Procedure for Granting International Protection in the Form of Asylum in the Czech Republic Abstract The content of this work is mainly the course of the asylum procedure from the submission of application for international protection to possible appeals, but also the definition of fundamental concepts, the historical development of the asylum institution, international, EU and national sources related to this procedure. In the introduction of this work I introduced and explained the different concepts without which it would be difficult to understand the asylum issue. In addition to outlining the historical development in this area, I have also taken the liberty of mentioning several major migration waves. Another important part of this thesis are the individual legal sources of this issue. The key documents of international regulation are described. Within the framework of Community law, the thesis lists the essential directives and regulations with a view to the necessary Europeanisation and subsequent incorporation into our legal system. The present work focuses on Europeanisation and the related influence of the CJEU case law on the interpretation of legal norms in the individual Member States of the European Union. Integration of Migrants into the Czech Society

The aim of my diploma work is to study the subject of integration of foreigners into the Czech society. For that purpose I intend to use research questionnaires and to compare my results with results of other researches conducted by NGOs. Secondary aim is to map legal status of foreigners in the Czech Republic, historical reasons for migration and its development, and the composition of migrating population in Europe. Furthermore, I will focus on access to health and social insurance and to the health care system as well as on education and work opportunities which foreigners have in the Czech Republic.

Refugee definition in international law The definition of the term "refugee" in international law is a very wide issue which can be conceived from many different points of view. One of the best ways how to deal with it is to focus on only one part of the generally most widely accepted definition of a refugee. This is the definition according to the 1951 Geneva Convention relating to the Status of Refugees. According to this document a refugee is a person who "owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion, is outside the country of his nationality, and is unable to or, owing to such fear, is unwilling to avail himself of the protection of that country..." This definition is more than fifty years old and still actual. It has been adopted in response to the Second World War and the mass refugee flood. The missing interpretation of the term "persecution", which is the fundamental element of the Geneva Convention refugee definition, is still one of the biggest problems of refugee law. The thesis deals with procedure of asylum and additional protection granting in the Czech Republic. The thesis focuses on characteristic features of the process; primarily the proceeding the application of protection and asylum granting by official authorities. To a certain extent, the thesis copes with substantive law; it defines terms of refugee and asylum law. It enumerates and characterizes the mentioned terms in connection with the process of the asylum and protection granting in the Czech Republic. Impact of the European Union law on the Czech internal law is also discussed.
Dublin system's impact on asylum policy in the Czech Republic

The objective of this thesis is to analyze the application of the Dublin system in the Czech Republic. The descriptive part of the thesis is mapping the development of the Dublin system, criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States, and Eurodac database, complementing the entire Dublin system. The descriptive part is followed by analytical part. This part analyzes the Dublin cases and their links to asylum requests. Specifically, it is concerned with the number of Dublin cases in the Czech Republic together with their breakdown to sent and received requests and also breakdown according to nationalities of the Dublin cases. The analysis concludes that the Dublin mode contributed to the decrease of the asylum requests in the Czech Republic, but it has not influenced the nationality composition of the asylum seekers. The Establishment and Development of Asylum Policies in East Central Europe

In the light of the current refugee crisis in the European Union, and the remarkably critical stance the East Central European states are taking in Brussels, this research contributes to a broader understanding of the Czech Republic, Slovakia, Hungary and Poland's policies towards refugees. By scrutinizing the process of developing refugee policies during the 1990s and 2000s, the research will demonstrate that the countries united in the V4 platform in their first years of transition generously contributed to international refugee protection. Steep increase of asylum applicants and negotiation talks with the EU in the late 1990s brought various changes to the refugee policies in the region, marked by more closely defining and the enhancing of asylum seekers' and recognized refugees' rights, but also by lower refugee recognition rates. Accession to the European Union ultimately resulted in more complete and comprehensive asylum policies in line with the Common European Asylum System (CEAS). However, the V4 states maintained rather restrictive interpretations of the European policy, explained by the pressure the CEAS places on the states at the EU's external border and lower economic capacity to accommodate large numbers of refugees. International Legal Protection of Refugees Persecuted for Reasons of Sexual Orientation and Gender Identity: A Critique of the Human Rights Approach Abstract This thesis examines the human rights approach to the interpretation of the definition of refugee by using the example of persons persecuted on the grounds of sexual orientation and/or gender identity (SOGI). The thesis focuses primarily on the European area and how a human rights approach to the interpretation of 'persecution' may be relevant to the practice of European Union states specifically in relation to SOGI refugees. The first part outlines the context of persecution of persons fors reasons of their SOGI. It examines the criteria by which SOGI is, and potentially can be, subsumed under the relevant grounds of persecution for refugee status. The second part outlines the different approaches to interpreting the concept of persecution and elaborates more on the so-called 'circumstantial' approach embodied by UNHCR. The third part is devoted to elucidating the doctrine of the human rights approach pioneered by James Hathaway and his book The Law of Refugee Status. The Influence of Asylum Discussion on Attacks against Immigrants in Federal Republic Germany in the Years 1992 - 1993: Cases Mölln und Solingen

The wave of attacks against national minorities in the Federal Republic of Germany in the first years after The German reunification in 1990 became on the background of asylum debate discussing the necessary change of asylum right and influx of asylum seekers became a burning problem. The culmination of moods against migrants was the attack in Mölln in November 1992, where were 3 persons of Turkish origin killed. The reactions were massive demonstrations all over Germany and finally an effort of political parties to give in their strict attitudes and agree on the amendment of asylum right. On 6th December 1992 CDU/CSU and SPD agreed on so called Asylkompromiss that should stop the influx of asylum seekers but still should keep the right of asylum and from that almost all the parties expected the end of the aggression against immigrants. The amendment of law was passed in German Bundestag on 26th May 1993and came into force on 1st July 1993. However the approved restriction of gaining the asylum didn't discourage the right-wing extremists and before coming into force they committed one of the most terrific arson attacks in Solingen on 29th Mai 1993, which entered in the German post-war history as the one with the most victims at all.
