V ANGLICKÉM JAZYCE Private-law consequences of a breach of competition law and their enforcement in the Czech Republic The private-law consequences of a breach of competition law, Articles 101 and 102 of the Treaty on the Functioning of the EU and Sections 3 and 11 of the Czech Competition Act, may affect many entities, irrespective of whether they are competitors or consumers. Recently, emphasis has been placed on private enforcement of competition law that is intended to serve as an important complement to public law enforcement. The first part of the dissertation defines basic concepts and principles of competition law including "public rules on restriction of competition". The history of the enforcement of competition law in the Czech Republic and the dynamic development in this area at the EU level are outlined in the second part. The third crucial part of this work deals with the right to damages caused by a breach of competition law in the Czech Republic. In 2014, the EU adopted Directive 2014/104 on certain rules in damages actions with the view, inter alia, to increase the effectiveness of private enforcement of competition rules by civil courts of EU Member States. Prerequisites for the obligation to compensate for personal injury from the provision of health services This rigorous thesis is aimed on prerequisites which must be fulfilled in order to qualify for the compensation for the personal injury, taking into account the specifics that are related to the provision of health services. In case of dispute is the most difficult to prove infringement of the doctor and the causation between the infringement and subsequent damage. For this reason, together with the personal injury part, this is the core of this thesis. In this thesis, I first focus on civil liability in general and build on the issue of civil liability with regard to the provision of health services. There is also a chapter dedicated to health services and directly embedding this area in the legislation. The other parts are divided according to the individual assumptions of the obligation to compensate for personal injury, namely the infringement, the personal injury, the causation and the culpability. This thesis deals with the topic of liability for damage caused by a defect in a product, i.e. liability of a producer (but also of another entity, such as the supplier or importer) for damage caused by the defective product to the health or property of the user (consumer) or other third persons. The primary area of this issue that the thesis has examined is the legal regulation in the UK (liability for damage caused by a defect in a product is in the UK usually expressed as "Product liability"). The main reason why I have chosen to describe the British legal regulation is my study experience in the UK at Northumbria University, where I studied within the program Erasmus+. In the UK, I had the opportunity to find all the resources, experience and incentives necessary in order to analyze the topic of Product liability and therefore, to write this thesis. Civil Liability for Bodily Injury in Medical Disputes The aim of this thesis is to map and analyze civil liability for bodily injury caused to a patient while providing health care. This topic is specific and current, especially considering the fact that the new Civil Code came into effect on 1. 1. 2014. Where required, there is comparison between the current and previous legislation. This thesis also offers a glimpse into the German legal system and features institutes similar to ones in the Czech legal system as well as institutes the Czech legal system does not offer. The thesis is divided into five chapters. The first chapter describes domestic legislation with elements of medicine. This includes sources of law that have the form of law, professional rules and case law. The second chapter deals with civil liability in the health sector and its individual cases that lie in the objective liability of the health care provider. At the same time, contractual and and tort liability is pointed out. The third chapter discusses the elements of civil liability and further maps out and takes into account its individual attributes, that are necessary to form civil liability. Obligation to compensate for personal injury in connection with provision of health care This dissertation is focused on the obligation to compensate for personal injury in connection with the provision of health care. The aim of the dissertation is to analyse relevant general elements of the obligation to compensate for personal injury as well as relevant special elements of such obligation. The dissertation surveys the interpretation of conceptual changes related to the recodification of Czech private law in the area of tort law in connection with the provision of health care. Legal basis of the doctor-patient relationship will also be analysed because such analysis is crucial for determination which elements of the obligation to compensate for personal injury will regularly be applied in this field. Civil Liability in the Case of Disrespecting a Patient's Advance Directives The aim of this thesis is to analyse and describe the problematic of Civil Liability in the specific case of disrespecting a patient's advance directives by a medical. The institute of Advance Directives was first introduced in the Czech law by the Convention on Human Rights and Biomedicine in 2001 and later by the Law No. 372/2011 Coll., Act on Health Care Provision. Thought the Advance Directives cannot be considered as a new institute in the Czech law, it is hardly ever used in practice. There is no judicature and practical knowledge on the topic of civil liability in this case, and the insecurity causes that doctors do not feel like willing to respect the exceptionally occurring advance directives, because they fear the criminal liability they think that could arise if they did not provide the health care necessary for saving life of their patient. Necessity and self-defence in civil law

This diploma thesis deals with necessity and self-defence in the light of the large recodification of private law in the Czech Republic. Together with other legal concepts they are referred to as the circumstances excluding unlawfulness. Their specificity lies in their exclusion of the obligation to compensate suffered damage provided that the conditions laid down by the law are met. This issue has always been a matter of interest to both laical and professional public as these important legal concepts form one of the most fundamental pillars of the liability system. The aim of the thesis is to point out their importance for the present codification by a comprehensive analysis of relevant legislation, conclusions of theory and case law. They have been subjected to extensive analysis as well as their Roman law roots. The key part is the comparison between Czech and German law that exceed the terms of private law. Thesis title: Civil liability in sports This thesis deals the issue of civil liability of athletes for sports injuries which is the current topic. In connection with constantly growing commercialization, media promotion and internationalization of sport is necessary to move towards the legal regulation of sport and its various aspects, including civil liability. The thesis is composed of seven chapters which are divided into three parts. The first one focuses on the definition and description of sport, sports standards and rules and the relation between sport and law. The second part deals with the civil liability in general, ie. its prerequisites and legal consequences. The remaining and main part of the thesis focuses on the issue of civil liability of athletes for sports injuries caused during the sports activities. - Compensation for damage to health: a comparison of Czech and German legislation This diploma Thesis deals with the theme of compensation for damage to health in Czech and German legislation, which was one of the inspirations during the creation of the Czech Civil Code. The aim of this study is to explore the issue of civil compensation for damage to health (and in the case of death) with an emphasis on medical-legal relations arising from the provision of health care, in both these legal systems. This study is divided into three parts. In the first is examined the legislation of Czech Republic, in the second the German one. The third section briefly summarizes the differences and the congruent aspects of both legislations, supplemented by suggestions for possible changes and improvements of the Czech law de lege ferenda. In dieser Masterarbeit wird die Problematik des Gesundheitsschadens im tschechischen und im deutschen Zivilrecht beschrieben. Das Ziel dieser Arbeit ist, eine Übersicht über den Gesundheitsschutz in beiden Rechtsordnungen, und darüber, wann die Gesundheit verletzt wird und welche Folgen daraus entstehen, zu bieten. Dazu wurden die komparatistische Methode und die analytische Methode benutzt. Die Arbeit wird in drei Hauptkapiteln gegliedert, die ersten zwei widmen sich der Regelung in der deutschen und der tschechischen Rechtsordnung und das dritte der Komparation. Die Aufmerksamkeit wird zuerst der verfassungs- und internationalrechtlichen Verankerung des Lebens- und Gesundheitsschutzes geschenkt. Weiter wird geringfügig die vertragsrechtliche Haftung beschrieben. Die Hauptaufmerksamkeit wird der deliktischen Haftung geschenkt - es werden die Voraussetzungen für ihre Entstehung, sowie auch die Art und der Umfang des Schadensersatzes erläutert. Selbständig wird auch der Körper als der Objekt des zivilrechtlichen Schutzes beschrieben, und es werden auch die Fälle der sogenannten "wrongful birth", bzw.
