Skripnik, Ondřej ; Sokol, Jan (advisor) ; Špinka, Marek (referee) ; Přibáň, Jiří (referee)
Between Biology and Law, notes to the anthropology of institution The aim of this text is to describe and to understand, how the biology, exactly human ethology works with the term human nature. The question is, if the theory of law could profit from the cooperation with human ethologic thinking, if the human ethology could be used as the background of nature law theories. Answering the question can be essential for the discussions about human rights. The first part describes the paradigms of classical and Neo-Darwinism ethology to compare these with the traditional concept of human nature in philosophy. Using anthropology of law (Hoebel, Pospíšil, Wesel) the explication accents the system of reciprocal obligation as a base of law. This point allows bringing some critical notes to the relevance of ethologic research for the theory of law. In the second part there are discussed four fields of human ethology research - territorial, competitive and anti-competitive, family behaviour, which are relevant for the property law, criminal law and family law. The reader can evaluate by himself the differences between the human ethology and social science perspectives.

The relationship between liability for damage and liability for defects
Valachovičová, Petra ; Švestka, Jiří (advisor) ; Salač, Josef (referee)
Résumé My diploma is focused on mutual relationship between the title from liability for damage and the title from liability for defect. Firstly, I tried to explain every institute separately and in the end of my work I dealt with their interrelation. In the first Chapter I outline a picture of civil liability in the level of juristic theory and I bring a view on the origin and content of civil liability. In this Chapter I point out that the understanding of the term of civil liability is non-uniform, which leads to serious opinion fragmentation. One of the main tasks of the legal order is to ensure the protection of the society and individual from the conception of damage with the aid of legal rules together with coercive state authority. It means that the protection of their health, property, as well as nature and the environment should be provided. Legal order realizes this task through the prevention of damage conception, what was the object of the second Chapter. I place emphasis on general and special prevention and I clarify in what they vest. General duty prevention imposes to everybody to act so, that no damage to health, property, nature or the environment will happen. Subsequently, special duty prevention imposes to the person, who possesses the risk of damage, to act within the context of its...

Indebtedness of individuals non-entrepreneurs and their subsequent inability to pay their obligations duly and on time was reflected not only in legislation designed to protect consumers but also to law that props up the debtor's financial position and provides him a second chance for a fresh start free of debt. The Insolvency Act passed through development during its efficiency i.e. from 1st August 2008, a considerable development, and according to the number of submitted insolvency proposals it became a legal instrument used by debtors to manage and address solving of their situation. We will be able to assess efficiency of utilisation this notion enabling discharge from debts in the next two or three years, when enough evidence should be available to evaluate the success of approved debt reliefs through the payment schedule.
