Co-ownership of a unit - administration of a building and tract of land

The Diploma thesis focuses on the current legislation of residential co-ownership, especially of administration of a building and tract of land. Its content is divided into two parts. The aim of the first part of the thesis is to present fundamental interpretation of an institute of residential co-ownership which is one of the types of co-ownership with a large number of specifics. The thesis includes also an outline of its historical development, an analysis of conceptual theories of residential co-ownership and explanation of essential terms of the institute. As one of the most important terms is considered the term unit. For correct understanding the thesis explains also other terms which the legislation of the unit expressly operates with. The relevant examples are the terms flat, commercial premises, building and tract of land and share of a building and tract of land. The first part of the thesis serves to obtain fundamental information about an institution of residential co-ownership and its essential elements that will be used during a deeper research in the second part. Tenancy spouses and use of the flat spouses in a new arrangement after January 1, 2014

The thesis is devoted to the topic of tenancy by the spouses, and its use as is specified in the new adaptation of the Civil Code no. 89/2012 Coll. It replaced until functioning Civil Code from the year 1964. The new legislation is specified series of new institutes, whose primary aim is to protect the weaker party, in the case of tenant. The diploma thesis was divided into theoretical and practical part. In the theoretical part, was attention paid to basic concepts which have been defined. There were characterized rights of tenant and landlord, analyzed housing legislation according to the new Civil Code. The practical part was devoted to the interpretation of survey results. There were approached tenants of several apartment buildings in Kralupy nad Vltavou. Based on the findings, were designed some recommendations to raise awareness about the rights and responsibilities of tenants, as well as about the whole issue of housing legally.

Flat owners association

This thesis is focused on the ownership of flats in the Czech Republic, which from
1.1. 2014 is governed by Act no. 89/2012 Coll., Civil Code, as amended, focusing on the
specific type of legal entity, which is the apartment owners.
The theoretical part is an analysis of the basic characteristics of the flat owner
association, it describe its main activity, the formation and cessation, the power of
statutory authorities and finally the rights and obligations of its members. This thesis is
focussed on the changes introduced by the new civil code.
The practical part is devoted to the the analysis and evaluation of the survey results with
the objective to find out how the flat owners association works in reality in a specific area.
The focus was on the most frequent problems they face and an indication of the possible
solutions. Further the thesis also points out the most common errors that occur in the
appliocation of the new civil code no. 89/2012 Coll.

Taxation of Housing Associations

This bachelor’s thesis focuses on the taxation of housing associations. In the theoretical part introduces the legal rules of a legal entity - the association. Analyzes the situation occurred in a housing association after its inception. The practical part presents a comparison of tax treatment of profit (cooperative) and NGOs (flats owners association). The final chapter recommends to the tenants of residential buildings more advantageous legal form for establishing a legal entity in terms of tax on corporate income.

In my Thesis I focus on problems about international guidelines in Byt a servis, družstvo Olomouc. In first part I deal with bacis concepts like international guidelines and their partition, characteristic home owners association and cooperative. In second part I will do basic analysis about company and current status of international guidelines, which has company processed and about their quality. In conclusion of my thesis I suggest treatment of lacks and design a missing international guidelines.

Technical Assessment of Building

In my diploma thesis I am trying to explain a technical assessment from the legal, accounting, tax perspective and determine the value of technical assessment of building in CZK. The theoretical part is devoted to a description of a technical assessment and its legal rules. The practical part is focused on two specific projects: a shopping centre and a block of flats. It contains the budgets of these projects and determination of the extent of a technical assessment for individual objects.

Financing of the Revitalization of a Block of Flats

This master thesis deals with the financing of the revitalization of a particular block of flats in Brno. The thesis contains process of reconstruction, comparison of supplier´s offers and bank credit products and return on investments. Based the selection criteria, analysis and calculations is chosen optimal supplier and bank institution. The result of this thesis is a proposal for the flat owners association how to efficiently finance revitalization.
