1 Ochrana a trvale udržitelné užívání lesa z právního pohledu Abstrakt Hlavním cílem disertační práce je zpracovat ucelený rozbor základních pramenů právní úpravy ochrany a trvale udržitelného užívání lesa, identifikovat hlavní nedostatky stávajících nástrojů a možnosti překonání těchto nedostatků do budoucna na úrovni mezinárodní, Evropské unie a České republiky. Disertační práce se nejprve zabývá významem komplexních funkcí lesů, jejichž prostřednictvím jsou uspokojovány ekonomické sociální, ekologické, kulturní a duchovní potřeby celé společnosti a jsou nenahraditelné pro veškerý život na Zemi. Právní úprava by tak měla usilovat o zajištění rovnoměrného užívání jednotlivých funkcí lesa a to prostřednictvím prosazovaní principů trvale udržitelného hospodaření v lesích, ochrany jednotlivých funkcí lesa a obecného užívání lesa společností. S ohledem na tento význam lesů přesahující hranice jednoho státu se disertační práce zabývá i postavením lesa jako přírodního zdroje, na který mají zásadní vliv zásady a principy ochrany životního prostředí, přičemž ke zvýšení odpovědnosti států za ochranu lesa by napomohlo nahlížet na lesy jako na přírodní zdroj "společného zájmu", jehož ochrana je zajištěna v rámci konceptu konceptu "opatrovnické suverenity" států. Ve vztahu k mezinárodní úrovni je disertační práce... 1 The protection and sustainable use of forests from the legal point of view Abstract The main goal of the dissertation is to provide a comprehensive analysis of fundamental sources of legal regulation of forest protection and sustainable use of forests, to identify main shortcomings of existing instruments and the possibilities to overcome these deficiencies in the future at the international level, European Union level, and the level of the Czech Republic. The dissertation deals first with the significance of the complex forest functions, through which the economic social, ecological, cultural and spiritual needs of the whole society are satisfied and are indispensable for all life on Earth. The legal regulation should strive to ensure the balanced use of forest functions by promoting the principles of sustainable forest management, the protection of forest functions and the general use of forest by the public. In view of the importance of forests beyond the borders of a state, the dissertation deals also with the status of the forest as a natural resource, which is fundamentally influenced by the principles of international and environmental law.
