Trestný čin krádeže podle § 205 trestního zákoníku Tématem této diplomové práce je právní úprava trestného činu krádeže podle § 205 trestního zákoníku. Cílem této diplomové práce je provést analýzu účinné české právní úpravy trestného činu krádeže v trestním zákoníku, přičemž současně si autor klade za cíl v přiléhavých případech právní úpravu podrobit kritickému hodnocení, a případně navrhnout její změny. Zároveň je cílem této práce provést analýzu rozhodovací praxe soudů v období nouzového stavu během pandemie COVID-19 pomocí vybraných relevantních rozhodnutí, a případně jí také podrobit kritice. Posledním cílem této práce je provést komparaci právní úpravy trestného činu krádeže podle českého trestního zákoníku a podle trestního zákoníku Spolkové republiky Německo s cílem identifkovat zásadní rozdíly v jejich úpravě. Diplomová práce je členěna do čtyř samostatných kapitol, přičemž jednotlivé kapitoly se dále člení na podkapitoly, s výjimkou kapitoly první. Kapitola první tvoří úvod do celospolečenské problematiky fenoménu krádeže. Tato kapitola stručně vymezuje význam a postavení trestného činu krádeže ve společnosti s přihlédnutím k historické genezi. The crime of theft according to section 205 of Czech criminal code Topic of this diploma thesis is the legislation of the crime of theft according to section 205 of the Czech Criminal Code. The aim of this diploma thesis is to conduct an analysis of the currently effective Czech legislation of the crime of theft in the Czech Criminal Code and at the same time subject legislation in fitting cases to critical evaluation or else propose it's modification. Simultaneously the aim of this thesis is to conduct analysis of the judicial practice in time of the state of emergency during COVID-19 pandemic using selected relevant judgements and alternatively subject it to criticism. Final aim of this thesis is to compare the Czech legislation of the crime of theft in the Czech Criminal Code to legislation of the crime of theft in the German Criminal Code with the aim to identify their main differences. Diploma thesis is divided into four separate chapters where individual chapters are further divided into subchapters except the first chapter. The first chapter forms introduction into social problems of the theft phenomenon.
