Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.
Hacktivism: Politics, Crime, or Fun?

Cílem této bakalářské práce je zanalyzovat fenomén zvaný hacktivismus, jeho význam, dopady na společnost a motivaci jeho aktérů. Termín hacktivismus se skládá ze dvou následujících termínů; aktivismus, který bývá ve většině případů politicky motivovaný a hacking, jenž se jedná o kriminální činnost za účelem zneužití chyby nebo nedokonalosti výpočetního systému. Za účelem efektivního dosažení svého cíle, se aktéři hacktivismu, stejně jako jiní aktivisté, většinou organizují do skupin. Práce je též zaměřena na motivaci a následky konání těchto organizovaných skupin, zejména na skupinu s názvem Anonymous, s exemplárními příklady jejich akcí z minulosti.

This thesis is focused on cybercrime, acquisition of evidence and development of a platform for retrieval, analysis and archiving web site data. The goal is to satisfy the investigators and security experts of the Czech police. The aim is to provide an open source platform that will be freely disseminable and in compliance with the requirements of legal institutions. The output of the thesis is two platform versions - full-fledged, fulfilling all the requirements set out in the diploma thesis and a light version for the police investigators of the Czech Republic.

Tato bakalářská práce pojednává o formě počítačové kriminality, která využívá škodlivý software zvaný malware. Nastiňuje základy počítačových bezpečnostních hrozeb a vysvětluje relevantní pojmy a koncepty. Poté práce postupuje přes nejběžnější a nejnebezpečnější typy malwaru, přičemž každý z nich popisuje a zároveň začleňuje informace o tom, jak konkrétní druh malwaru ovlivnil svět. Práce se dále zabývá základy detekce malwaru a popisuje, jak se uživatelé mohou chránit pomocí preventivních technik. Cílem práce je vytvořit manuál, který by mohli použít běžní uživatelé počítačů ke své vlastní ochraně před malwarem.

This bachelor thesis aims to analyse the DARKNET with focus on forensic research. This paper describes a variety of illegal actions which occur in the DARKNET and possible form of their forensic research. A forms of identification of the illegal actions, possibilities of their documentation and analysis of the identification of the perpetrator are suggested. By the suggested methodology is designed a cybercrime solution, which can be used by the authorities active in the criminal proceedings.

67 Criminal-law aspects and criminological aspects of ransomware spread Abstract The thesis deals with the ransomware spread and its exploration from the perspective of criminology and substantive criminal law. This theme is still relevant as ransomware is still a highly used form of cybercrime, whose method of execution is being constantly improved by the perpetrators. The theme is further relevant because this form of cybercrime is also used as a form of waging war against another state, as may be seen e.g. in the increasing number of cyber-attacks incurring in connection with the current war between Ukraine and Russia. The first part of this thesis defines the term ransomware and then briefly describes the history of this type of cybercrime. This part further describes the different types of ransomware currently recognized by the professional community. Current trends in the ransomware spread are also outlined. The second part discusses the criminological aspects of ransomware, focusing primarily on explaining the ransomware spread by the criminological theories, examining the personality of the perpetrator and the victim from a criminological perspective, and exploring other criminological aspects of ransomware. 1 Thesis title, keywords and abstract Thesis title: Sexually motivated cybercrime Keywords: cybercrime, virtual child pornography, sexting, pornographic performances, cyber grooming, sexual solicitation of children This master thesis deals with the issue of cybercrime against persons more specifically with sexually motivated crimes. The thesis is divided into five separate chapters. The first chapter deals with cybercrime in general, its taxonomy and the necessary terminology, it also describes some of the criminogenic factors of cybercrime relevant for the issue. The second chapter presents the most important applicable international legal instruments. The third chapter describes the issue of illicit pornography especially child pornography. For the subsequent chapters the author's own taxonomy was used and they overlap in part. The fourth chapter explores the phenomenon of sexting and the use of web cameras for sexual purposes as a consensual activity. In the fifth chapter the misuse of these activities for the purposes of child grooming, extortion and commercial sexual exploitation of children is examined. Criminological aspects of cybercrime Abstract (EN) This thesis is a study of specific aspects of cybercrime in regards to banking and non- banking financial institutions in Czech republic. By comparing results of third-party analytical resources and own findings obtained by strategically performed interviews with personnel in leading positions in cyber-security careers, the thesis describes causes and results of cyber-attacks and related preventive measures with emphasis on their respective place and priority in the cybersecurity policy of the organization. The main finding is that the biggest risk to the organization seems to be its own employees. That is why the entity cannot simply trust in the security of its perimeter by protecting only its border, but has to also consider its internal part. An equally important finding is the fact that mechanisms for the prevention of cybercrime take a large number of non-mutually exclusive forms, and in order to maintain the highest possible level of security, it is appropriate to layer these measures into complex units. Latent criminality

1 Latent criminality Abstract This submitted diploma thesis deals with the phenomenon of latent criminality. Latent criminality is the part of criminality that is for some reason not registered by the law enforcement authorities. The thesis itself consists of four consecutive chapters. The first chapter deals with the concept of crime. It discusses the different approaches to concept of crime in criminology and the indicators that are used to describe it. Furthermore, this chapter is dedicated to the division of crime into latent and registered crime and the sources of information about registered crime. In particular, it focuses on official crime statistics. In the second chapter, the issue of latent crime is discussed in more detail. It defines the concept of latency, in which cases it is considered being latent criminality and what its types are. Furthermore, the ratio of latent and registered crime, the rate and extent of latency are described. At the end the possible causes of its existence are presented, one of the main reasons being the failure to report the crime by its victims.
