National parks regulation in the Czech Republic and the Kingdom of Spain

1 Abstract Legal Regime of National Parks in the Czech Republic and the Kingdom of Spain National parks as traditional instruments of in situ nature protection, which ensure the protection of the most valuable natural values of the state, have long been a socially debated topic that deserves repeated attention. The fact that this is a current and fundamental issue is proved by the fact that both legal regulations examined in this thesis have undergone extensive changes. The Czech regulation of national parks was amended completely in 2017 and the Kingdom of Spain adopted a new law on national parks in 2014, also in response to a long-standing dispute between the autonomous regions and the central government over jurisdiction over specially protected areas. The aim of this work is to present and analyze the basic legal concept of national parks in the Kingdom of Spain and the Czech Republic, sources of legislation, tools used for nature protection, their anchoring in legislation and institutions related to the administration of national parks. Based on the performed analysis, a comparison of individual institutes is performed, their identical and different elements are evaluated and some changes de lege ferenda are proposed. Large-scale Nature Conservation Areas in the Czech Republic and Selected European Countries in the Legal Context

The main goal of the thesis is to analyze and compare the degree of protection of the large-scale nature conservation areas in the legal orders of the Czech Republic, the Russian Federation and the United Kingdom of Great Britain and Northern Ireland, and, in the conclusion of the thesis, to answer the question of whether these countries' regulation provides a sufficiently effective protection to these areas. Legal orders of the examined countries are analyzed with regard to the scope and effectiveness of the large-scale nature conservation legal instruments. Administrative instruments are examined and compared, including the degree of proprietary rights restrictions and related compensations of property loss. Furthermore, the conceptual and economic instruments (both positive and negative stimulation) are also examined. The analysis also focuses on the regulation of legal liability in regard to the large-scale nature conservation. Next, the thesis focuses on the institutional framework of the large-scale nature conservation in the examined countries and on the evaluation of the scope of the nature protection authorities' competence. National parks in the Czech Republic and their legal regulation Abstract The subject of this master theses are national parks in the Czech Republic and their legal regulation. The main legal document that regulates the issue of national parks in our country, is the Act No. 114/1992 Coll., On Nature and Landscape Protection, as amended. This Act has been significantly amended and its wording has been in force since 2017. For the most part, this new regulation affected especially national parks that represent the most important and strictly protected areas in the Czech Republic. Although, in practice the amendment has not yet been fully reflected, as some institutes are still in the process of negotiation or approval. The aim of this thesis is therefore by means of methods of description, analysis and comparison comprehensively summarize regulation of the existing national parks and at the same time in the light of the previous legislation to compare it and analyze. Subsequently, critically evaluate the extent to which the Czech legislator has managed to create an effective legal regulation responding to the current needs of nature protection. Legal aspects of tourism and sport in Krkonoše mountains national park Abstract This presented thesis analyse law regulation concerning protection of National Parks in against negative Influence of tourism and sport. Assessing impact of tourism on essential pillars (principles) of sustainable development I tried to find out if the preservation and protection of national Parks in The Czech Republic within Czech legislation is adequate. Content of the thesis of eight chapters is definition of terminology used in this thesis, listing of sources of legal regulation and means of protection of nature at National Parks and comparison of specific legal regulation of KRNAP and KPN. At the end of thesis the essential findings of the analyses are summarised. The aim of this thesis is to find a compromise between effective legal regulation and over-regulation of tourist and sport activities in National Parks. Legal regulation of nature protection in national parks Abstract The purpose of the thesis is to provide an overview of legal instruments used to protect nature in national parks after the amendment of the Act No. 114/1992 Coll., On Nature and Landscape Protection ("NLP") and evaluate their functionality. Although Act No. 123/2017 Coll., which amended the NPL, has been in effect since June 1, 2017, changes are being reflected in practice gradually. The thesis is elaborated by a descriptive method connected with the analysis of effective legislation and it is formally divided into six chapters. The first chapter deals with sources of legal regulation, the second one deals with the term of national park itself, including a short historical excursion and the international concept of IUCN. This chapter also includes the issue of the protection zone and the process of proclaiming national parks. The third chapter is devoted to the new concept of management zoning and also contains the current information on the zoning discussion in individual national parks. Comparison of socioeconomic aspects of farming in the protected

The main objective of this work is to compare selected socioeconomic aspects of farming in three business in Šumava. One lying inside the National park Šumava and protected landscape area Šumava and belongs to the ecological farming system, the second eco-enterprise is outside the protected area and third for comparison deals with the conventional form of agriculture and its lands reach into the protected landscape area Šumava. The theoretical section provides findings from the literature on socioeconomic aspects and protected areas (NP and CHKO Šumava). In the practical part of the selected agricultural operators were compared in terms of objective and subjective data (resulted from the interviews with individual company executives and publicly available data).
Comparison of selected forms of rural tourism in large-scale protected areas

This master thesis deals with rural tourism in protected landscape areas. Its objective is a detailed analysis of the situation in the Šumava National Park and Blanský les Protected Landscape Area and evaluation of sustainable tourism as an aspect of rural tourism. In the introductory part key terms, such as national park, protected landscape area, countryside and thrifty tourism are explained. Practical part of the thesis uses managed interviews as a tool to evaluate business situation in both protected areas. The respondents were represented by individual businessmen who are doing business in model areas and employees of the administration of Šumava National Park and Blanský les Protected Landscape Area.

Sustainable use of natural resources in the Krkonoše Mountains National Park under climate change

The ongoing climate change and anthropogenic activities in the landscape can significantly influence the environmental values of the Krkonoše Mts. landscape and the resulting benefits for the humans. The paper presents selected partial results of the project, focused on the study of processes mentioned and mutual relations on the territory of the Krkonoše Mountains National Park. In particular, current problems and their causes were analysed in several key sectors related to the use of natural resources in the territory of the National Park – specifically agriculture, forestry, water resources, settlement structure and tourism. The topic is addressed using the DPSIR methodological framework whose individual components (socio-economic causes, pressures, state, profits and human responses) are quantified using a set of data available between 1991 and 2015. The development of the monitored indicators is expressed using an index of change, comparing the state at the beginning and the end of the given period. Based on the assessment of the development of individual DPSIR components, then it is possible to describe the trajectory of changes in the sub-sectors and to propose appropriate adaptation measures. The overall situation in water resources utilization can be described as rather positive, with a slightly improving trend. However, from the long-term point of view it will be necessary to realize measures to increasing water retention capacity of the landscape and maintain water consumption of big consumers, especially water for snowmaking of ski slopes.\n\n
