System of safety at work in a building company

Occupational health and safety is nowadays one of the most important things, which must be solved by everyone who is responsible for his employees. This thesis deals with a specific occupational health and safety system in a building company. Its task is to introduce the basic legislation of the occupational safety in the Czech Republic and then to describe and propose an improvement of occupational health and safety system in a particular building company. The theoretical part describes basic legislation of the occupational safety in our country, the second part of the thesis gives us the idea of the occupational health and safety system in the company Ekostavby Louny Ltd. Next part describes how the system of occupational health and safety works in practice. The last part contains the summary of all fundamental information and a proposal of improvement of the present occupational health and safety system.

The employer's obligation to compensate for the damage caused to the employee Abstract In the submitted dissertation, the author deals with the topic of the employer's obligation to compensate for the damage caused to the employee. This issue is highly actual, as in the past there have arised, and these days still continue to arise new and new connected questions to discuss, and sometimes the re-opening of questions that have already been settled occurs as well. At the same time, it is also a common-sense oriented topic, as almost every employer has at some point been in a position where they were forced to fulfil this legal obligation towards their employee. Within the scope of this dissertation, fundamental attention is devoted to the analysis of individual types of the employer's liability for damage caused to the employee and to a critical insight into the complexity of their legal provisions and their real usability. International comparisons are also provided in places, where it is appropriate and useful. A number of concrete suggestions de lege ferenda are also provided. The first part is devoted to a basic insight into this issue, but in addition to it, it also contains a clear statistic comparison of the amount of court decisions carried out in cases of lawsuits on fulfilment of the relevant types...

Compensation for mental suffering of primary victims The basis of the thesis is the hypothesis that the current systems of compensation for bodily harm in civil and labor law do not allow for effective compensation for psychological injuries and mental disorders, since they do not devote even one, respectively just one item, of this type of harm in the hundreds of items of bodily harm. Therefore, the aim of the thesis is to analyze the current system of compensation for bodily harm from the perspective of mental disorders, to reveal its deficiencies and to present de lege ferenda proposals so that a comprehensive system is created that will allow the most effective compensation for all types of bodily harm. In order to verify the hypothesis, in Chapter 1 the thesis evaluates the historical development of the compensation for psychological injuries and the invalid legislation, the deficiencies of which are a valuable basis for the suggestion of truly effective de lege ferenda proposals. 1 Claims for compensation for accidents at work and occupational diseases Abstract The topic of this diploma thesis is the issue of the claims of the employee for compensation for accidents at work and occupational diseases included in the broader context of the compensation for pecuniary and non-pecuniary harm in labour law with an accent on the definition of the key concepts with connected institutes. The topic reflects the characteristic attributes, purpose and development of the employer's duty to compensate for pecuniary and non-pecuniary harm, from which the significant part of the work devoted to partial claims for compensation, is based. The diploma thesis is divided into nine chapters, where the topic is described using descriptive, analytical and comparative methods. First chapter is focusing on introducing the field of duty to provide compensation for pecuniary and non-pecuniary harm in private law. The second chapter is devoted to a comparison of the legal regulation of the duty to provide compensation for harm in the Labour Code and in the Civil Code. The goal of the thesis is to analyze the current system of health and safety in logging. The analysis is based on analysis of Czech and European legislation and other regulations, and comparation the details with statistics and other findings from the technical literature. The work focuses on the felling by chainsaw and skidding by tractor or horses, evetually by cableway. The analysis is supported by a questionnaire survey, an overview of accidents in forest exploitation by Vojenské lesy a statky, s. p. company (division of Lipník nad Bečvou) and our own observations of breach of work safety regulations with other subjects. From the findings are proposed possible measures to support the current system or to increase the efficiency of the system.

Employee's claims in the case of work accidents or occupational diseases

The topic of this thesis is employee's claims in the case of work accidents or occupational diseases, because the assessment and determination of damages is still an actual issue. The first part of the thesis deals with theoretical introduction and definition of terms which are material for the whole thesis. The first part defines the liability in labour law, the liability of employee and employer, work accidents and occupational diseases and mainly the employer's liability for damages and non-material damage caused by work accidents or occupational diseases to employees. The next chapter focuses on insurance which is obligatory for all employers who employ at least one employee. This insurance is important in case of the employer becomes liable for damage or non-material damage caused by work accidents or occupational diseases. The insurance is important especially for small and medium-sized employers for whom the compensation could be liquidating and could lead to the termination of their activities. The most importatnt chapter of the thesis is the chapter concerning individual types of employee's claims for damages or non-material damage which arise from work accident or occupational disease, or claims of survivors of employee in case of employee's death, and their assessment.
