The Topical Issues in Experts Activities

The Diploma thesis deals with general issues in the environment of Czech expertise from the view of ordinary experts. The study fosuses on a critical analysis of expert activities with special regards to remuneration issues, timing of expert fees, expertise, experts‘ inauguration and dismissal from a post and cooperation with government authorities. The methodology used is an array of reactions by experts to individual and specific points, which are then evaluated and possible methods of solution are proposed. The end of the thesis statistically summarises all problems in a graph and highlights the most critical ones.

Status of senior employees This thesis deals with a special category of employees who have the task of managing, organising and checking the work of subordinate employees. It is often crucial for the employer's operations to have these senior employees in the company, especially to better ensure the organisation of work, where the employer may not have sufficient overview of all their employees, especially if it employs a large number of people. Managers thus act as a necessary link between employers and rank-and-file employees, fulfilling the employer's will through their activities, thus facilitating the performance of the employer's activities, but also making it easier to manage a larger number of employees, which can also lead to greater success of the company. The title of the thesis: Protective function of labour law in the case law of Czech courts Abstract: This thesis focuses on the protective function of labour law in the case law of Czech courts. The protective function of labour law is one of its essential functions and has a close relation to employee protection as the weaker party of employment relationships. Courts as public authorities and decisions-making bodies significantly affect the final form of the protective function, while providing protection to the rights of employees. Considering the fact that the protective function is immanent to labour law and the case law of Czech courts further develops, in my opinion, this thesis deals with a topical and evolving issue. The content of this thesis is divided into four chapters. The first chapter describes the meaning of protective function in labour law, its role as a fundamental principle of employment relationships, and legal consequences related to it. Its part is also the brief explanation of the concept of "flexicurity". The second, third and fourth chapter deal with three fields of labour law, in which the protective function is significantly reflected. Legal action aimed at terminating the employment relationship The topic of the submitted diploma thesis is individual legal proceedings aimed at the termination of employment. This is a crucial area of labor law, because it is through these legal acts that the relationship between the employee and the employer is terminated, and also because it affects each of us at least once in our lives. The purpose of the thesis is to give a comprehensive interpretation of these legal proceedings with reference to their peculiarities and problems. To achieve this purpose, the amendment to the Labor Code itself was used, supplemented by professional literature and case law. In addition to the introduction and conclusion, the thesis is divided into eight chapters which mainly deal with individual untying legal proceedings. In the introduction I explain the reasons behind the choice of the topic of this thesis. I also present its structure, which is then supplemented with a brief description of the content of individual chapters. Ways of ending of an employment relationship

The ending of an employment relationship can be considered to be one of the most important institute of the labour law. By means of it is terminated the legal relation between employer and employee, which can results in grave social and legal repercussions for the employee. For this reason, the labour code follows up thoroughly the alterations, conditions and ways of ending of an employment relationship. This rigorosum wants to map these ways and define usage of its legal preconditions and differences in following chapters. It uses legal practise of labour code, case law, and literature for this purpose. It adverts several practical issues of ending of an employment relationship at the same time. The introduction pursues the general concept of labour law and its historical development. It also contains, what legal relation is according to the law and introduces the reader to employment matters at the same time. Thesis is focused on the systematic interpretation of the issue of termination of employment and associated terms. The first chapter focuses on a general definition of labor law, as a legal branch covering the termination of employment. The second chapter was devoted to the relationship between the Labour Code and the Civil Code. In the third chapter were mentioned the most important international documents on the subject of the thesis. The fourth and fifth chapters were focused on the main principles of labor law and it's entities. The sixth chapter describes ways of termination of employment, while the seventh chapter contains the duties of the subjects of labor relations related to termination of employment. Aspects of employees dismissal from the organization from the perspective of the employer and the employee

and key words Abstract This diploma thesis is a contribution to the mapping of the issue of involuntary employee departures from organizations with an emphasis on the aspect of dismissal organizations and the dismissal individual. Thematically, the work is divided into theoretical and empirical part. The theoretical part deals with issues related to the nature of work and the importance of work in human life. It clarifies the traditional motives that encourage a person to perform a paid work in order to better understand the consequences of its loss. It provides insight into the legislative framework of employment termination with focus on the types of termination, which in fact represent dismissals. These data are followed by text that introduces the reasons for which the employee can be dismissed, since these reasons play an important role in next phases of dismissal. Since the dismissal of workers (although it may have positive benefits for the organization) is less popular HR activity among the performers and it could be very traumatic for leaving employees, it is common to prevent it by HR planning or through incentives for voluntary departures.
