Porušování zákona o zaměstnanosti Abstrakt Cílem a účelem této disertační práce bylo v kompaktním a souvislém rozsahu popsat jednotlivé druhy porušení právních předpisů v návaznosti na jejich důsledky pro jednotlivé subjekty, vůči kterým negativní dopady směřují. Práce na základě současné zákonné úpravy oblasti zaměstnanosti rozděluje porušování povinností do jednotlivých oblastí, které se dále dají rozdělit podle subjektů porušujících povinnosti a závažnosti jednotlivých porušení. Problematika porušování zákona o zaměstnanosti v sobě zahrnuje dvě zásadní oblasti. První oblastí, vlastní většině hmotněprávních předpisů, je ta přestupková, reagující primárně na porušování povinností ze strany zaměstnavatelů. Na tuto oblast je zaměřena zejména třetí, pátá, a šestá kapitola. Druhá oblast zákona o zaměstnanosti vzhledem k jeho povaze a účelu upravuje a zakotvuje řadu povinností pro fyzické osoby, zájemce o zaměstnání a zejména uchazeče o zaměstnání, kteří prostřednictvím úřadu práce realizují své základní sociální právo garantované Listinou základních práv a svobod, tedy právo na práci. Na tuto oblast směřuje kapitola druhá a dále částečně kapitola čtvrtá a šestá. K této oblasti, s ohledem na obtížnou sociální situaci, ve které se uchazeč o zaměstnání nachází, je pak nutné přistupovat velice citlivě k případnému... Violation of the Employment Act Abstract The purpose and aim of this dissertation work was compactly and coherently to describe the individual types of violations of legal regulations in relation to their consequences for individual entities against whom the negative impacts are directed. The work, based on the current legal regulation of employment, divides the violations of obligations into individual areas, which can be further broken down by entities violating obligations and (by) the seriousness of individual violations. The issue of violation of the Employment Act includes two fundamental areas. The first area, which forms an inherent part of most substantive regulations, is the area of administrative offenses, responding primarily to violations of obligations imposed upon employers. Especially the third, fhe fifth and the sixth chapter focus on this field. The second area of the Employment Act, which is vital for the topic at hand, regulates and sets obligations for individuals, persons interested in the job and especially job seekers who, through the Labour Office, exercise their basic social rights guaranteed by the Charter of Fundamental Rights and Freedoms, i.e. the right to work.
