Freedom of speech and racial extremism

Apart from the basic definitions used in the paper, the main objective of this bachelor thesis is especially mutual correlation of freedom of speech as the one of basic human rights and race extremism which is undesirable phenomenon in mature society. The first section is devoted to definition of term "freedom of speech" by means of legal regulation included both in Declaration of Fundamental Rights and Freedoms and international agreements. To specify freedom of speech exactly, it is necessary to consider its limitation in a series of documents which are also mentioned in the introductory section. The second section of the thesis is focused on the definition of another significant term often used in the thesis - race extremism. A part of this section is a smaller sub-section containing one of many cases of race attacks. The main reason for choosing this case was personal participation of the author of this thesis in the attack. The main objective of this sub-section is not only presentation of the actual case but application of theoretical knowledge in this concrete case. No other cases were chosen so that the thesis did not receive any unwanted causative contents. Political advertising

The aim of this thesis is to answer the question whether the ban on political advertising on television and radio, which is laid down in the Czech Broadcasting Act 2001, is in compliance with the freedom of expression. Namely, whether it is in compliance with the Article 17 of the Czech Charter on Fundamental Rights and Freedoms. And secondly, whether it is in compliance with the Article 10 of the European Convention on Human Rights. The freedom of expression is an essential political right. Therefore, the limitations have to be interpreted restrictively. Moreover, all limitations have to be thoroughly justified. Firstly, the thesis analysis the scope of the ban on political advertising on television and radio. It explains what are the sanctions in the case of violation of the ban. Examples of violations are also introduced. Further, it is referred to the amendment to the Broadcasting Act. This amendement proposes to define "the political commercials". It is not possible to find such a definition in the current version of the Act. Another topic which is discussed is an anonymous advertising. Then attention is paid to the regulation of free airtime. This diploma thesis deals with freedom of speech and its limits. Freedom of speech as the fundamental right which is necessary to proper functioning of a democratic state where the law rules. In this regard the freedom of speech has to be protected properly. Protection in Czech legal order is entrusted with the legal regulation of the major legal force, part of constitutional order, "Charter of fundamental Rights and Basic Freedoms". Freedom of speech as we know it today, was expressed after the Second World War as a prevention of similarly devastating conflict in the future. Certain desire for the free dissemination of ideas we can see in a deep histor when firs attemps of gaining freedom of speech was closely connected to religion. Denial of the Holocaust and other crimes from the perspective of the international protection of human rights (freedom of expression) This thesis discusses the conflict between the freedom of expression and other rights and values guaranteed by the European Convention on Human Rights, which are affected by denial of the Holocaust and other crimes. Freedom of expression is a relative fundamental right that can be limited in order to protect other protected rights and values. In cases of denial of the Holocaust and other crimes, freedom of expression can be limited in the interests of the protection of the dignity of victims and prevention of disorder or crime. The aim of this thesis is to provide a comprehensive view on the issue of denial of the Holocaust and other crimes in the light of freedom of expression in the European Court of Human Rights case law. Protection of Personality Rights in Relation to Media

The topic of the master thesis Protection of Personality Rights in Relation to Media is the conflict between two constitutional rights - protection of personality and freedom of speech. Both of these rights are stated in the Constitutional Act No. 2/1993 thus they have an equal level of legal protection. However, conflicts can arise between the two. The thesis evaluates and analyses these two crucial rights and their conflicts. This thesis is divided into four main chapters, which are the following: Protection of personality, Freedom of speech as a main principle of media law, Protection of personality versus freedom of speech in the practice of the Constitutional Court, and Media development and its influence on the protection of personality. The first and the second part of the thesis analyse protection of personality and freedom of speech. The aim of the first two chapters is to present the sources of these rights, to define basic concepts, meanings and limits of these rights and to describe their possible restrictions. Campaign Finance in the U.S. : McCain-Feingold Reform

The United States has a long history of political campaigns. The Bipartizan Campaign Reform Act of 2002, also known as McCain-Feingold, was the last attempt to regulate the campaign finance. Being enacted in order to cover the loopholes that occurred in the Federal Election Campaign Act, this act banned the "soft money", it modified the rules for the pre- electional broadcasting, and it brought special restrictions for self-financing candidates. These changes succeeded to be enacted by both chambers of Congress, were signed by the President and upheld by the Supreme Court in the McConnell v. FEC landmark decision. However, the impact of the reform didn't quite meet the expectations of its supporters.

The thesis deals with student participation in the life of the school and more specifically with the work of student self-administration. The goal of the theoretical part is to define the concept of student participation and all its accessible forms. To outline the life of students self-administrations and present a current picture of the issue of student participation in the Czech Republic. To compare international experience with the work of student self-administration, as mainly in the course of the last couple of years there have been changes in thinking about student participation. The theoretical context serves as a basis for the empirical part of the paper. The main goal of the investigation is to analyze and describe the work of student self-administration at a chosen high school. The research also describes what possibilities and limits students as well as the management and teachers feel there are in relation to successful operation of student self-administration. The research was realized using a mixed qualitative/quantitative model (QUAN - QVAL scheme). The sample comprises of students, members of the student self-administration, teachers and management of a chosen high school.
Protection of personality rights in relation to media

This thesis deals with cases of conflicts of personality rights with the activities of the media, which representing the exercise of freedom of expression and right to information. It focuses primarily on answering these questions: how is the personality of individuals protected against unauthorized interventions of media in our legal system, what is considered as appropriate and what as an inappropriate interference with the personal rights of individuals and whether an individuals in whose personal rights have been infringed by the media, can obtain adequate reparation for the harm that was caused them by unauthorized intervention. The thesis is divided into six parts. The first part is the introduction, which describes the main focus of the work and questions with which the work deals. The second part is devoted to a treatise on the general format of personality rights according to the general rules contained in Law No. 40/1963 Coll., The Civil Code. in English The First Amendment to the United States Constitution and the development of its interpretation The aim of the paper is to analyze the First Amendment to the United States Constitution. The main reason for my research is my long-term personal interests in the fields of law which are covered by the First Amendment. The thesis is composed of an introduction, six chapters and a conclusion. The study begins with the introduction where it is discussed methodology, my motives for choosing this topic, importance of the topic and potential contribution of this thesis to the Czech legal science. Chapter One examines historical roots of the First Amendment's rights and freedoms. It focuses on their development both in the England and in its American colonies. It tries to find main tendencies contributing to reasons for adopting rights and freedoms embodied in the First Amendment. Chapter Two concentrates on the main political and legal events involving adopting the First Amendment, and then it attempts to find a proper interpretation of the First Amendment using both historical and teleological approach. This interdisciplinary thesis deals with the area of investigative journalism and ethics. In the context of our time it offers a look at what kind of information a citizen has the right to obtain and what kind of the published information violates the moral rights of the individual. The work depicts the professional and ethical requirements placed on workers in the media to indicate the boundaries between "investigative journalism" and the pursuit of sensation. I draw upon the core material of the Syndicate of Journalists of the Czech Republic, the ethical codes of our public and private media and the books of experts in the field of media studies and ethics.
