Formation of marriage

This diploma thesis focuses on the analysis of the constitution of marriage legal regulation in the new Civil Code and the relating legislation. Primarily, it deals with the concept and the purpose of marriage, along with the moment of its constitution and, it outlines alternative forms of entering into marriage. The thesis further analyses the difference between the civil and religious marriage. The major chapter is devoted to entering into marriage with an international jurisdiction conflict because the number of marriages between Czech citizens with foreigners continues to increase. It becomes more frequent that the Czech citizens enter into marriage abroad. At the end, the causes and consequences of the putative marriage and the invalidity of the entering into marriage are examined.
Nuptiality in the Czech Republic: cross-sectional and cohort view

Nuptiality in the Czech Republic: cross-sectional and cohort view Abstract The objective of this study is to describe the development of primo-nuptiality in the Czech Republic from 1961 to 2014 using primo-nuptiality life tables. These tables have been calculated to such an extent with the use of the same methodology for the first time and thus their complete mutual comparability is guaranteed. For each period there are selected years, which are then in detail examined primarily in terms of intensity and timing of first marriages. As for illustration there are also mentioned external socioeconomic factors of the given time period, which has been affecting the discussed indicators. The last chapter of the study adresses a cohort view on primo-nuptiality of specific birth cohorts. The development of the cohort primo-nuptiality quantum by age and respective differences are investigated. William Slavata of Chlum and Košumberk. Lifeway to the window of Prague Castle and from there to glory

The main topic of the thesis is William Slavata of Chlum and Košumberk. The most important information about his life and career in many significant provincial and royal offices is summarized at the beginning of my thesis, which is divided into five chapters. The third chapter, which follows after the introduction, list of sources of literature and explanation of key terms, describes the development of a prominent clan of Slavata of Chlum and Košumberk, whose origins according to the oldest historical sources can be traced back to the turn of the 11th century. Moreover, I linked the history of Slavata of Chlum and Košumberk clan with geographical context by adding detailed description of clan residences in the Kingdom of Bohemia. The fourth chapter deals with Vilém Slavata of Chlum and Košumberk himself, illustrating the everyday life of a high nobility representative. The fifth chapter gives information on the picture depicting the life of Count Vilem Slavata as well as other important events of this era in art.

ABSTRACT: The presented thesis is based on a study of moral psychology and its methodological tradition, particularly on Gilligan's morality of care. The marriage has become a subject of this research. The main source of the empirical data are interviews about the Wedding dilemma and following interviews about this topic. The aim of the research is to mediate an insight into young adults' reasoning about moral dilemmatic situations, that deal with a wedding and setting up the family, and to uncover a moral dimension of the marriage. This study is a contribution to the theories of morality, to the discussion about the acceptance and the rejection of the marriage, and to the discussion about moral dimmension of the marriage. According to my findings (and by using my methodological procedures) it is possible to find a difference in reasoning between married and unmarried respondents. The moral dimension of the marriage is consisted in the possibility of hurting the others in the case, that partners don't concur in the question of the marriage. Marriage The aim of this thesis is to describe legal institution of marriage - from the conclusion of marriage to the ending of it - according to the current legislation. I compare main changes introduced by the new Civil Code with legislation before 1st of January 2014. The reason I chose this topic was the fact that institute of marriage affects everyday life of almost every individual. My thesis is composed of five chapters. Each of them deals with different aspects of marriage. Besides these five chapters this thesis includes Introduction, Conclusion, Index of Appendices and the List of Bibliographical References. Chapter one concentrates on the most important changes in the Family law area during the modern history, including recent recodification of private law. This chapter also contains summary of the main legal sources of marital law and examines the term marriage itself and its purpose. Chapter two focuses on the conclusion of marriage. Marriage is an important legal institution, which is connected with the development of Christian-Jewish culture and concerns, whether directly or indirectly, every one of us. In this is seen topicality of chosen topic and this fact is underlined by the adopting of the Act. No. 89/2012 Coll, the Civil Code, which is progressing in the continuity of the previous legislation, but it also brings a number of changes. In this work was used a large number of books, commentary literature, technical articles or legal textbooks. Finally, there are theoretical conclusions and statutory provisions, supported by higher Courts jurisprudence, which is despite of the changing in legislation, still apply. The work is divided into three parts which are preceded by Introduction and terminated by Conclusion. 70 ABSTRACT The topic of my Master's degree thesis is institution of "Marriage". I chose this topic because I am interested in family law and I would like to be an attorney focusing on this area of law in future. I also think that marriage is an important legal and social institute, which proves its long-standing history. This thesis reflects the historical development of the law but it mainly deals with legislation in force. Specifically it deals with the origin of marriage, dissolution of marriage and the legal consequences that legal negotiation brings. I also pay attention to the legal regulation of rights and responsibilities of spouses. The thesis is divided into five chapters. The first chapter is dedicated to an introduction. Rites of passage as a theme in the history textbooks

The intention of the Diploma thesis Rites of passage as a theme in the history textbooks is analyze the history textbooks of upper primary school in terms of rites of passage. This practical part is preceded by general introduction to the issue of rituals and rites of passage. The following is a discussion of selected rites of passage, which are weddings and funerals. Selected rites of passage determine the direction which is going analysis itself textbooks. In general I am interested in themes of weddings, funerals and all other facts that are associated with the issue in analyzing textbooks. Then I find out, how and what extent selected rites of passage are presented to pupils. So that pupils gain the most information from the particular way in view of the rites of passage, I deal also possibilities to enrich a certain representation of ritual. The conclusion summarizes the main reasons for the changes of rites of passage that appear in the history books for upper primary school. "I feel like an alien" - migration of Filipino women and mixed marriages

This thesis reacts to the Philippine migration trend, supported by Philippine government for economic reasons, mostly regarding to work opportunities of migrants abroad. Author concentrates on primarily non-work related migration but the partnership related one, with focus on Filipino women, who migrate to Czech republic with their husbands. The work is based on 5 in-depth interviews with female Filipino migrants, where choice strategies and important moments in constructed narrative images of reality were identified. In the process of migration the gender power change was identified as non-fluid. Gender is being perceived as anchored in the institutions and social relations that are not space-dependant, in this case it manifests in the family. Family relations are lasting across spatial distance and so they constitute the feeling of migrants that they have to support their family. There is also the difference between strategies of women who could migrate into developed country sooner and therefore broaden their gender power and those for whom Czech Republic is the first country, where they migrated and became financially and also partly socially dependent on their husband.

As it is evident from the title of this work, I will focus on formation of marriage, not only the civil one, but also a church wedding and some not ordinary ways of marriage contracting. The work addresses itself not only to effective domestic legal regulations (the family act n. 94/1963 Coll.,), but also to legal regulations taken in Act No. 89/2012 Coll., the Civil Code (the new Civil Code, herafter "NOZ" or "new Civil Code"). Using the comparative method, this work also discusses fundamental similarities and differences between the legislation of the Czech Republic and the Federal Republic of Germany, from which legal regulations were drawn on the creation of the new Civil Code. This work is divided into 8 basic parts. The first part is focused on illustration of a term of marriage and its purpose. The second part deals with the basic legal obligations of engaged couples before marriage, moreover an earlier conception Institute of engagement is not forgotten.
