Rigorózní práce se zabývá skončením pracovního poměru se zvláštním důrazem na výpověď z hlediska právní úpravy České republiky. I přes rozsáhlou soudní judikaturu vyvolává problematika skončení pracovního poměru nejasnosti zejména u laické veřejnosti, jejímž důsledkem je nesprávná aplikace zákona. Zmíněné obtíže pří používání pracovněprávních předpisů jsou dány mimo jiné množstvím novelizací zákona č. 262/2006 Sb., zákoníku práce, přičemž svůj podíl nese rovněž nález Ústavního soudu ze dne 12. 3. 2008, sp. zn. Pl. ÚS 83/06, který přinesl řadu zásadních změn do koncepce pracovního práva. Považuji znalost právní materie skončení pracovního poměru za nezbytnou, a proto jsem se rozhodla v této práci shrnout současnou právní úpravu, zdůraznit některá obtížně uchopitelná ustanovení zákoníku práce, stejně tak jako nastínit možný budoucí vývoj pracovněprávních norem. V této práci se opírám o ustálenou soudní judikaturu, která vhodným způsobem osvětluje danou problematiku. Rigorózní práce je rozdělena do 7 kapitol, které jsou dále podrobněji členěné. První kapitola se zabývá obecným výkladem pojmu pracovního poměru včetně jeho prvků. Druhá kapitola podrobně rozebírá jednotlivé právní skutečnosti vedoucí ke skončení pracovního poměru včetně zahrnutí specifické úpravy skončení pracovního poměru založeného... The purpose of my thesis is to provide a summary of the legal regulation and points out legal problems connected with the employment relationship termination. It provides a comprehensive description and an evaluation of the impact of the legal regulation on a common life of a personal/legal entity. Legislation is explained not only in terms of labor law contained in the Labor Code but also with regard to other legislation dealing with the various legal institutes. The thesis is composed of seven chapters, the introduction and the conclusion. Chapter One is introductory and defines basic terminology used in the thesis: the term of employment relationship, the subject, the object and the content of the relationship. The interpretation is essential for understanding the following chapters relating directly to the termination of employment relationship. Chapter Two examines relevant Czech legislation, and deals with the specific methods of termination of employment which are further divided into: legal acts, legal events and the termination of the relationship on the basis of official decisions and the termination of the relationship in some specific cases.
