The title of the thesis: Crime of murder and manslaughter under section 140, 141 of the Criminal Code Abstract: This master's thesis focuses on the analysis of the crimes of murder and manslaughter under sections 140 and 141 of Act No. 40/2009 Coll., The Criminal Code. The aim of this work is a comprehensive analysis of both of these crimes and their differentiation in judicial practice, utilizing available professional literature and case law. The thesis is structured into four chapters. The first chapter describes the historical development and gradual changes in the regulation of intentional killings, ranging from the period of the first Czechoslovak Republic to the adoption of the current Criminal Code. The second chapter is dedicated to the analysis of intentional killings under the current legal framework, specifically the crimes of murder and manslaughter. These crimes are characterized in the thesis by the elements of their factual constitutions, which are thoroughly examined. The chapter distinguishes between simple murder and premeditated murder. Methodology of murder investigation with the focus on the use of trace evidence Abstract The thesis deals with the investigation of murder as one of the most serious forms of crime. After a general definition of the investigative methodology, the text focuses on the issue of trace evidence and its use in criminal proceedings, including potential challenges associated with it. Firstly, the current legal regulation of homicides in the Czech Criminal Code is briefly discussed. This is followed by a section devoted to statistics on the number of registered murders and the clearance rate, which are compiled annually by the Police of the Czech Republic, with a brief commentary. The investigative methodology of murder is initially introduced in general terms, followed by a description of its selected components. Attention is focused on the crime scene examination process, the examination of the corpse and the forensic autopsy, as these are crucial initial tasks through which police authority obtains valuable information. The remaining parts of the thesis focus on the forensic specifics of trace evidence, its collection and examination, interpretation, and procedural value, with emphasis on some of its limits. The main title of the doctoral thesis - ART/CRIME - CRIME/ART - point to a general investigation of these two phenomenons. This investigation makes up the background of the main theme of the thesis, which is an actual event of the mysterious death of the painter and shepherd K.. At work I spend time with alternative investigations of this death and the goal is an attempt to reconstruct the events and effort of discovering the answers what happened that night and whether or not a killer really existed or not.

Methodology of Investigation of Murders Abstract This thesis examined methodology of investigation of murders. As this is a very broad topic, the focus was on selected aspects of the investigation methodology. The introduction of the thesis was devoted to murder from the perspective of law and its comparison with the crime of killing and murder of a newborn child by the mother. The nuances that differentiate them are discussed there. The second chapter focuses on the criminological characteristics of murder. It provides the reader with an insight into the characteristics of the perpetrators of murder and who the victims most often are. The following chapters deal with the individual components of the methodology itself. They describe typical clues as well as investigative situations that criminologists most often encounter in practice. Attention is also paid to the methods of crime scene examination, examination of a corpse and forensic examination. PROBLEMS OF INVESTIGATION OF STAGED HOMICIDES Abstract The presented diploma thesis deals with the issue of investigation of staged homicides. The primary aim of the thesis is to point out the specifics and problems that investigation of staged homicides entails. The thesis places particular emphasis on the unusualness of the crime scene search that comes with the investigation of staged homicides, then on the importance of use of the forensic expertise, and, finally, on selected problems related to this type of investigation. In addition, the thesis aims to confront the theoretical part with practical knowledge obtained from people participating in the investigation. Furthermore, the thesis also aims to provide an evaluation of the current practice. The thesis consists of seven chapters apart from the introduction and conclusion. In the first chapter, the concept of staging is generally defined, and further attention is paid to homicide staging and reflection on foreign studies. Methodology of Investigation of Murders Abstract Methodology of invecstigation of murders includes criminologistic characteristic of a murder and also a proces of investigation of murders and another crimes aganinst life by a law enforcement agency. The title of the thesis: Crime of murder and manslaughter under section 140, 141 of the criminal code Abstract: This thesis focuses on the offences of murder and manslaughter under sections 140 and 141 of Act No. 40/2009 Coll., The Criminal Code. The crimes of murder and manslaughter are classified among the most serious crimes against life and both of these crimes can be subsumed under the broader term of intentional killings. The aim of this thesis is to provide a comprehensive analysis of the crimes of murder and manslaughter, with particular emphasis on demonstrating the fundamental differences between these offences and also what makes the offence of manslaughter a privileged offence over the offence of murder. The aim of this thesis is also, among the other things a brief excursion and comparison of the differences between the domestic legislation of these offences and the English legislation. The first part of the thesis deals with the development of the legal framework of intentional killings in the Czech Republic from the time of Great Moravia until the adoption of the current Criminal Code.
