Harmonisation of law and economic measures in the area of supervision over commercial banks

Resumé This diploma thesis deals with harmonisation of law and economic measures in the area of supervision over commercial banks. It is focused on changes that were made in area of regulation and supervision and their legislation during the last several years. Another purpose of this thesis is evaluation of reforms that are proposed as an answer to the last financial crisis, which influenced many economic systems all over the world. In introduction I explain why the regulation and supervision of the commercial banking are so important these days, what are the reasons for changes in the legislation and also I analyse different levels of lawmaking and influence of such. Next I deal with differences between regulation and supervision and common methods of them, for example a minimum capital requirements, a financial reporting and others. The second chapter concentrates on evolution of the regulation in the Czech republic, but also on the international level and also with the european legislation and its transposition in Czech law system. Modes of termination of employment

The ways to terminate the employment relationship The purpose of my thesis is to analyze the ways to terminate the employment relationship. The thesis deals with the theme of the termination of employment relationship in aspect of the legal regulation of the Czech Republic and compares the ways to terminate the employment relationship with the Slovak legislation. The thesis is composed of six chapters. Chapter One is introductory and defines basic terminology used in the thesis. Chapter Two deals with various ways of termination of employment, such as the termination of employment relationship by agreement, by notice, by immediate termination, by termination within probationary period. The termination of employment relationship by agreement is a bilateral legal act, in which an employee and employer agree on the termination of the employment relationship, the employment relationship shall terminate upon the agreed day. An employment relationship may be terminated by giving notice on the part of the employer or employee. Notice must be given in writing and delivered to the other party, or otherwise it shall be invalid. Civil Society in Non-Democratic Regime. Analysis of Civic Groups in Current Burma and Their Relation towards the End of Military Goverment

Since 1962, Burma (Myanmar) has been under the rule of a military junta, which, through the extensive state and military apparatus, forms one of the most repressive regimes in the world today. In spite of, or rather because of the authority of the authoritarian regime, hundreds of associations with a variety of social, economic and political goals have been emerging in the country in recent years. The existence of numerous associations under authoritarian rule is a rather new phenomenon which has aroused contradictory views among observers - hopes for the formation of civil society struggling for liberalization on the one hand, and fear that the associations are just another of the regime's tools to manage people's lives on the other. On the basis of a qualitative analysis of various organizations, movements, parties and groups in current-day Burma, this thesis aims to explain that neither of the aforementioned views alone can depict the complexity of associational life under the authoritarian regime, but rather that both roles must be viewed as an intrinsic and mutually-interacting part of it. This thesis deals with the common property of spouses in case of business activities of one of the spouses. First chapter defines marriage and other related issues. Second chapter is the analysis of legal regulations of property relations between spouses since the days of Rome up to the present day, which influenced up-to-date legal regulations. Third chapter deals with the forms of ownership in marriage. Last chapter is about the most important issue of the thesis - common property of spouses and business activities. This chapter deals especially with the object of common property of spouses and with the possibilities of its modification.

Modes of termination of employment

In my graduation theses I focused on the ways to terminate the employment relationship.I enforced chracteristics of each way of the termination and legal possibilites for using it.I mentioned the differences between present - day legal regulations end previous legal regulations. I engaged in specific changes of termination of the employment relationship brought by the present Labour Code in the area of legal regulations, as in the part concerning applicable legal regulations, so in the part defining individual ways of termination of the employment relationship. In the conclusion of this graduation theses I would like to focus on the Labour Code especially with the view of what improvements or on the contrary impairment has brought in the area of legal regulations in termination of the employment relationship on the part of employers and employees. Next I would like to mention several conceptual changes in the Labour Code, which are being prepared by ministry of labour and social affairs. In content of this I would like to introduce some of my de lege ferenda considerations. The Labour Code of 2006 was accepted embarrassedly since its release. Quality assessment of products - Environmentally Friendly Products

In my thesis I would like to show how to reduce negative impact on the environment that is caused by for example corporations. I insist on the system of ecolabelling in the Czech Republic. But I also pay attention to others voluntary instruments of environmental policy (to concrete the situation I will mention the most important legal standards about environmental legislation, that enable at least a bit of protection of the environment). The basic quiestion and goal of my thesis is to find out, in which aspects the "common" products has changed their character, what is their development that we could call them these days "environmentally friendly" products, where is their "friendship". Other important thing is to tell which groups of products I will judge: paper, environmentaly friendly cars, detergents.

The influence of the tax practice of the courts on the assessment of a tax and the retrospective assessment in the Czech Republic

This thesis was focused on the influence of the tax practice of the courts on the assessment of a tax and the retrospective assessment in the Czech Republic. The purpose was to find out if the present law about the tax and fees administration is a sufficient procedural tax norm and if the existing practice of the courts provides us by its interpretation and integral attitude with reasonable juristic certainty of the tax subjects as well as the tax administrator when in the assessment of a tax and retrospective assessment process. Furthermore the new procedural norm which is just being approved these days in law area was examined: if it brings more suitable legal regulations in the selected areas and if it takes into account the conclusions of the practice of the courts. Finally the conclusions which confirmed expectations in the beginning of this thesis were made. The tax administration law can't act as the basic tax norm because its actual reading contains too many deficiencies. Thereunto from the downright analysis arises that the practice of the courts, which is disunited in its resolutions, for ensuring the integral and right procedure of tax assessment and retrospective assessment can't act. The present situation could be improved by coming into enter be of the new procedural tax law -- The Tax Regulation.

Analysis of Cross-border Mergers on the Czech Market in the Period 2018-2015

This Master's thesis concerns cross-border mergers on the Czech market. The aim of the thesis is to identify their main trends. Though the theory of both cross-border and domestic mergers is mentioned, the emphasis is placed on the analytical part. The analysis is based on real life data of mergers which were realized from 2008 till 2015 and in which a Czech company took part. The research focuses on the development of quantity and type of cross-border mergers whose project was filed in the public register, quantity of finished mergers, number of participating companies and the country under whose legal system the participating companies operate, the position of Czech companies, ownership structure of participating companies, their legal form, reasons for realization of mergers, exchange ratio, decisive day assessment in relation with the balance sheet date and processing time of a cross-border merger.
