NÁZEV DIPLOMOVÉ PRÁCE V ANGLICKÉM JAZYCE The Criminalization of Cyberattacks on Information Systems ABSTRACT This master thesis deals with the issue of criminalization of attacks on information systems. The topicality of the topic is supported by the rapid development of information and communication technologies and the shift of everyday activities to the virtual environment. Nowadays, cybercrime poses a growing danger not only to individuals but also to the state. The aim of this thesis is to introduce cyberattacks and to classify them criminally. Furthermore, attention is concentrated on the procedural aspect of attacks, in particular on their detection, investigation and the procedure of international cooperation. The transnational and international framework in the fight against cybercrime is not omitted. The thesis seeks to identify what problematic aspects domestic legislation faces and what future developments in the field of cybercrime can be expected. The introductory section explains the basic terms that are used extensively in the thesis. Subsequently, key international instruments in the fight against cybercrime are introduced. This bachelor thesis aims to analyse the DARKNET with focus on forensic research. This paper describes a variety of illegal actions which occur in the DARKNET and possible form of their forensic research. A forms of identification of the illegal actions, possibilities of their documentation and analysis of the identification of the perpetrator are suggested. By the suggested methodology is designed a cybercrime solution, which can be used by the authorities active in the criminal proceedings.

67 Criminal-law aspects and criminological aspects of ransomware spread Abstract The thesis deals with the ransomware spread and its exploration from the perspective of criminology and substantive criminal law. This theme is still relevant as ransomware is still a highly used form of cybercrime, whose method of execution is being constantly improved by the perpetrators. The theme is further relevant because this form of cybercrime is also used as a form of waging war against another state, as may be seen e.g. in the increasing number of cyber-attacks incurring in connection with the current war between Ukraine and Russia. The first part of this thesis defines the term ransomware and then briefly describes the history of this type of cybercrime. This part further describes the different types of ransomware currently recognized by the professional community. Current trends in the ransomware spread are also outlined. The second part discusses the criminological aspects of ransomware, focusing primarily on explaining the ransomware spread by the criminological theories, examining the personality of the perpetrator and the victim from a criminological perspective, and exploring other criminological aspects of ransomware. Cílem této bakalářské práce je zanalyzovat fenomén zvaný hacktivismus, jeho význam, dopady na společnost a motivaci jeho aktérů. Termín hacktivismus se skládá ze dvou následujících termínů; aktivismus, který bývá ve většině případů politicky motivovaný a hacking, jenž se jedná o kriminální činnost za účelem zneužití chyby nebo nedokonalosti výpočetního systému. Za účelem efektivního dosažení svého cíle, se aktéři hacktivismu, stejně jako jiní aktivisté, většinou organizují do skupin. Práce je též zaměřena na motivaci a následky konání těchto organizovaných skupin, zejména na skupinu s názvem Anonymous, s exemplárními příklady jejich akcí z minulosti.

This bachelor thesis deals with cybercrime in the European Union at present time. It begins with a description of the most well-known historical cybercrimes, which has helped to create cybercrime as a separate branch of crime. Subsequently, the work describes the changes that have occurred in the development of cybercrime, describes the practical problems in prosecuting cybercrime and its current trends. At the same time, it outlines the problems that arise in producing adequate statistics. The practical part of the work then describes the basic function of the application, which was created to work for the purpose of providing information on cybercrime and clear mediation of available statistical information.

Development of information technology is one of the most dynamic parts of today's global society. Along with the coming of new technologies it generates new types of crime, eventually existing types of criminal activities in this area are moving from the real world to cyberspace. This rapid development of cyber crime enforces corresponding changes in the legislation related to cyberspace. In the Czech Republic the most fundamental changes in cyber crime law have been made along with the new Criminal Code. The new code has modified some areas, that were not mentioned by previous criminal code, refined or amended previous terminology related to cyberspace and added institutes required by international commitments, especially by the Convention on Cybercrime. The purpose of this diploma thesis on "Cyber crime" is to outline the issues of cyber-crime, point out some troubling topics, which are currently present in cyberspace, and outline possible future development of criminal law in cyberspace. In the beginning of the thesis there is a short summary of cyberspace and cyber crime history, that is followed by definitions of selected basic concepts of cyberspace and cyber crime. Internet and computer criminality Summary This thesis, as its name indicates, deals with the problems of our times associated with computers and the Internet, which make it possible to commit all sorts of crimes. Computers are part of our daily life and the sphere of information and communication technologies are constantly and rapidly developing, which gives space to potential perpetrators to find new approaches. The thesis is composed of eight chapters. The opening chapter of this thesis describes the basic concepts related to computer and Internet criminality. It includes the definitions of computer criminality, cybercrime, cyberspace, as well as basic technical concepts such as computer, hardware or software. Approximation of this terminology is essential to understanding the issue. Next chapter is devoted to some illegal activities in cyberspace, which are then legally assessed. The third chapter forms the most important part of the whole thesis because it describes in details the issue of copyright violations in connection with computers. Security of Work with Electronic Data in Industrial Enterprises

The aim of this thesis is not only to characterise the key terms related to this field, but also to analyse the possible solutions to the area in a particular industrial enterprise in the Czech Republic by means of a case study which is a reliable method of qualitative research. The thesis is divided into theoretical and practical part. In the theoretical part the terms such as information, electronic data, know-how, enterprise information systems, cybercrime, and cyberterrorism are defined. The practical part drawing on the theoretical part gives a thorough analysis of the initial state of an industrial enterprise in food industry. Furthermore, it deals with the implementation of the ECM (Enterprise Content Management) which is considered a possible solution to the security of work with electronic data in industrial enterprise.

Legal framework of computer crime investigation

Master's thesis is focused on computer crime, with an emphasis on the process of investigation. New systematics in Czech computer crime terminology is offered. Within the thesis, cybercrime is perceived as a part of computer crime. Special attention is put on various aspects of criminalistics, as the topic of investigation itself is understood from the point of view of such science. Nevertheless, criminological findings are discussed likewise. Particular emphasis is put on a link between Czech legal regulation and expert literature from the fields of law, criminalistics, criminology and technology. Master's thesis is based on Czech literature, as well as English and French writings, in addition to national and international case law. The text itself is divided into three chapters. First chapter is introducing the issue of computer and cybercrime with selected criminological characteristics, including specifics of offending within the Internet. Second chapter discusses evidence of computer crime, the electronic or digital evidence, from the point of view of criminalistics. ABSTRACT, KEY WORDS Seizing digital tracks for the purpose of a criminal proceeding This thesis analyzes procedural institutes of law that serve to seize digital traces on the Internet to investigate cybercrime. This document also deals with a selected procedural institute of the Convention on Cybercrime, which serves to secure digital traces. Furthermore, an assessment is made as to whether the Czech legislation meets these requirements. Data retention analysis provided information on what traffic and location data are and describes the extent of their retention. The issue of identification of offenders based on seized IP addresses was explained and anonymization methods were explained. The main goal of the thesis is an extensive elaboration of some relevant procedural institutes of the Code of criminal procedure no. 141/1961 Sb., through which digital traces are seized. This data may lead to the identification of the offender, and also for conviction of guilt during criminal proceedings. The thesis elaborates institutes: a record of telecommunication traffic, monitoring digital communication, data freeze, and physical provision of devices.
