Institutional context of stalking and barriers to its resolution based on victims' experiences

EN The aim of this thesis is to explore the institutional context and barriers to individual and collective efforts to address the phenomenon of stalking (in Czech "dangerous prosecution") through Interpretative Phenomenological Analysis (IPA). Drawing on feminist perspective, this qualitative study explores the shared social context in which the unique experiences are set, the approach of the security forces and the reactions of those around the victims. The outcome of this work is the identification and overview of systematic gaps that allow the phenomenon of stalking (and possibly other forms of gender-based violence as well) to persist in our society in its current form and extent. These gaps are an obstacle to cases being reprorted and properly addressed within the existing legislative system.
Criminal act of stalking and it's investigation

Thesis title: Criminal offense and investigation of stalking Abstract The presented rigorous thesis analyses a criminal offense of stalking in §354 provision and selected investigation issues of this type of criminal activity. This work consists of an introduction, four main chapters, and a summary. The first chapter defines the concept of stalking and its genesis. Then, the particular signs of stalking and basic views on the classification of the perpetrators are described. The case interpretation of some real cases of stalking follows. The second chapter is focused on the criminal offense of stalking. Firstly, from the point of view of its adoption in the legal order of the Czech Republic and its position in the system of the Criminal Code of the Czech republic. Subsequently, the individual features of facts of the case of stalking are subjected to examination with their summarizing analysis, and their positives and negatives are specified, followed by the proposal to amend the material provision. Chapter two is also addressing the relation to other criminal offenses and misdemeanors against civil cohabitation. This diploma thesis analyzes the phenomenon known as stalking. The psychological part is deals with the studies of two target groups of stalking - stalkers and their victims. I am pointing out especially the typology that can predict potential violence, and those that show means that limit, respectively stop stalker's conduct, such as effect of legal sanction or comply with medical care. I also examine, in detail, some legislations of Common law countries and the legislation of the Czech Republic. I focuse on civil, administrative and criminal means of legal protection against stalking.
The Crime of Dangerous Stalking under Section 354 of the Criminal Code

Resumé v anglickém jazyce The issue of this thesis is the crime of dangerous stalking, which is set out in section 354 of the Act No 40/2009 Coll., Criminal Code and which criminalizes behavior commonly known under the term of stalking. The thesis aims not only at clarification of the criminal-law aspects of this crime, but also at its presentation in a more complex approach. So the thesis is divided into three parts, which are comprised of seven chapters. The first part, which is comprised of first two chapters, deals with stalking and its victims. This part addresses both the contemporary concept and historical development of this pathological phenomenon, frequency of its incidence, its possible manifestation, impact on pursued individuals and risk, which follow to them from stalking. The second part, which is comprised of third, fourth and fifth chapter, deals with issue of the crime of dangerous stalking itself. This part addresses the process of its implementation in the Czech criminal law and also its criminal- law aspects. The issue of an offender's personality in criminology

A Abstract of the thesis "The Issue of an Offender's Personality in Criminology" Offender's personality is a summary of various aspects influencing one's behaviour in regards of a set offence. This paper focuses mainly on criminological and psychological aspects of people who commit violent crimes. It summarizes different typologies of offenders, schools of criminal causes, various aspects of personalities, and discusses prevention of criminality in the Czech Republic. In addition, it focuses greatly on stalking from theoretical as well as practical point of view through an extensive case study. The main foundation for this case study is a court case from early 2008, further anonymous due to request of the Municipal Court in Prague. Even though this case took place before stalking was recognised as a criminal offense in the Czech Republic, it served greatly as a foundation for its recognition, and thus plays a vital role. The main research questions of this thesis are a) "Why do people commit violent crimes?", and b) "What are the main intentions behind it?". With deeper understanding of the knowledge of offender's personality and motivation, findings of this paper can serve as a significant tool for prevention of criminal behaviour in society. Resumé The aim of this final thesis is to evaluate stalking - the phenomenon which gained infamy over the last few decades - and its legal definition. Stalking or "dangerous pursuit" (literal translation name of the Czech criminal offence of stalking) is also a new offence under Czech Criminal Code no. 40/2009 which was entered into force on the 1st of January 2010. The main goal of this newly introduced criminal offence is to cover the psychological and social phenomenon of the same name, stalking, and the main goal of this thesis is to critically assess whether this criminal offence, "dangerous pursuit", is successful in criminalizing the stalking phenomenon and whether its form is an effective instrument in fighting stalking. The thesis begins with a short overview which aims to unveil the main ratio behind the call for a legal regulation of stalking. Then a psychological and social peek into the depths of this phenomenon follows (encompassing some of the most widely used typologies and even some clinical opinions on punishing and treating stalkers), which allows to critically evaluate the efficiency of that new criminal offence later on. Stalking - criminological and criminal aspects

This thesis would like to inform the reader of a new crime in the Czech republic which is dangerous pursuit (stalking) and it aims at analysis of current legislation. It attemps to define dangerous pursuit, the emergence of this phenomenon from a historical point of view as well as its current interpretation. It also covers the penalties that can be imposed on the criminals. Moreover, it also looks at victims of dangerous pursuit and effective ways of helping the victims as well as the criminals.
Celebrity stalking

As Meloy (1998: 4) says: "Stalking is an old behavior, but a new crime. Postmodern society which is evolving not only in real environment but also in multimedia cyber-space brings much more instruments and trends where stalking can be realized. I focus my bachelor work on celebrity stalking, a specific type of stalking in which celebrities are the victims. Scholarly research on stalking exists and focuses on domestic violence, working environment, or other kinds of harassment. Celebrity stalking cases, however become public through the media especially from particular cases, mainly those of foreign celebrities, presented as tabloid articles. Because of the lack of formal research on celebrity stalking, I analyze the common forms and connections in celebrity stalking. My research is based on 5 qualitative interviews with celebrities who are victims of stalking. I try to define relationship between respondents and their fans where I am focusing on break point of change from common fan into chaser. Problems of discrimination in working environment

This thesis deals with the current issue of discrimination in the workplace, especially focuses on discrimination based on age and sex, sexual harassment and bullying in the workplace, legislation that regulates the area of discrimination in labor relations. The theoretical section includes explanations of terms and connections to a given focus and the practical part includes a probe into five large companies examining whether the effects mentioned in the theoretical part actually occur in practice, or how these problems are solved. This probe was in the form of semi-structured interview respondents in their workplaces. The results confirmed the claim that one of the most vulnerable group are women. Larger companies are trying to provide them a variety of advantages as for example flexible-time work, etc. Some companies have confirmed that there were some cases of bullying or sexual harassment in their firm, but these situations have not been solved other than by the dismissal of one of the participants. However, the occurrence of age discrimination was in the surveyed companies not confirmed - despite the theoretical claims and personal experience.
