Termination of the employment relationship with particular emphasis on the notice of termination

The purpose of my thesis is to provide a summary of the legal regulation and points out legal problems connected with the employment relationship termination. It provides a comprehensive description and an evaluation of the impact of the legal regulation on a common life of a personal/legal entity. Legislation is explained not only in terms of labor law contained in the Labor Code but also with regard to other legislation dealing with the various legal institutes. The thesis is composed of seven chapters, the introduction and the conclusion. Chapter One is introductory and defines basic terminology used in the thesis: the term of employment relationship, the subject, the object and the content of the relationship. The interpretation is essential for understanding the following chapters relating directly to the termination of employment relationship. Chapter Two examines relevant Czech legislation, and deals with the specific methods of termination of employment which are further divided into: legal acts, legal events and the termination of the relationship on the basis of official decisions and the termination of the relationship in some specific cases. Employee's liability for damage caused to the employer Abstract My rigorosum thesis deals with the issue of "Employee's liability for damage caused to the employer". My main motivation to choose this topic is to the fact because it is connected with every individual of working age, exactlier said - with every employee. Legal regulation of employee's liability for damage caused to the employer undoubtedly belongs to the most important areas of labour law. The above mentioned issue is highly topical. The high topicality is presented by a high number of judicial decisions of courts of all instances. It is clear that not only in the judicial decisions of general courts but also in the judicial decisions of the Supreme Court of the Czech Republic dealing with the employee's liability for damage caused to the employer is increasing. In my rigorosum thesis I focus first and foremost on the analysis of legal regulation of employee's liability for damage caused to the employer as well as on the closest legal matter connected with the main issue of this rigorosum thesis. Termination of employment in relation to the recodification of private law Abstract My rigorosum thesis deals with the "Termination of employment in relation to the recodification of private law". I have chosen this topic mainly because it is connected with every individual of working age regardless of whether the individual is an employee or an employer. Legal regulation of the termination of employment undoubtedly belongs to the most important spheres of labour law. The issue is highly topical. That fact is presented by a high number of judicial decisions of courts of all instances. It is necessary to remark that the number of judicial decisions of the Supreme Court of the Czech Republic dealing with the termination of employment is increasing. In my rigorosum thesis I focus first and foremost on the analysis of legal regulation of all ways of termination of employment - especially legal acts - i.e. an agreement to terminate employment, notice of termination of employment, instant termination of employment and termination of employment during the probationary period. Commencement of basic employment law relationship - comparison of the Czech and German legal regulation

This text aims on providing of analysis of the content of the rigorous thesis. The thesis deals with the topic of commencement of basic labour relations and its comparison with the German legal regulation. Therefore it is divided into three parts. The first part closely focuses on the commencement of basic labour relations according to the valid Czech law. The second part describes the commencement of labour relations according to the valid law of the Federal Republic of Germany. The third part compares and contrasts both legal regulations. The first part is the most extensive. It describes the historical development of labour law in general, its sources as well as its incorporation into the legal system of the Czech Republic. Furthermore, it defines labour relations, basic labour relations and commencement of labour relations with regard on the extended recodification of the private law. The second part which describes the German legal regulation, conceptually follows on the previous part. The author adhered to the terminology of German labour law and to the description of commencement of labour relations according to German textbooks. The third part is the shortest and it compares and contrasts the similarities and the differences between the Czech and German legal regulations.
A Job Seeker and the Labour Office of the Czech Republic

A Job Seeker and the Labour Office of the Czech Republic Abstract The PhD thesis focuses primarily on the legal regulation of the Employment Act affecting the issue of job seekers within the activities of the Labour office, especially in the process of employment intermediation and in receiving unemployment benefits. The introductory theoretical interpretation of the fundamental social right guaranteed by the Charter of Fundamental Rights and Freedoms, i.e. the right to work, is followed by a treatise on unemployment and its development. A compact overview of this issue is given by a summary of the concept of employment policy in the Czech Republic and within the European Union and its state management within the Czech Republic. The main part of the thesis presents an analysis of individual provisions of the Employment Act from the practical point of view of the job seeker. It defines his rights and obligations starting by submitting an application for mediation of suitable employment to the Labor office register. These are discussed in detail in relation to the main instruments that the job seeker may encounter during registration, such as "appropriate employment", "serious reasons", "temporary incapacity to work", "non- conflicting employment", "illegal work", etc. The thesis contains a detailed analysis...
