the first part the author deals with the most comprehensive definition of the subject of euthanasia and its development abroad and, particularly, in the Czech Republic. Other parts, using the historical-empirical methods, deal with the legal arrangements and their analysis in the Benelux countries, where the euthanasia is legal under certain given conditions. They describe not only the current treatment, but also the path that led to it. In the last section the author assesses the non-legal aspects of euthanasia and outlines two basic directions, which the domestic legislation could take in the future.

The aim of my thesis is to unify the total view of the issue of euthanasia and assisted suicide with an emphasis on the criminal law. I am not trying to concluded whether legalize euthanasia in the Czech legal system or not, I just would like to outline the posibilities of the legal regulation in the Czech Republic in the future, after providing the analysis of the countries where euthanasia has happened legal in the last few years. My thesis is divided into eight chapters. At the beginning I try to give a detailed description of the substance of euthanasia and other related terms as assisted suicide, do not resuscitate and then I state usual forms and divisions of euthanasia. Then I deal with the history of euthanasia in the world because for understanding and clarification it is necessary. The next chapter is already about euthanasia in Czech Republic, where euthanasia has never been legalised but there were some efforts in some forms to do that. In this part I deal with a legal qualification of killing on request and assisted suicide de lege lata and de lege ferenda. Addressing the complex issue of euthanasia in Uwe Timm's novel Ikarien. The birth of racial hygiene out of the spirit of utopian ideals

Presented Master's thesis deals with euthanasia in the novel "Ikarien" by German author Uwe Timm. The thesis highlights development of its main character Alfred Ploetz, an originator of so-called racial hygiene (German variation of eugenics). Ploetz supported the idea of performing euthanasia on severely disabled people. This was applied at massive scale in Nazi Germany from 1939 to 1945. One of the goals of this thesis is to analyze the connection between utopian notions about the creation of a new man, eugenics and euthanasia performed by Nazis, which is reflected in the life of Alfred Ploetz. Furthermore, the thesis aims to give analysis of literary means used for capturing subject matter and compare factual and fictional parts of this historical novel. Euthanasia and the Criminal Law

The goal of this thesis is to point out the weaknesses of the current terminology of euthanasia and get a closer look on the role of the euthanasia in the Czech legal system with the main focus on criminal law. The secondary goal is to evaluate de lege ferenda legislation. To address this issue comparison of Czech and foreign legislation was included. The analysis leads to conclusion that the term euthanasia needs to be correctly defined to be usable in academic discussion. The definition needs to include differentiation from other conducts that are called euthanasia by the general public even though they cannot be classified as euthanasia by law. The main conclusion of the thesis is that legislation of euthanasia is not a right way forward in the Czech Republic. Nevertheless the Czech legislation should include criminal act of "killing upon request". Alternative to euthanasia should be improvement of palliative care and application of the institute of living will in practice. All future solutions of this controversial issue have to be based on comprehensive and diverse discussion amongst both the public and the legal experts.

In this thesis, I examined the definition of euthanasia and its different forms, as well as the legal evolution of this term and its constitutional foundations in the Czech Republic. Furthermore, I focused on the legislative treatment of euthanasia in the Czech criminal law, and compared it to the legislative treatment of euthanasia in Australia, Colombia, and England. In every individual state, I tried to capture the most important moments concerning the legal regulation of euthanasia and assisted suicide. In Australia, I focused mainly on the very first legal regulation of euthanasia, in Colombia, progression of an application of the Constitutional Court judgment on active euthanasia and in England, the evolution of relevant case law, usually related to assisted suicide. The most detailed explanation, of course, focuses on the Czech Republic. In my analysis, I used a variety of Czech and foreign legal sources, including modern sources such as video conferencing. By comparing the approaches, I provided a general overview of differentiation of euthanasia and its potential criminal impact. Request for termination of life in Benelux countries from the perspective of civil law The master's thesis is about euthanasia which is known as one of the most controversial and discussed topic in the world of law and medicine, especially termination of life on request. The aim of this work is to innovatively interduce unique legislation of termination of life on request in Benelux countries from the perspective of civil law because I am convinced of its importance despite being overshadowed by the meaning of criminal perspective. In a first chapter the terminology, definition and theory dividing will be explained. The other terms which are connected with the things above are the content of this part as well. The human rights related to euthanasia are discussed in next part of this work. Benelux countries have their own euthanasia enactment - this is what third chapter is about. Right to live vs. unnatural termination of life

The aim of this thesis is to clarify the concept of the right to life in the legislative in the Czech Republic and in abroad with a comparison with its unnatural end, while abortion and euthanasia. This work is primarily devoted to law regulation of these institutes, but also covers other aspects such as religion, philosophy and science. It is designed so that each and every chapter is in its introductory section devoted to the formulation of the topic, the historical development in the Czech Republic but also abroad, it introduces the possible procedures and attitudes, it mentions for example and briefly compares similar institutes. Other parts of the diploma deal with legislation whether the right to life, abortion or euthanasia, provides comparison of domestic legislation with internationals. In light of the judgments of the European Court of Human Rights points the views and attitudes on the subject at the international level. The final section is then evaluated core issues especially from the standpoint of law.

The aim of this Master's degree thesis is an overall assessment of the issue of euthanasia and a consideration of its possible legal regulation. In order to accomplish this aim it was necessary to carry out an analysis of foreign legislations of euthanasia. Furthermore, I have dealt in this thesis with the current status of euthanasia under the legal order of the Czech Republic with primary emphasis on criminal law. This thesis consists in total of four chapters. Chapter One deals with the most general matters of euthanasia, in particular with the matter of the term itself, usually determined forms and historical developments of attitudes towards euthanasia. Chapter Two compares foreign legislations of euthanasia and their impact on practice. Chapter Three clarifies the status of euthanasia in respect of the Czech legal order, in particular from the perspective of criminal law, in respect of recent legislative efforts for its legal regulation and considerations of possible future legal development. The last chapter deals with fundamental arguments of supporters and dissenters of euthanasia and provides its summarizing assessment. Criminal aspects of euthanasie in selected european countries

Euthanasia is nowadays hot topic not only in terms of societal impact but also in terms of criminal law. This work is devoted to the introduction of the concept of euthanasia, its history and various forms of euthanasia. There is also a view of supranational institutions and organizations to euthanasia. A substantial part of the work is devoted to euthanasia legislation in selected European countries and their analysis. Attention is also focused on the criminal aspect of euthanasia in these countries. One of the final chapters looks back on medially well-known cases, which stirred up a debate on euthanasia.
