Representation of an enterpreneur in business relations

The purpose of submitted thesis is to analyze current regulation of one of the key institutes of law - institute of representation. The institute is common for different branches of law. The core of representation is mutual for all branches, although several differences appear. Regulation of this institute can be found in substantial as well in procedural law. The thesis focuses at representation of an entrepreneur (also referred to as a businessman) in particular. Duplication of regulation in Civil and Commercial Code results in fact, that appropriate provision of both Codes must be applied for proper interpretation. Institute of representation enables that under certain circumstances a legal person (proxy or authorized representative) can act for other legal person and in the name of other person (principal, mandator or donor of the power). Legal consequences - rights and duties - shall arise directly to the principal. Representation has long history, but contrary to other legal institutes, inspiration can not be found in Roman law, because Roman law did not recognize representation in modern understanding. REPRESENTATION This theses focused on representation in term sof civil law, family law and business law. This issues is processed komplex and contains all the basic attributes of representation. Theses is based on current treatment of private law and it highlights the changes in new civil Code effective since january 2012. It evaluates legislation in comparison with future changes. It refers to mootness, uncertainties and inaccuracies contained in the current Civil Code. The work focuses on the representation in general and its different types based on the Civil Code. It also contains a modification in the representation of the Commercial Code, which focuses on representing corporate and procuration. The presentation draws on family law representation and guardianship of minors, guardianship.

The graduation theses deal with contemporary legal regulations of the civil proceeding participants. A big attention was dedicated to particular definitions of the participants within contentious and non-contentious proceedings. The presumptions are being analysed of which a certain person can become the participant in proceedings and the presumptions of which the participant in proceedings is legitimated to act on his/her own behalf in the trial. Object of theses are also different kinds of representation of the participants, i.e. representation at law, representation at judicial decision or representation under the power of attorney. A relevant part of theses is characteristics of the principle of equality which is reflected in status of participants of the civil proceedings and is a part of the right of due process. Consumer loans and their impact on the debtor´s social situation

The bachelor's thesis entitled Consumer credits and their impact on the social situation of debtors investigates the causes and consequences of entering the credit contracts. Borrowing money becomes a risky phenomenon and has a very negative impact on the society. The theoretical part of the thesis describes the legal regulation of consumer credits and motivation of persons to enter them. It describes the causes leading to inappropriate indebtedness of persons, being normally not able to get a credit in view of their income. It refers to the facts stated in the business terms and conditions and practices of sellers and companies. Thanks to arrangements in the business terms and conditions which are an inseparable part of the contract and which are accepted by signing by the client, it may be agreed that a not paid claim may be ceded to a lawyer's company for collecting. In such a case, the debtor is obliged to pay also the costs of legal representation. The occurred claims are increased considerably by the court or arbitration proceedings. The people's low knowledge of this issue is confirmed also in the conclusion of bachelor's thesis. In the practical part of the research, three research questions were formulated: 1) Do the respondents use the consumer credits for the necessary subjects or services? 2) Does the company elaborates a financial plan for the borrower to estimate if he/she will be able to meet its obligation? 3) What impacts had exacting the claim on the social situation of the respondent or its family? 8 persons utilizing the services of Consulting Centre ? Equal Chances for Everybody operated by Jihočeská Růže o.s. took part in the research. The talks were performed individually and anonymously. The qualitative method of questioning and analysis of contents of documents deepening the research were applied. These documents were 315 credit contracts from a non-banking company which are handed over for collecting to a lawyer's office. The task of this thesis was to find out if the persons entering credit contracts behave maturely, if they think about the consequences of this behavior; if the inability to pay occurs only for external reasons or if these persons act rashly with the target to satisfy their momentary needs. The thesis shall research the purpose for which the households are inclined to enter credit contracts. I deepened this research also by the analysis of not paid credit contracts. By means of interviews with respondents I tried to describe the consequences of the financial burden of repayment of the claim on their life or life of their family. It was confirmed by the research that the concern are less necessary and more expensive goods. Lower share represented the credits for standard equipment of households. These goods were mostly electronics as notebooks and TV-sets. The talks with respondents confirmed also the statement that the credits are also used to pay the debts of another creditor. The respondents, who are not able to meet their obligations do not create any financial plans. This shows the low responsibility rate of these persons. Before entering the contract, they do not compare the products and do not ask about credit parameters. The research confirmed the prognosis of experts. The financial burden had a negative impact on the life of the family resulting in consideration of divorce. The respondents had negative psychological consequences manifested in the form of stress and depressions. The financial burden caused by collecting claims resulted in several cases in the inability to pay further obligations as e.g. housing. In one case, economic and cultural limitation occurred.

More Women into Politics: Civil Society Activities in the Czech Republic

The master's thesis deals with the role civil society plays in the process of introducing more women into politics. Women are significantly underrepresented in the Czech politics. This situation can be changed by adopting measures to support women in politics. These measures must either be voluntarily adopted by political parties or regulated by law. In order for political parties to recognize the necessity of such measures, they must be pressured by the voters. That is why nongovernmental organizations' activity is needed, as they are able to push interests through and they can inform public as well as cooperate with other subjects in order to achieve their goals. An example of such an organization is the organization Fórum 50 %, whose activities are subject to an analysis in this thesis. The master's thesis is divided into four chapters. The first part of the thesis covers the civil society and interest representation in theory. The second chapter is concerned with the concept of women's political representation, presents statistics of the number of women in Czech politics, identifies the main barriers that prevent women from political participation and introduces the instruments that can help regulate the amount of women in politics. The third chapter depicts female-oriented nongovernmental organizations in the Czech Republic after 1989 and the women's movement development. The last chapter focuses on the analysis of activities of the organization Fórum 50 %.
