Resüme Titel: Die Zuständigkeit der Gemeinden Das Hauptziel dieser Diplomarbeit besteht darin, die Zuständigkeit der Gemeinden in der Tschechischen Republik zu beschreiben. Die heutige gesetzliche Regelung schließt sich seit 1990 wieder an die ehemals Ősterreichisch-Deutsche kommunale Tradition des gemischten Vollzugs der öffentlichen Verwaltung an. Nach einer nötigen kontextuellen Einführung (in der Form der Abgrenzung des Begriffes der "Zuständigkeit" und in der Form eines kurzen historischen Exkurses des Verlaufs der gesetzlichen Regelung bis zum Jahr 1990), folgt das Kapitel über den übertragenen Wirkungskreis der Gemeinden. Das Ziel dieses Kapitels ist die Verankerung dieser Zuständigkeit innerhalb der Rechtsordnung der Tschechischen Republik, ihre Prinzipien und ihre Funktionieren zu zeigen. Der eigene Schwerpunkt dieser Arbeit ist in den Kapiteln zu finden, die den eigenen Wirkungskreis der Gemeinden beschreiben. Erst beschäftigt sich die Arbeit mit der verfassungsrechtlichen Verankerung und mit dem Vergleich des Rechts auf die Selbstverwaltung in der Tschechischen und Deutschen Rechtsordnung. Competencies of the General Meeting of a limited liability company

This thesis deals with competencies of the General Meeting of a limited liability company in the Czech legal order. At the first place its aim is to define the term competencies of the General Meeting. The next main task is an in-depth analysis of each issue that falls within the competencies. The attention is concentrated predominately on how decisions about the issues concern the General Meeting as the highest body of the limited liability company, i.e. which requirements, procedures and limitations have to be complied with according to the law. The intent is to point out all the areas within the subject matter of this thesis that are ambiguous or the areas without any consistent view on them for any reason including providing with my own commentary or opinion of a possible solution. The essential part of the thesis is an analysis of a current practice of higher courts of the Czech Republic related to the subject matter of the thesis. ! 69! Internet Law - Master Thesis Abstract This study explores and describes the discipline of Internet Law as well as the problems arising from applying its jurisdiction. Furthermore, it deals with liability limitation in the on-line world and presents various tendencies in the development of the Internet Copyright Law in the Czech Republic, USA and France. This study is divided into two main chapters. The first one deals with the theoretical and philosophical foundations of the Internet phenomenon and the second focuses on practical aspects of the on-line legal regulation. The tendencies in interpretation and application of the legislature are presented through important case studies. The research strategy for this thesis was data gathering followed by its analysis. Providing examples of local legislature (Czech, USA, French) together with presentation of corresponding case studies I was searching for the keys for interpretation and application strategies of this relatively young and dynamically developing field of law. The study's objective was to find answers to the following two questions: a) Is there a general need for the Internet legal regulation? Competencies of General Meeting of limited liability company The purpose of my thesis is to analyse competencies of a general meeting of a limited liability company, show different theoretical opinions and present my own ideas. I have chosen this topic because the limited liability company is the most common type of business entity in the Czech Republic and so I find this topic useful. The thesis is composed of Introduction, four chapters and Conclusion. Introduction defines aims and methods of this thesis. First general chapter is followed by three chapters, each of which dealing with different aspects of general meeting's competence. Chapter One is introductory and defines basic terminology used in the thesis. This chapter is subdivided into five parts. Part One describes the limited liability company and explains basic characteristics of this type of business entity set out by the Czech Commercial Code, No. 513/1991 Coll., as amended (hereinafter referred to as the ,,Commercial Code ). The scope of the Administrative Procedure Code Abstrakt The Administrative Procedure Code as a code of activity of public administration is not a novelty in our legal system, but perhaps that is exactly why it is appropriate to consider how far its scope of application extends. Although the definition of the scope of the Administrative Procedure Code is regulated in the first section of the Act, a closer examination will probably reveal many ambiguities or doubts as to how far its limits extend. And it is precisely the detailed breakdown of the circumstances to which the Administrative Procedure Code is applicable and under what conditions it will apply, which I have set as my goal of this rigorosum thesis. The scope of the Administrative Procedure Code can be examined from two points of view. The first of them is the material definition of the scope of the Administrative Procedure Code, that is, the definition of public administration as such, the evaluation of individual forms of its activities, the subsequent evaluation, in which cases the Administrative Procedure Code is applicable. The applicability of criminal law statues (abstract) The submitted thesis is focused on the applicability of criminal law statutes and aims to summarize the current legislation regarding the applicability of criminal law statutes, assess its current state, draw attention to any legislative gaps and propose possible de lege ferenda changes. The usual focus of university textbooks might suggest the applicability of criminal legislation is a matter more or less brief, which does not require a special level of attention. However, the opposite is true. The applicability of criminal legislation is a rather broad and diverse topic, its legal framework can be found both in substantive and procedural law, as well as in regular law, constitutional law and law of international treaties. A detailed theoretical research and the solution of individual cases uncovers a number of subquestions, not only in criminal law, but also in a number of other areas of law. There are four basic aspects of applicability: temporal, territorial, personal and subject matter. Every single one of those has a rich history in theoretical, statutory and case law development. Czech Environmental Inspectorate

This thesis addresses the problem of Czech Environmental Inspectorate and the general protection of the environment. I focus on the history of the protection of the environment, both at international, European and national. Further, I develop inspections in our area and grounds of Inspection, its scope (both substantive and territorial) and its competence in all major components. For comparison, I also deal with environmental protection in other European countries (I chose two Western European countries, which have a relatively long history of environmental protection). Most, however, devoted to the performance of supervision, both in general and specifically as one of the powers of inspection to all five areas. At the end of the deal by providing information and differences in process the individual laws. The aim is to introduce the reader to general environmental protection, and especially with the functioning of Inspections and its importance.
