Povinnost k náhradě újmy na zdraví v souvislosti s poskytováním zdravotních služeb Předkládaná disertační práce je zaměřena na problematiku stanovení povinnosti k náhradě újmy na zdraví v souvislosti s poskytováním zdravotních služeb. Jejím cílem je provedení analýzy jednotlivých obecných skutkových podstat povinnosti k náhradě újmy na zdraví a rovněž i relevantních speciálních skutkových podstat, jejichž aplikace v této oblasti pravidelně přichází v úvahu, což značí podrobné rozebrání jejich jednotlivých prvků. Cílem disertační práce je dále interpretace koncepčních změn plynoucích z rekodifikace českého soukromého práva v oblasti závazků z deliktů se zaměřením na poskytování zdravotních služeb. Analýze je podroben i právní základ vztahu mezi lékařem a pacientem, jelikož tato analýza je klíčová pro rozhodnutí, jaké skutkové podstaty povinnosti nahradit újmu se budou v této oblasti pravidelně aplikovat. První kapitola se proto zabývá právní povahou vztahu mezi lékařem a pacientem. Druhá kapitola se věnuje povinnosti k náhradě újmy na zdraví při poskytování zdravotních služeb, tedy vymezení a analýze jednotlivých skutkových podstat povinnosti k náhradě újmy, jejichž aplikace v případě způsobení újmy na zdraví v této oblasti přichází pravidelně v úvahu, včetně obecného vymezení jejich jednotlivých... Obligation to compensate for personal injury in connection with provision of health care This dissertation is focused on the obligation to compensate for personal injury in connection with the provision of health care. The aim of the dissertation is to analyse relevant general elements of the obligation to compensate for personal injury as well as relevant special elements of such obligation. The dissertation surveys the interpretation of conceptual changes related to the recodification of Czech private law in the area of tort law in connection with the provision of health care. Legal basis of the doctor-patient relationship will also be analysed because such analysis is crucial for determination which elements of the obligation to compensate for personal injury will regularly be applied in this field. Therefore, the first chapter is devoted to the legal nature of the doctor-patient relationship. The second chapter deals with the obligation to compensate for personal injury caused by the provision of health care, i.e. with the definition and analysis of relevant elements of such obligation in this field.
