Kadlec, Ondřej ; Koskan, Jan (referee) ; Linkeschová, Dana (advisor)
The aim of this work is to map the area of mobbing and bossing to find out how in recent years these concepts have become known, not only to managers but also to employees. Due to with increasingly hectic time, more and more demands are placed on employees and the associated motivation and demotivation. The work aim is to focus on the relationship between motivation and mobbing. What motivational benefits from increasing financial rewards to reducing contact with the aggressor lead the victim to remain in the position. One of the goals is to find out who can most easily fall victim in mobbing and also whether employees have enough confidence to report mobbing to their superiors. The main benefit of the work lies in the analysis the victims of mobbing, the subsequent inference of knowledge about the characteristics of these people and finding out the main motivators that would be a sufficient substitute for the unpleasant situation. The characteristic can be used in the preventive protection of potential victims. Motivators, in turn, can be used when the above-mentioned prevention fails.

The Role of the Grand Chambers of the Supreme Courts and of the Plenum of the Constitutional Court in Judicial Law-Making
Kadlec, Ondřej ; Ondřejek, Pavel (referee)
The Role of the Grand Chambers of the Supreme Courts and of the Plenum of the Constitutional Court in Judicial Law-Making Abstract Grand Chambers (GCs) are considered to be the most authoritative judicial bodies within multi-panel supreme courts. They are said to secure the unity, continuity, and quality of these courts' decision making. This thesis explores these claims in relation to GCs of three Czech highest courts - the Supreme Court, the Supreme Administrative Court, and the Constitutional Court. What is the role of the GCs in the decision-making of these Courts and how do the GCs fulfil their role? The thesis addresses these questions from both doctrinal and empirical angles. Doctrinally, it analyses with respect to all three courts the criteria for selecting GC cases, the character of GC decisions, and the status of GC precedents. Empirically, it explores how many and what type of cases the case-selection mechanism generates and how the GC's decisions influence the decision- making of other Court formations. On the basis of this analysis, the main argument of the thesis is that courts' use of GCs influences the way the multi-panel courts develop the law. The three key parameters of any GC that the thesis identifies are (i) the justification of its authority, (ii) the means of asserting its authority...

Přesnost nakládky do závěsného vertikálního míchacího krmného vozu
KADLEC, Ondřej
The theoretical part features an overview of the historical development of dairy cows feeding and introduces currently used trends in feeding. This part also outlines basic technologies in the production of roughage and describes modern feed distribution machinery. The practical part evaluates the accuracy of loading of individual components and the total weight of a feed ration loaded into a vertical suspension mixer feeder wagon by a front-end loader tractor. The observation was carried out at Mr. Kadlec's family farm in Velký Bor near Netolice and lasted four months. During this period, the actual weight of loaded components (grass-clover haylage, maize silage, grains meal) was being monitored daily. The evaluation came to a conclusion that grass-clover haylage stored in bales is loaded with a greater accuracy than maize silage stored in a clamp silo.
Methodology of legal interpretation in the case law of the Constitutional Court of the CR
Kadlec, Ondřej ; Kühn, Zdeněk (advisor) ; Tryzna, Jan (referee)
1 This paper consists of two different parts. The first part is theoretical and descriptive and its three chapters are organized deductively. The second part analyses a methodology of interpretation of the Constitutional court of the Czech Republic. The first chapter concerns with important legal concepts such as law certainty, predictability of courts' decisions, justice and equality. It concludes that a methodology of interpretation plays a crucial role in all of these concepts. Next chapter examines such terms as application of law, interpretation of law, law argumentation and methodology of interpretation. The last chapter of the descriptive part presents two judicial strategies to interpretation. Judges in the first strategy use only internal law arguments (mainly text of the statutes) as opposite to the second strategy where judges do not rely on the text at all, but interpret the law with external law arguments (such as intent, unexpressed law principle, economical argument etc.). This chapter also briefly describes the most common methods of legal interpretation for every judicial strategy. Eventually this part tries to provide modern strategy which combines methods used by both strategies and is based on rational, full and open explanation of court decisions. Afterwards the paper shifts the focus...
