Název práce: Ochranná funkce pracovního práva v judikatuře českých soudů Abstrakt: Tato diplomová práce se zaměřuje na ochrannou funkci pracovního práva v judikatuře českých soudů. Ochranná funkce pracovního práva je jednou z jeho základních funkcí, která úzce souvisí s ochranou zaměstnance jako slabší strany pracovněprávních vztahů. Soudy přitom jako orgány veřejné moci nadané rozhodovací pravomocí zásadním způsobem ovlivňují konečnou podobu této ochranné funkce při poskytování ochrany právům zaměstnanců. Vzhledem k tomu, že ochranná funkce je pracovnímu právu imanentní a judikatura českých soudů se neustále vyvíjí, jedná se dle mého názoru o stále aktuální a vyvíjející se téma. Obsah této diplomové práce je rozčleněn na 4 kapitoly. První kapitola přibližuje význam ochranné funkce v pracovním právu, její zakotvení jako základní zásady pracovněprávních vztahů a právní důsledky s tím spojené. Její součástí je též stručný výklad k pojmu flexicurity. Druhá, třetí a čtvrtá kapitola se zabývá třemi oblastmi pracovního práva, ve kterých se zásadní měrou promítá ochranná funkce pracovního práva. Těmito oblastmi jsou odměňování, ochrana zaměstnance před skončením pracovního poměru a pracovní podmínky včetně BOZP. V každé z těchto kapitol je pojednáno o ochranném účelu vybraných právních institutů. K tomu... The title of the thesis: Protective function of labour law in the case law of Czech courts Abstract: This thesis focuses on the protective function of labour law in the case law of Czech courts. The protective function of labour law is one of its essential functions and has a close relation to employee protection as the weaker party of employment relationships. Courts as public authorities and decisions-making bodies significantly affect the final form of the protective function, while providing protection to the rights of employees. Considering the fact that the protective function is immanent to labour law and the case law of Czech courts further develops, in my opinion, this thesis deals with a topical and evolving issue. The content of this thesis is divided into four chapters. The first chapter describes the meaning of protective function in labour law, its role as a fundamental principle of employment relationships, and legal consequences related to it. Its part is also the brief explanation of the concept of "flexicurity". The second, third and fourth chapter deal with three fields of labour law, in which the protective function is significantly reflected.
